You will receive an email with payment requirement/details. In addition, this project is subject to the Jordan Lake Riparian Buffer regulations and therefore will require a buffer authorization, please update the PCN form and plan sheets accordingly. In order to review the buffer impacts please provide plan sheets which clearly show the existing Jordan Lake Riparian Buffer (50 feet from the top of bank) that is outside of the maintenance corridor, and the proposed 50 foot buffer for the new stream alignment. Please provide a permanent buffer restoration plan, including a monitoring plan, for any areas outside of the ROW. Please note that the relocation of the stream will create new buffers which will impact the adjacent landowner. The adjacent landowner should be made aware of future restrictions within the new protected buffer. Please copy me on your response to David's request below. I have reviewed the information and need clarification before proceeding with verifying the use of Nationwide Permit 13 (http://saw-reg.usace.army. mil/NWP2017/2017NWP13.pdf [saw-reg.usace.army. mill). Please submit the requested information below (via e-mail is fine) within 30 days of receipt of this Notification, otherwise we may deny verification of the use of the Nationwide Permit or consider your application withdrawn and close the file: 1. The purpose of the project as proposed is to protect/maintain an existing pipeline, rather than to control or prevent erosion. Otherwise, avoidance and minimization would point toward stabilizing the stream channel in place rather than relocation. As such the project is not a good fit for NWP 13. Rather, the project is a better fit to use NWP 39; 2. Please provide a profile view along the centerline of the proposed channel relocation; 3. Please note that, at such point that the a NWP verification is processed, Special Conditions would be included requiring photo monitoring for at least 3 years post construction. March 16, 2020 - Mr. and Mrs. Thelen, 680 Waynick Road C A R D I N A L Reidsville, NC 27320 �' RE: Cardinal Pipeline Stream Stabilization and Protected Riparian Buffer Mr. and Mrs. Thelen, While permitting for the proposed Cardinal Pipeline stream stabilization project on your property (680 Waynick Road), American Land Concepts (contracted by Cardinal) has determined the Limits of Disturbance are within the Jordan Lake watershed, which is subject to the Riparian Buffer Protection Program (15A NCAC 02B .0267). The purpose of the rule is to protect the Riparian BuFFer (50 feet from the top of bank) by limiting any disturbances within this area. There are two zones within the Riparian Buffer. Zone One is from the top of stream bank and extends landward a distance of 30 feet. Zone Two begins from the edge of Zone 1 and extends landward a distance of 20 feet. As you are aware, the proposed stream stabilization will shift the stream alignment east, which will subsequently shift the Riparian Buffer on your prop ex�ty. Please see attached Exhibit A which identi£aes the existing and proposed stream alignments and the change in Riparian Buffer. As a condition for acquiring the authorization, Cardinal Pipeline will be required to replant the Riparian Buffer within the Limits of Disturbance; excluding the pipeline right -of --way. Currently, plans call for American Land Concepts to plant at least 66 trees within the Limits of Disturbance and adjoining areas of the Riparian Buffer not currently forested. No trees will be planted within the Cardinal Pipeline right-of-way. This replanted area will be protected land, and minimal to no disturbance can occur in this area. Below are some examples of common practices that a property owner may do within the Riparian Buffer that are exempt From Riparian Buffer Rule for Jordan Lake. These practices can occur without any authorization from NC DEQ: • Vegetation management: o Emergency fire control measures provided that topography is restored o Mowing or harvesting of plant products in Zone Two o Planting vegetation to enhance the riparian buffer o Pruning forest vegetation provided that the health and function of the forest vegetation is not compromised o Removal of individual trees that are fn danger of causing damage to dwellings, other structures or human life, or are imminently endangering stability of the streambanlc. o Removal of individual trees which are dead, diseased or damaged. o Removal of poison ivy o Removal of invasive exotic vegetation • Access Trails: o Pedestrian access trails leading to surface water that are restricted to the minimum width practical and that do not exceed 4 Feet in width of buffer disturbance, and provided there is no removal of trees and no impervious surfaces are added to the riparian buffer. • Fertilizer application: o One-time application to establish vegetation • Playground equipment: o Playground equipment on single family lots provided that installation and use does not result in removal of vegetation. Grading and revegetation in Zone Two provided that diffuse flow and the health of existing vegetation in Zone One is not compromised and disturbed areas are stabilized until they are revegetated. Fencing: o Install Fences provided that disturbance is minimized and installation does not result in removal of trees as defined in this Riparian Buffer Protection Ordinance. Below are some examples of common practices that a property owner may do within the Riparian Buffer that are allowable, but Access Trails: o Pedestrian access trails that exceed 4 feet in width of buffer disturbance, the installation results in removal of trees, or impervious surfaces are added to the riparian buffer. • Playground equipment: o Playground equipment on single family lots that requires removal of vegetation. • Fencing: o Install Fences provided that disturbance is minimized and installation results in removal of trees as defined in this Riparian Buffer Protection Ordinance. ��1 • Recreational and accessory structures in Zone Two: 1 `� o Sheds and gazebos within Zone Two provided the total footprint is less than or equal to 150 square feet and provided they are not prohibited under a local water supply ordinance. o Wooden slatted decks and associated steps, provided the deck is at a minimum of 8 feet in height and no vegetation is removed from Zone One.
