After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3287. This certification allows you to use Nationwide Permit Number 39 when the Corps of Engineers issues it. This approval is also valid for the Neuse River buffer rules (15A NCAC 213 .033). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application except as modified below. If you change your project, you must notify us and you may be required to send us a new application.. If the property is sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be valid, you must follow the conditions listed in the attached certification and any additional conditions listed below. 1. Deed notifications or similar mechanisms shall be placed on alfremaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). 2. Stormwater shall be directed to flow at non-erosive velocities across the entire protected stream buffers. 3. Upon completion of the project, the applicant shall complete and return the enclosed "Certification of Completion Form" to notify DWQ that all the work included in the 401 Certification has been completed. The responsible party shall complete the attached form and return it to the 401/Wetlands Unit of the Division of Water Quality. The impacts are to a beaver marsh and to a pond dam so Table 2 on pg. 6 of the PCN form is correct as `NA' because there is no stream channel. Given this, we do not feel that mitigation should be required. Therefore we request that you proceed with processing and approval of our client's 401 water quality certification. Insufficient evidence is present in our files to conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H.0507. Therefore, unless modifications of the proposal are made as described below, we will have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e) and will place this project on hold as incomplete until we receive this additional information, we are requesting (by copy of this letter) that the US Army Corps of Engineers place your project on administrative hold. Privette (property owner), we hereby request authorization from the US Army Corps of Engineers to use Nationwide Permit 39 to cover impacts to two beaver impoundments and an emergent wetland (see attached impact map). We also request written concurrence from the NC Division of Water Quality (NC-DWQ) that the project complies with the 401 Water Quality Certification associated with Nationwide Permit 39 and the Neuse River Basin buffer rules. A Pre-construction Notification Application (PCN) is attached, which includes an agent authorization form. The proposed project, which consists of a residential development, is located on the south side of Tarboro Road (SR 1100) approximately one mile west of the intersection of Tarboro Road (SR 1100) and Mays Store Road (SR 1106). The property is bounded on the west by Little River. The project site is approximately 133 acres in size. Please refer to the USGS topographic map attached for the location of the project. S&EC conducted a detailed wetland delineation and Neuse River Basin (NRB) Riparian Buffer evaluation on the property in July 2001. Copies of the delineation map and data forms are attached for USACE review and approval. On August 3, 2001, Steve Mitchell of NC-DWQ performed a site visit and determined that features A and B (see figure 2) are not subject to the buffer rules. The remaining features on the property are subject as indicated on the attached overall site map. Sections of this tributary have been impounded due to beaver activity and were included in our delineation. The Neuse Buffer depicted on the impact map extends outward 50-feet from the edge of the wetlandstbeaver impoundments. The applicant chose this approach because the edge of water tended to fluctuate depending of the amount of rain and/or beaver activity. Please note that due to this approach, the buffers actually extend more than 50 feet from the water's edge in some cases. The proposed road, necessary to provide access to the eastern and western portions of the property, will impact a jurisdictional beaver impoundment and an emergent wetland (Impacts 1 and 2). The applicant will minimize impacts by locating the proposed road on top of an existing dam at the base of a drained pond. The proposed crossing, Impact 2, will impact 128 linear feet of impounded water and 2,251 sq. ft. of wetlands (0.05 ac.). Approximately 6,752 square feet of riparian buffer (Zone 1-4,346 sq. ft., Zone 2-2,406 sq. ft.) will also be affected at the proposed crossing location. Impact 1 comprises 0.07 acres of wetland impact. Impact 3 In order to access the southeastern portion of the property it is necessary to cross a beaver impoundment, also subject to the Riparian Buffer Rules. Impact 3 consists of 5,793 square feet (0.13 acre) of emergent wetland within a beaver impoundment. The proposed crossing will impact approximately 133 linear feet of impounded water and 5,741 square feet (Zone 1-3,632 sq. ft., Zone 2-2,109 sq. ft.) of riparian buffer. The USACE's current policy requires applicants to avoid and minimize wetland and stream channel impacts to the maximum extent practicable and may require compensatory mitigation to offset unavoidable losses of waters of the US when impacts exceed the requirements for notification (0.10 acre) or if a discharge to a special aquatic site such as wetlands is proposed. Total wetland impacts on site are 0.25 acres. The applicant requested a detailed delineation of wetlands present on property prior to site plan development in order to avoid jurisdictional wetlands to the maximum extent practicable. However, an unnamed tributary to Little River is present on-site. This tributary separates the eastern and western portions of the property. An additional beaver impoundment must be impacted in order to access the southeastern portion of the property. All roadway crossings will be constructed perpendicular to wetlands. Because all roadway crossings will be constructed perpendicular to jurisdictional areas, and because the applicant plans to maintain riparian buffers on all streams on-site and will maintain the remaining 2.7 acres of wetlands through deed notifications, S&EC believes the USACE should not require further compensatory mitigation for this project. December 6, 2001 S&EC Project k 99-5099 Page 3 of 3 NC-DWQ's current policy requires written concurrence for impacts to any stream channel within the Neuse River Basin. Because the applicant plans to permanently impact beaver impoundments subject to the buffer rules, S&EC requests written concurrence that the project complies with the 401 Water Quality Certification associated with the Nationwide Permits 39. NC-DWQ's current policy does not require wetland or stream mitigation for wetland and stream channel impacts below 1 acre and 150 linear feet per tributary. Because the total cumulative permanent impacts for the site is 0.25 acre of wetland, and because the permanent impacts to beaver impoundments/channels are below 150 feet, S&EC believes that neither wetland nor stream mitigation should be required by NC-DWQ. As noted above, the two tributaries of the Little River on-site are subject to the buffer rules. Little River, which constitutes the western boundary of the project, is also subject. The cumulative riparian buffer impacts to beaver impoundments (Impacts 2 and 3) are both less than 150 linear feet and less than 1/3 acre of buffer impacts. Current NC-DWQ policy allows road crossing without mitigation if the impacts are less than or equal to 150 linear feet of stream channel or 1/3 acre of riparian buffer per tributary. Because the project impacts are within these thresholds, S&EC believes that riparian buffer mitigation should not be required. S. The DWQ issues a corresponding Certification (General or Individual), and cannot tell the applicant which 401 Certification will apply until the 404 Permit type has been determined by the USACE. Applicants are encouraged to visit DWQ's 401/Wetlands Unit website at http:/Ah2o.enr.state.nc.us/ncwetiands to read about current requirements for the 401 Water Quality Certification Program and to determine whether or not Riparian Buffer Rules are applicable. The applicant is also advised to read the full text of the General Certification (GC) matching the specific 404 Permit requested. Trout Waters Coordination - Special coordination with the North Carolina Wildlife Resources Commission (NCWRC) is also required for projects occurring in any of North Carolina's twenty-five counties that contain trout waters. In such cases, the applicant should contact the appropriate NCWRC regional coordinator (listed by county on the last page of this application).
