The proposed impacts do not meet the conditions in WQCG No. 4139 for requiring written authorization from NCDWR and therefore, this application is being provided to NCDWR as a courtesy. The project is ±12.94 acres in size and is located between International Drive and Southport Drive, adjacent to aviation Parkway in Morrisville, Wake County (Latitude: 35.832934°N; Longitude: - 78.816616°W). The project is located in the Neuse River basin and onsite waters drain to Crabtree Creek (Crabtree Lake). The Water Quality Classification for Crabtree Creek (Crabtree Lake) is B; NSW and the Stream Index Number is: 27-33-(3.5). The cataloging unit for the site is 03020201. Proposed Project The purpose of the proposed project is to construct a multi -family apartment complex to meet the existing demand for multi -family housing in Morrisville. The overall proposed project consists of ±224 multi -family dwelling units, site amenities, and associated infrastructure including: roads, utilities and stormwater management. Standard commercial construction equipment and techniques will be used to construct the proposed project. The proposed project consists of construction of a sewer main/easement and construction of a retaining wall within the proposed Bainbridge Aviation Crossing Project. The proposed sewer main connection will utilize an existing Town of Cary utility easement. Your Success. Proiect History Onsite "Waters" were delineated by WithersRavenel on June 14, 2018. A Preliminary JD Request and all supporting data is included in support of our delineation, and WR requests issuance of the JD in conjunction with the issuance of the NWP 29. All depicted streams were determined to be perennial streams in the field and therefore buffer subjectivity was conceded. Impacts to riparian buffers will be permitted by the Town of Morrisville as the delegated local municipality. Proposed Impacts The proposed impacts consist of 0.038 acres of permanent wetland impacts from construction of a retaining wall and fill to construct the parking lot and 0.033 acres of temporary wetland impacts from construction of a sewer main and easement. Please note the entire 20' sewer easement will be maintained/mowed in perpetuity, resulting in 0.033 acres of permanent conversion impacts as a result of permanent conversion from forested wetlands to herbaceous wetlands. Avoidance and Minimization Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands and "waters" could be minimized. The proposed project avoids stream impacts entirely by installing the sewer line via jack and bore at the stream crossing. Wetland impacts have been minimized to only those necessary for construction of a retaining wall and fill to construct the parking lot and the gravity sewer main/easement to service the project. The proposed sewer main will avoid stream impacts entirely by utilizing the bore and jack installation method. The proposed site requires retaining walls and fill to construct the parking lot. Due to the natural topography, slope of backfill and location of Wetland C permanent impacts could not be avoided. Impacts to Wetland E could not be avoided in order to tie into an existing sewer service. The location of the proposed sewer main was designed to be contained within an existing Town of Cary sewer easement that extends north from the existing sewer line to the southern boundary of the project. The use of the existing easement was dictated by the adjacent property owner and the inability to negotiate an easement in a different location. Therefore, the proposed sewer main has been designed to cross Wetland E at a perpendicular angle to minimize impacts to the maximum extent possible. Silt fencing will be installed around all disturbed areas to prevent sediment from escaping into adjacent wetlands and waters during construction. Mitigation Wetland Mitigation The proposed project will result in only 0.038 acres of permanent wetland impacts; therefore, the applicant does not propose mitigation. Wetland Conversion Mitigation The proposed project will result in only 0.033 acres of permanent wetland conversion impacts; therefore, the applicant does not propose mitigation Stormwater Management Plan The proposed development will result in approximately 56% impervious coverage. The stormwater management plan consists of 1 underground sand filter (SCM). The SCM has been designed to remove 85% TSS and TN removal rate of 30%, and therefore diffuse flow is not required. The Stormwater Management Plan will be reviewed and approved by the Town of Morrisville, as the delegated municipality. The current request is for 0.038 acres of permanent wetland impacts and 0.033 acres of temporary wetland impacts (see the attached maps and PCN for details). WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as NCNHP GIS data to identify if there were any known occurrences of endangered species on or near the proposed project. The review of the NHP data did not identify any recent occurrences of federally listed threatened or endangered species or critical habitat on the subject property. The NCNHP letter did identify a Bald Eagle occurrence within 1.0 mile of the review area. Based on NCNHP GIS data, the only bald eagle nest within the vicinity of the project area is nest "Wake #1 — Lake Crabtree" (EOID: 20537). Based on NCNHP GIS data "Wake #1 — Lake Crabtree" nest is located 5,200 ft away from the project area at its closest point.
