USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Fede, al Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include.
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams: and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project. a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
h ttp:l/h2o.enr.state.nc.us/ncwetlands/strmgide.html.
Provide a brief description of the proposed mitigation plan- The description should provide
as much information as possible including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/) i near feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.
2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration
Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that
you would like to pay into the NCWRP. Please note that payment into the NCWRP must be
reviewed and approved before it can be used to satisfy mitigation requirements. Applicants
will be notified early in the review process by the 401/Wetlands Unit if payment into the
NCWRP is available as an option. For additional information regarding the application
process for the NCWRP. check the NCWRP website at http://li2o.enr st,tte nc u,Iwrv/index htm. If
use of the NCWRP is proposed, please check the appropriate box on page three and provide

Dutchman's Branch [03-04-02; 27-43-4.5; WS-III (Water Supply) NSW]
To Whom It May Concern,
On November 14, 2001, the Division of Water Quality (DWQ) visited the subject property in response to a citizen
complaint. The complaint involved clearing of vegetation adjacent to a stream within the Lake Wheeler watershed.
Please be aware that the stream located adjacent to the western property boundary of the subject property is an intermittent
stream within a water supply watershed and subject to the Neuse River Buffer Rules (15A NCAC 2B .0233). The stream
is indicated as an intermittent stream on both the Lake Wheeler USGS topo (1":2000' scale) map and the Wake County
USDA Soil Survey. It was determined by the DWQ (based on this site visit) that all clearing of vegetation occurred
greater than thirty (30) feet from the bank of the stream. Therefore, it was determined by the DWQ that the site is
currently in compliance with the DWQ water supply regulations for WS-III waters (15A NCAC 2B .0215) and the Neuse
River Buffer Rules (15A NCAC 2B .0233). -However, it appears that potential parallel impacts to the Neuse River
Buffers may occur with regards to the placement of the driveway.
The Neuse River Buffer Rules (15A NCAC 2B .0233) protect fifty (50) foot riparian areas (buffers) along surface
waters (including, but not limited to, intermittent streams) within the Neuse River basin. The Neuse River Buffer Rules
(15A NCAC 2B .0233) that protect these areas have been in place as temporary rules since July 22, 1997. The 50-foot
buffer is divided into two Zones. The first zone, Zone 1, consists of the first 30 feet from the bank of the stream. This
zone is intended to be an undisturbed vegetated area. The second zone, Zone 2, consists of the outer 20 feet of the 50-foot
buffer. This zone is intended to be a managed vegetated area. Clearing and grading is allowed within Zone 2 as long as
the area is left vegetated. No new impervious-surface is allowed within the 50-foot buffer.
As stated above, the DWQ has determined that the site is currently in compliance with the Neuse River Buffer Rules
(15A NCAC 2B .0233). However, if you wish to place the driveway within 50 feet of the bank of the stream it will
require submittal to and approval from the DWQ prior to construction. The DWQ recommends that you review your
design plans for the driveway (and any other impervious surfaces), measure the distance to the bank of the stream and
determine if any impacts to the 50-foot buffers are proposed. If so, please call the DWQ 401 Wetlands Unit at 919-733-
1786 to receive information on how to apply for the proposed impacts.
This letter is only intended to provide you with notice of the Neuse River Buffer Rules and other DWQ regulations
and does not authorize any impacts to wetlands, waters or protected buffers. A copy of the buffer rules and other DWQ
regulations can be found at our web site (http://h2o.enr,state.nc.us/ncwetlands/) or by calling 919-733-1786. Please
contact,Mr. Bob Zarzecki of this office at 919-733-9726 if you have any questions. You may also contact your DWQ
regional office located in Raleigh, NC at 919-5714700. You are not required to respond to this letter.

John,
I received a call from Mr. Lipkin last week and past it on to Steve. I know nothing of what they where

Steve, This is the site referred to in the email below. Did you get a chance to go to the site? If not, let
me know I'll head out there during lunch today.

"Steve,
I just received a call from a Mr. Herman Lipkin (852-4886) concerning a
potential violation of either buffers, 401 or erosion and sediment
control. He said that they are working very close to a stream. The
subject property is adjacent to his. He lives at 2608 Bradford Grove
Place, off Graham-Newton Road, two blocks from Penny Road, Raleigh. The
subject property apparently has a construction entrance off Blue Cypress
Lane (possibly a new road). Please have someone over there check into
this. Let me know if no one can get to it and I'll see if I can get out
there tomorrow. Thanks,
- Bob"
