Dear Mr. Bakopoulas:
You have our approval, in accordance with the attached conditions, to place fill in 0.1 acre of vegetated wetlands in
ordeer to construct a retaining wall on Lot 19, block 21, section 1, Croatan Shores in Kill Devil Hills, Dare County, as
described in your application received by the Division of Water Quality on November 27, 2001. After reviewing your
application, we have determined that this fill is covered by General Water Quality Certification Number 3274, which can be
dovmloaded from our web site at httD://h2o_enr.state.ric.us/ncwetlands . This Certification allows you to use your CAMA
Permit when it is issued by the NC Division of Coastal Management. In addition, you should get any other federal, state or
lo-i permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-
Dr".swlarge and Water Supply Watershed rerUttions. Also this approval will expire when the accompanying CAMA Permit
expires unless otherwise specified in the Ge:>sral Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your

8. PROJECT SUMMARY: The applicant, Mr. Bakopoulas proposes to construct a 53.5 linear
foot retaining wall landward of normal water level and the adjacent coastal wetlands. The
project will include the filling of approximately 4,356 square feet of delineated 404 wetlands,
adjacent to Kitty Hawk Bay, on Lot 19, block 21, section 1, Croatan Shores, on Bay Drive, Kill
Devil Hills, Dare County.

PROJECT SITE
The applicant's property is located on the west side of Bay Drive, 150 feet south of the
intersection of Bay Drive and Third Street, adjacent to Kitty Hawk Bay, in Kill Devil Hills, Dare
County. The physical address for the property is 1734 Bay Drive. The Bakopoulas property
consists of three 50' wide undeveloped lots that are primarily wooded. Each lot consists of
approximately .3 acres with Section 404 Wetlands and Coastal Wetlands. The project site is
located on the northern most lot adjacent to a three-story cedar sided home. Coastal Wetlands on
the property are limited to a waterward fringe that ranges from 39' to 55'deep, measured from
the waterward edge to its landward extent, and have been verified by a Coastal Management
Field Representative. Section 404 Wetlands have also been delineated on the property and have
been verified by the Army Corp of Engineers. The total area of wetlands on the property is
approximately 6,990 square feet.
Trees found on the property include, but are not limited to, loblolly pine, black willow,
water oak, magnolia, and red bay. The vegetative understory includes wax myrtle, canebrake,
brier, and poison ivy. Coastal Wetland vegetation consists of common reed, big cordgrass and
saltmeadow cordgrass. A variety of submerged aquatic vegetation is know to grow in the waters
adjacent to the applicant's property in Kitty Hawk Bay.
Properties in this area are supplied water by the Dare County Water System and are
serviced by on-site waste disposal systems. The applicant's property is located in a residentially
developed area. Located immediately north of the applicant's property is a recently
constructed single-family residence and to the south is a small duplex condominium.
Development east of the property is also residential in nature.
According to the Flood Insurance Rate Map the property is located in an AE (9) Flood
Zone and the average elevation of the property is approximately seven feet above mean sea level.
Colington Bay is classified as joint waters by agreement between the Marine Fisheries
Commission and Wildlife Resource Commission. The Division of Environmental
Management's water quality classification for Currituck Sound is SC (fish propagation).
Additional review indicates that there are no known geological formations associated with the
applicant's property. There is one identified archeological site within a half mile of the
applicant's property (DR56).
PROJECT DESCRIPTION
The applicant proposes the following activities:
1) Mr. Bakopoulas proposes to construct a 64.5 linear foot retaining wall landward of
Coastal Wetlands and normal water level (NWL). The placement of the retaining wall
will be approximately two feet above existing grade, and will tie into a retaining wall on
the adjoining property to the north. A nine-foot return wall is proposed along the
southern property line. Approximately 12 linear feet of the proposed retaining wall will
be within the 30' buffer along the northern corner. Backfill for the retaining wall will
include fill in Section 404 Wetlands.

According to the application the owner is requesting a bulkhead for shoreline
stabilization. However, field inspection of the property indicates that with the exception
of slight erosion near the northern corner of the applicant's property, there is no evidence
of erosion on the site.
2) The applicant would also like to fill Section 404 Wetlands, not in association with the
construction of the retaining wall. It should be noted that no Section 404 Wetland fill is
proposed within the 30' of NWL.
The total area of Section 404 Wetlands that the applicant is proposing to fill in
association with this project is 4, 356 square feet (.10 acre). The total area of high ground to be
filled in association with the request will be 678 square feet, of which approximately 64 square
feet will be within the 30' buffer. The applicant proposes to place approximately 373 cubic
yards of fill on the property in question.
ANTICIPATED IMPACT
• The loss of 4,356 square feet of Section 404 Wetlands.
• Elevation of the property two feet above existing grade will result in changing
surface runoff patterns on the applicant's property.
• A small pocket of Section 404 Wetlands will be left unfilled in the adjacent
property to the north. It is reasonable to assume that this very small pocket will
be lost in the firture from incidental fill.
• A secondary impact of the proposed fill activity will be the development of the
property for a single-family residence that will include the placement of an on-site
waste disposal system.
• Another secondary impact will be the "water dependent" development that comes
with water front residential development.

PROJECT NARRATIVE - CAMA Major Permit Application
Nicholas Bakopoulas - Lot 19, Block 21, Section .1, Croatan Shores
Kill Devil Hills, NC
Nicholas Bakopoulas proposes to construct 64.5 linear feet of bulkhead (includes 9' return wall) and
backfill to provide shoreline protection to his soundfront lot in Croatan Shores. This application also
proposes to fill 4,353 s.f. (0.10 ac.) of 404 wetlands to prepare the site for residential construction. The
bulkhead will begin at the north adjoining to the existing bulkhead of the north adjacent land owner. The
9' return wall will be located at the south end 'of the property line. The alignment of the proposed bulkhead
is landward (-50') of the NWL and all coastal wetlands. To backfill behind the bulkhead 404 wetlands and
highground will be filled to cover the tie backs. Total fill proposed within 75' AEC setback is
approximately 2,021 s.f. Total fill proposed within the 30' Buffer is approximately 64 s.f.(highground fill
area). Fill will be brought to the site from a commercial source using dump trucks and smoothed and
graded using a bull dozer. No coastal wetlands will be impacted by this carefully designed project No
open water will be filled as well.
