NORTH CAROLINA BROWNFIELDS PROGRAM
ENVIRONMENTAL MANAGEMENT PLAN
This form is to be used to prepare an Environmental Management Plan (EMP) for projects in
the North Carolina Brownfields Program at the direction of a Brownfields project manager.
The EMP is a typical requirement of a Brownfields Agreement (BFA). Its purpose is to clarify
actions to be taken during the demolition and construction at Brownfields properties in an
effort to avoid delays in the event of the discovery of new contamination sources or other
environmental conditions. The EMP provides a means to document redevelopment plans and
environmental data for each applicable environmental medium to inform regulatory‐compliant
decision‐making at the site. As much detail as possible should be included in the EMP,
including contingency planning for unknowns. Consult your project manager if you have
questions.
Prospective Developers and/or their consultants must complete and submit this form and all
pertinent attachments, see checklist below, to their Brownfields project manager prior to any
earthmoving or other development‐related activities that have the potential to disturb soil at
the Brownfields Property, including demolition. For the resultant EMP to be valid for use, it
must be completed, reviewed by the program, signed by all parties working on the project,
and approved by the Brownfields project manager. Failure to comply with the requirements of
the EMP could jeopardize project eligibility, or in the event of a completed agreement, be
cause for a reopener
So that the EMP provides value in protecting brownfields eligibility and public health, the
preparer shall ensure that the following steps have been completed prior to submitting the
EMP for review. Any EMP prepared without completing these steps is premature.

and applicable to the proposed redevelopment:

Redevelopment plans include the construction of an approximately 710,000 square‐foot
industrial building along the central portion of the Site and west of the railroad right of way, as
well as an approximately 232,000 square‐foot industrial building to the south of the
aforementioned building. A Site location map is provided as Figure 1. Redevelopment plans are
depicted in Appendix A. A paved road and parking lots will separate the two buildings, with an
additional paved parking lot located east and north of the central building. Prior to construction,
vegetation will be cleared and the Site will be graded in accordance with the proposed grading
plans provided in Appendix B. The proposed finished flooring elevation is 634 feet above mean
sea level. Stormwater detention ponds will be constructed to north of the central building and
east of the southern building to manage surface water flow.

PART 1. Soil – Please fill out the information below, using detailed site plans, if available, or estimate
using known areas of contaminated soil and a conceptual redevelopment plan. Provide a figure
overlaying new construction onto figure showing contaminated soil and groundwater locations.
1) Known or suspected contaminants in soil (list general groups of contaminants):
Operations at the Site consisted of 1) vanadium catalyst manufacturing from 1965 to 1972, 2)
solvent recovery, reclamation, and blending from 1974 to 1984, 3) bulk chemical repackaging
from 1974 to 1976, and 4) laboratory services and chromium compound manufacturing from
1977 to 1988, and was vacant thereafter. In the early 1990s, soil contamination was identified at
the Site and subsequently listed as a North Carolina Inactive Hazardous Site (Aquair II
Corporation Site, NCD074511361). In 1999, stabilization measures were conducted at the Site
including the removal of vanadium pellets, debris and a septic tank system. The on‐Site buildings
were demolished in approximately 2000. Soil samples collected from 1990 through 2003 indicate
metals and chlorinated solvent compounds are the primary constituents of interest in soil.
Historical and more recent soil and sediment analytical data is provided in Table 1. A Site Plan
depicting historical features and soil and sediment sample locations are provided as Figure 2 and
3, respectively.
The Site was entered into the North Carolina Department of Environmental Quality (DEQ)
Brownfields Program in July 2015 and a Brownfield Plat was prepared depicting the “Area of

