APPROVAL of 401 Water Quality Certification
Dear Mr. Jones:
You have our approval, in accordance with the attached conditions, to dredge and fill 0.73 acres of non-vegetated
wetlands in order to replace a bulkhead, conduct maintenance dredging of an existing canal, and grade/clear/landscape the
property adjacent to the canal on your property in Craven County, as described in your application received by the Division
of Water Quality on November 20, 2001. After reviewing your application, we have determined that this fill is covered by
General Water Quality Certification Number 3274, which can be downloaded from our web site at
http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use your CAMA Permit when it is issued by the NC
Division of Coastal Management. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying CAMA Permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification as well as the additional conditions listed below:
1. The mechanical dredging phase of this work must be completed prior to implementation of your buffer restoration
plan; ' .
2. All sediment and erosion control measures must be in place throughout the dredging phase of construction.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must
act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-
7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you

8. PROJECT SUMMARY: The applicant proposes to replace a failing bulkhead (total linear
footage 642 ft.); maintenance dredge an existing canal (total spoil volume to be removed 700

canal.
9. NARRATIVE DESCRIPTION
Project Setting
E.M.D., LLC owns a 2.95 acre tract surrounding the head of an unnamed canal that flows to the
Trent River. Elevations on the tract rise from 3 ft. above sea level at the canal to approximately
10 ft. above sea level along Hillcrest Road and Trent River Drive. The property was cleared
and graded without authorization during September 2001. In order to stabilize the site, the
applicant has installed a silt fence upslope from the existing bulkhead, mulched the tract, and
seeded the tract. As of the date of this field report grass has begun to germinate over much of
the site. Only a few trees were left standing on what was previously a densely vegetated tract.
A house previously located at 207 Hillcrest Road and within the boundaries of this tract was
also demolished and removed during the clearing. In response to this activity, the Division of
Coastal Management (DCM), the Division of Water Quality (DWQ), and the Division of Land
Resources (DLR) has initiated enforcement actions against E.M.D., LLC. To date, restoration
activities continue for both DWQ and DLR. The applicant has satisfied restoration efforts
required by DCM and a civil assessment will be issued shortly.
From the applicant's property boundary, the canal flows some 560 ft. to the Trent River. The
canal and the applicant's property are bordered by a residential community. The canal varies
in depth from -2.5 ft. NWL at the canal mouth to -5 ft. NWL near the head of the canal.
Likewise the canal varies in width from a minimum of 20 ft. to a maximum of + 60 ft. Some
coastal marsh and wetlands borders the canal in this area. Downstream of the applicant's
property the canal is currently used for recreational boating access via existing single-family,
residential piers. The canal is not designated as a Primary Nursery Area nor is it open to
shellfish harvesting. While the canal is not classified by the DWQ, it carries the same
classification as its connecting waters, the Trent River, which is SIB SW NSW. In addition the
canal acts as a receiving point for stormwater runoff via existing pipe and culvert from Country
Club Road (NCSR 1200).

Project Description
The applicant proposes to replace the failing bulkhead with a new one. The alignment of the
new wall is shown 2 ft. waterward of the existing wall resulting in the placement of 119 yds.' of
backfill in open water. Total length of the new wall is 642 ft. The new wall will be constructed
of treated lumber. The height of the wall from the canal bottom to the top of the wall is 7.5 ft.
There will be four 4" x 6" whalers spaced evenly from the bottom of the wall to the top. Pilings
will be located on 5.5 ft. centers. Each piling will be tied back through the top whaler to a 6"
timber at least 10 ft. landward of the new wall via 3/" galvanized tie rod. Pilings and tie back
timbers will be embedded a minimum of 8 ft.
The applicant also proposes to maintenance dredge the canal to a maximum depth of -5 ft.
NWL. Dredging will be accomplished via mechanical digging techniques. The dredging has
been divided into two separate zones. Zone A (280 linear feet) is located from the head of the
canal to the applicant's southern property line or contiguous to the new bulkhead. Maximum -
5 ft. contour width will be 41 ft. Bottom contours will rise at a 1:3 slope to a uniform depth of -
2.5 ft. NWL immediately adjacent to the new bulkhead. This,-2.5 ft. depth will extend
approximately 3ft. waterward from the new bulkhead. Total spoil volume removed from Zone A
= 380 yds.'. Zone A will be excavated from the shore using a backhoe and dump truck.
Zone B (568 linear feet) will continue the -5 ft. depth throughout the remaining length of the
canal to the Trent River. Maximum -5 ft. contour width will not exceed 8 ft. Outside the -5 ft.
contour, the bottom will rise at a 1:2 slope to meet existing contours. Maximum excavation
width in Zone B will be limited to 30 ft. Total spoil volume removed from Zone B = 320 yds.'.
Of the 568 ft. to be excavated in this zone, only the southernmost 50 ft. will fall outside the
canal, in open waters of the Trent River. This portion of the excavation will connect the canal
to the -5 ft. contour in the Trent River. Zone B will be excavated using a mechanical excavator
on a small barge.
No wetlands, coastal marsh, or aquatic vegetation will be excavated or filled as part of the
maintenance dredging or bulkhead installation.

Spoil generated from the maintenance dredging will be placed on applicant's property and
utilized as backfill behind the new bulkhead. The placement of this backfill will raise existing
elevations at the canal by an average depth of 1.05 ft. A slight swale will be placed 2 ft.
landward of the wall to prevent surface runoff from spilling over the new wall. All filled areas
will be compacted, seeded, and mulched. Silt fences will remain in place throughout
construction until disturbed areas are stabilized.
Anticipated Impacts
The proposed maintenance excavation will require the removal of 700 yds.3 of spoil from a
0.74 acre area within an unnamed canal tributary to the Trent River. The mechanical removal
technique, both from high ground and via barge with excavator, will likely cause some short
term turbidity impacts. The spoil will be deposited over 0.44 acres of uplands surrounding the
head of the canal and permanently stabilized. Turbidity impacts can also be expected during
bulkhead installation. Future development of the site will include the construction of single
family residences including driveways, septic systems, landscaping, etc.
