Lee County Dear Ms. Innman, i Staff of the NC Division of Water Resources (DWR), Water Quality Regional Operations Section inspected the subject wastewater irrigation system on February 27, 2020 to inspect recent repairs that were done to the existing sand filter that is covered under permit WQ0007026. The following permit condition/limitation violations were observed during the time of the inspection. Please also refer to the attached inspection report. III. OPERATION AND MAINTENANCE REQUIREMENTS Condition I which states "The facilities shall be properly maintained and operated at all times." During the inspection, permit condition violations were noted as follows, A. Wastewater remained ponded on the surface of the sandfilter throughout the 25-minute inspection which is an indication of a failing sand Filter. There does not appear to be a biological mat built up that could impede drainage. It appeared that the surface of sandfilter was recently raked, but water was still ponding. B. The switch on the control panel that should test the function of the alarm activates the sand filter pump instead. -�� North Carolina Uspomixot o! Specifically, the response should minimally include the following information. 1. Please have the enbineer or consultant submit an engineering certification stating that the correct sand was used and that the sandfilter was properly rebuilt according to the originally approved plans. 2. Please provide a time table for how you will determine the cause of the failure and also when and how the drainage problem will be addressed, as well as when the control panel -'alarm will be fixed. This office requires that the violations, as detailed above, be abated and properly resolved. Environmental damage and violations of North Carolina Administrative Codes have been documented for the subject site as stated above. Your efforts to undertake activities to bring the subject site back into compliance is not an admission, rather it is an action that must be taken to begin to resolve ongoing environmental issues. Failure to comply with conditions in a permit may result in a recommendation of enforcement action, to the Director of the Division of Water Quality who may issue a civil penalty assessment of not more that twenty- five thousand ($25,000) dollars against any "person" who violates or fails to act in accordance with the terms, conditions, or requirements of a permit under authority of G.S. 143-215.6A.
