APPROVAL of 401 Water Quality Certification w/ ADDITIONAL CONDITIONS
Dear Mr. Andrews:
You have our approval, in accordance with the attached conditions and those listed below, to impact 80 feet of stream to
construct the proposed development at the subject property as described within your application dated May 10, 2002 and
received by the Division of Water Quality (DWQ) on June 13, 2002. After reviewing your application, we have determined
that the impacts are covered by the Division of Water Quality (DWQ) General Water Quality Certification Number 3362.
This Certification allows you to use Nationwide Permit No. 39 when issued by the US Army Corps of Engineers (USACE).
In addition, you should get or otherwise comply with any other federal, state and local requirements before you go ahead
with your project including (but not limited to) Erosion and Sediment Control Permit, water supply regulations and the
approved Major Variance. Also, this approval will expire when the accompanying 404 permit expires unless otherwise
specified in the General Certification. You should contact the USACE Raleigh Regulatory Field Office at 919=876-
8441 regarding regarding the use of Nationwide Permit No. 39 if you have not already done so.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application. If the property is sold,
the new owner must be given a copy of this Certification and approval letter and is thereby responsible for complying with
all conditions. If total fills for this project (now or in the future) exceed one acre of wetland or 150 feet stream,
compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you
must follow the conditions listed in the DWQ General Water Quality Certification No. 3362 and any additional conditions
listed below.

• You shall comply with all of the conditions of Major Variance approved by the Water Quality Committee (WQC) of the
Environmental Management Commission (EMC) on September 12, 2001 and provided within the Major Variance
Approval letter dated October 17, 2001.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition, which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.

Please find attached my PCN application form requesting permission to construct a
commercial building at 4406 Roxboro Rd in Durham, N.C. I have enclosed a copy of the
site plan with vicinity map as well as a copy of variance which was approved through the
office of Bob Zarzecki. This application was placed previously in September 01. 1
received a letter in November 01 requesting a check for the fee of $200 and additional
maps etc. I sent the information requested in December 01 with a note that a check
(number 7477) had been sent with the original application. The check cleared on 12-10-
01) and when 1 had not heard anything until April, I called Bob to find out what the hold
up was. He suggested that there must have been a holdup in the mail and I should
prepare another package. This is the new package with everything which 1 understand is

On September 17, 2001, the Water Quality Committee (WQC) of the EnlvironmetiW Management Commission
(EMC) approved with the conditions listed below your Major Variance Request to impact approximately.80 feet of
intermittent stream channel and its associated riparian buffers to construct the proposed commercial, development as
described within your Major Variance Request dated August 15, 2001. As stated within our 1cner to you dated August 30,
2001, written concurrence from this office for the use of DWQ General Cetti.ftcatioti Number 3287 (GC3287) (assuming that
you choose to use the US Army Corps of Engineers (USACE) Nationwide Permit (NWP) No. 39 to impact the stream) is
rcquircd prior conducting the activities approved under the Major Variance. To obtain this written concurrence you will
need to submit seven copies of the Pre-Construction Notification Application Form (PCN) to this office. A permit
application fee of $200 will be required for the PCN'submittal. You can download a digital copy of the PCN and obtain
additional information concerning GC32$7 and other certifications from, our web site address listed below. In addition, you
most likely will be requimd to submit a copy of this form to the USAGE for approval of NWP39. You should contact the
USAGE Ralcigh Reg-olatory Field Office at 919-876-844I regarding this.
Conditions required by the WQC for the approval of the Major Variance include the following.
I. A final, written stormwatCr management plan shall be approved in writing by this Office before the impacts specified in
the Major Variance Approval occur. The stormwater management plan must include plans and specifications for
stormwater management facilities designed to reilmve 85% TSS according to the most recent version of the NC DENR
Stormwater Best Management Pmcticrs Manual_ The stormwater management plan must include at least a sand filter
stormwater management facility that meets DWQ specifications as required by the WQC. Thesc facilities must be
designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water ' ..
Quality (DWQ). Also, before any permanent building is occupied at the subject site, the facilities (as approved by this
Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be

M. Project Information
Attach a vicinity map clearly showing the location of the property with respect to local
landmarks such as towns, rivers, and roads. Also provide a detailed site plan showing property
boundaries and development plans in relation to surrounding properties. Both the vicinity map
and site plan must include a scale and north arrow. The specific footprints of all buildings,
impervious surfaces, or other facilities must be included. If possible, the maps and plans should
include the appropriate USGS Topographic Quad Map and NRCS Soil Survey with the property
boundaries outlined. Plan drawings, or other maps may be included at the applicant's discretion,
so long as the property is clearly defined. For administrative and distribution purposes, the
USACE requires information to be submitted on sheets no larger than 11 by 17-inch format;

VII. Impact Justification (Avoidance and Minimization)
Specifically describe measures taken to avoid the proposed impacts. It may be useful to provide
information related to site constraints such as topography, building ordinances, accessibility, and
financial viability of the project. The applicant may attach drawings of alternative, lower-impact
site layouts, and explain why these design options were not feasible. Also discuss how impacts
were minimized once the desired site plan was developed. If applicable, discuss construction
techniques to be followed during construction to reduce impacts.
I own property at the intersection of Roxboro and Duke Street (4406, 4412, 4416 Roxboro Rd.) and have had a
garden center business there for the past 21 years. All totaled, I have approximately 8600 sq.ft of deteriorated
commercial buildings. For several years I have planned to upgrade and build a new building. As I recently pursued
this end, I found that the tree ordnance of Durham was placing an inordinate restriction on my development plans. I
had no existing trees, had extensive sewer, utility and storm water easements on which you cannot build and cannot
plant the trees for the ordnance. The rules state that the trees must occupy 14% of the project. Therefore I had to
consider buying the adjacent lots that have adequate trees on them to meet the tree ordnance requirements. This
VIII. Mitigation
DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC
Division of Water Quality for projects involving greater than or equal to one acre of impacts to
freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial
streams.
USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide
Permits, published in the Federal Register on March 9, 2000, mitigation will be required when
necessary to ensure that adverse effects to the aquatic environment are minimal. Factors
including size and type of proposed impact and function and relative value of the impacted
aquatic resource will be considered in determining acceptability of appropriate and practicable
mitigation as proposed. Examples of mitigation that may be appropriate and practicable include,
but are not limited to: reducing the size of the project; establishing and maintaining wetland
and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of
aquatic resource functions and values by creating, restoring, enhancing, or preserving similar
functions and values, preferable in the same watershed.
If mitigation is required for this project, a copy of the mitigation plan must be attached in order
for USACE or DWQ to consider the application complete for processing. Any application
lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as
incomplete. An applicant may also choose to review the current guidelines for stream restoration
in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at
http://l12o.enr.state.nc.us/ncwetlaiids/strmgide.htm].
Provide a brief description of the proposed mitigation plan. The description should provide
as much information as possible, including, but not limited to: site location (attach directions
and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet)
of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view,
preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a
description of the current site conditions and proposed method of construction. Please attach
a separate sheet if more space is needed.

' Dear Mr. Andrews,
On September 12, 2001, the Water Quality Committee (WQC) of the Environmental Management Commission
(EMC) approved with the conditions listed below your Major Variance Request to impact approximately 80 feet of
intermittent stream channel and its associated riparian buffers to construct the proposed commercial development as
described within your Major Variance Request dated August 15, 2001. As stated within our letter to you dated August 30,
2001, written concurrence from this office for the use of DWQ General Certification Number 3287 (GC3287) (assuming that
you choose to use the US Army Corps of Engineers (USACE) Nationwide Permit (NWP) No. 39 to impact the stream) is
required prior conducting the activities approved under the Major Variance. To obtain this written concurrence you will
need to submit seven copies of the Pre-Construction Notification Application Form (PCN) to this office. A permit
application fee of $200 will be required for the PCN submittal. You can download a digital copy of the PCN and obtain
additional information concerning GC3287 and other certifications from our web site address listed below. In addition, you
most likely will be required to submit a copy of this form to the USACE for approval of NWP39. You should contact the
USACE Raleigh Regulatory Field Office at 919-876-8441regarding this.
Conditions required by the WQC for the approval of the Major Variance include the following.
A final, written stormwater management plan shall be approved in writing by this Office before the impacts specified in
the Major Variance Approval occur. The stormwater management plan must include plans and specifications for
stormwater management facilities designed to reriiove 85% TSS according to the most recent version of the NC DENR
Stormwater Best Management Practices Manual. The stormwater management plan must include at least a sand filter
stormwater management facility that meets DWQ specifications as required by the WQC. These facilities must be
designed to treat the runoff from the entire project, unless otherwise explicitly approved by the Division of Water
Quality (DWQ). Also, before any permanent building is occupied at the subject site, the facilities (as approved by this
Office) shall be constructed and operational, and the stormwater management plan (as approved by this Office) shall be
implemented. The structural stormwater practices as approved by this Office as well as drainage patterns must be

maintained in perpetuity. No changes to the structural stormwater practices shall be made without written authorization
from the Division of Water Quality. Please include the revised plans that meet DWQ specifications within your PCN
submittal. To discuss these specifications please contact Mr. Todd St. John of this office at 919-733-9584.
2. You are required to mitigate for impacts to the protected riparian buffers. We understand that you wish to make a
payment into the Riparian Buffer Restoration Fund administered by the NC Wetlands Restoration Program (WRP) to
meet this mitigation requirement. This has been determined by the WQC to be a suitable method to meet the mitigation
requirement. Please provide the area (in square feet) of Zone 1 and Zone 2 of the buffer proposed to be disturbed by this
project. Please include this information within your PCN submittal.
3. You are required to provide nutrient off-set payments into the NC Wetlands Restoration Program (WRP) as required
under the Neuse River Basinwide Stormwater Requirements (15A NCAC 2B .0235 and .0240). You must contact the
subject local government (City of Durham) and NC Wetlands Restoration Program to work out the details of providing
this payment. Until the WRP receives and clears your check (made payable to: DENR - Wetlands Restoration Program
Office), no impacts specified in the Major Variance Approval can occur.
If you do not accept any of the conditions of this Major Variance Approval, you may ask for and adjudicatory hearing. You
must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter
150B of the North Carolina General Statutes to the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27699-
6714. This Major Variance Approval and its conditions are final and binding unless you ask for a hearing.

You'll need to fill out and submit 7copies of the PCN form with the required
application fee of $200 to this office for the use of Nationwide Permit 39
(info. at http://h2o.enr.state.nc.us/ncwetlands/basic40l.html ). You most
likely will also need to send one copy to the US Army Corps of Engineers
Raleigh Regulatory Field office c/o Mr. Todd Tugwell (info. at
http://www.saw.usace.army.mil/wetlands/regtour.htm ). This is required for
the proposed stream impact. This approval will be included in the Major
Variance approval letter. It will contain all the conditions required for
the Major Variance approval. Call or email if you have any questions.