Possible Soil Contamination. In December 2015, Terracon conducted soil sampling in the area
designated on the Brownfields Plat as the “Area of Possible Soil Contamination.” A total of 13
surface soil samples were collected to represent this area. Additionally, four samples were
collected from borings advanced as soil vapor sample points, west of the “Area of Possible Soil
Contamination.” The sample locations and depths were chosen specifically to evaluate potential
impacts associated with redevelopment of the site. Site plans depicting 1) the proposed Site
redevelopment 2) the locations of historical and more recent sample locations depicted by
consultant and date and 3) the locations of historical and more recent soil and sediment sample
locations are provided as Figures 3 through 5, respectively.
Volatile Organic Compounds (VOCs): The results of historical soil samples indicate that several
VOCs (carbon tetrachloride, chloroform, tetrachloroethene, 1,1,2,2‐tetrachloroethane, and
trichloroethene) were detected above DEQ Inactive Hazardous Sites Branch (IHSB) February 2018
Industrial/Commercial Preliminary Soil Remediation Goals (PSRGs) at depths at depths from 1 foot
below ground surface (ft bgs) to 12 ft bgs. The 2015 soil samples had low level detections of VOCs
which were below the February 2018 Industrial/Commercial PSRGs.
Semi‐Volatile Organic Compounds (SVOCs):
The results of a single historical soil sample analyzed for SVOCs (SS‐03) contained concentrations
of SVOCs above the laboratory reporting limit (RL) but below the February 2018
Industrial/Commercial PSRGs. The 2015 soil samples did not contain concentrations of SVOCs
above the RL.
Metals:
Cadmium, total chromium, lead, mercury, and vanadium were detected in several historical
shallow soil samples at concentrations above the February 2018 Industrial/Commercial PSRG and
regional background levels. Additionally, chromium or vanadium (or both) were detected in six
historical sediment samples at concentrations above the February 2018 Industrial/Commercial
PSRG and regional background levels. Only vanadium was detected in two 2015 soil samples
collected from 0 to 0.5 ft bgs at concentrations above the February 2018 Industrial/Commercial
PSRG and regional background levels.
2) Depth of known or suspected contaminants (feet):
In general, historical soil samples were collected from 0‐1 ft bgs. In 2003, five deeper soil boring
were installed and several several compounds (carbon tetrachloride, chloroform,
tetrachloroethene, and trichloroethene) were detected in three soil samples (APH‐42, APH‐58,
and APH‐59) collected from 6.0‐6.5 ft bgs and 11.5‐12.0 ft bgs. Soil samples from the 2015 soil
sampling event were collected from 0‐0.5 ft bgs.
3) Area of soil disturbed by redevelopment (square feet):
Approximately 2,903,303 square feet (sq ft).
4) Depths of soil to be excavated (feet):
The maximum excavation depth will be approximately 6 to 7 ft along the southern portion of the

site along cross‐section A‐A’ (See Appendix B).
5) Estimated volume of soil (cubic yards) to be excavated (attach grading plan):
Approximately 264,795 cubic yards (cu yds) (See Appendix B).
6) Estimated volume of excavated soil (cubic yards) anticipated to be impacted by contaminants:
Based on the cut/fill analysis (Appendix B), soil within the “Area of Possible Soil Contamination”
will not be excavated, but rather is located in an area of the Site primarily designated to receive
fill material.
7) Estimated volume of contaminated soil expected to be disposed of offsite, if applicable:
Disposal of impacted soils at off‐Site locations is not anticipated at this time. The fill analysis in
the grading plan indicates the Site grading will require an equal amount of fill as soil excavated
(264,795 cu yds).

The potential for hazardous waste exists because several total chlorinated
VOCs, total lead, and total mercury concentrations in soil exceeded 20

In the unlikely event that impacted soil is excavated and relocated at the Site, the soils

The grading contractor will take into account conditions such as wind speed, wind direction,
and moisture content of soil during soil grading and stockpiling activities. In the unlikely
event that contaminated soil is encountered during Site redevelopment that requires
excavation, particular attention will be paid by contractors in daily Site‐safety briefings and
throughout the day to implement dust control measures as needed based on Site and
atmospheric conditions (i.e. by controlled water application).

Field Screening of site soil

field screening:
During soil disturbance at the site, the workers or contractors will observe soils for
evidence of the potential significantly impacted soil that may not be suitable to leave in
place in exposed areas at the site. Evidence of potential significant impacted soil includes a
distinct unnatural color, strong odor, or observance of filled or previously disposed
materials of concerns (i.e. chemicals, tanks, drums, etc.). Should the above be noted
during Site work, the contractor will contact the project environmental engineer to
observe the suspect condition. If the project environmental engineer confirms that the
material may be impacted, the soil management procedures described below will be
implemented. In addition, the environmental engineer will contact the DEQ Brownfields
project manager within two business days to advise that person of the condition.

Soil samples have been collected from within the Area of Potential Soil Contamination,
including samples collected specifically to support the Brownfields Agreement. Based on
the grading plan, soil within the Area of Possible Soil Contamination is not planned for
excavation, but rather is located in a fill area, with as much as 6‐7 feet of excavated soil
placed on top of the impacted soils, followed by the installation of impervious surfaces.
Management of Unanticipated Impacted Soil
In the unlikely event significant soil impact is encountered during grading, excavation will
proceed only as far as needed to allow grading. Suspect significantly‐impacted soil
excavated during grading will be stockpiled and covered in a secure area to allow
construction to progress. Suspect impacted soil will be temporarily stockpiled, as depicted
in DEQ Figure 1, located at the back of the Environmental Management Plan (EMP) form.
At least one representative sample of the stockpiled soil will be collected for analysis of
total VOCs (discreet sample), total SVOCs, and total Resource Conservation Recovery Act
(RCRA) 8 metals plus hexavalent chromium and vanadium (composite sample). If the
results of analysis of the sample indicate that the soil could potentially exceed toxicity
characteristic hazardous waste criteria by evaluating the 20 times “rule of thumb,” then
the soil will also be analyzed for TCLP for those compounds that could exceed the toxicity
characteristic hazardous waste criteria. Impacted soil will be handled in the manner
described below based upon the laboratory analyses:
i. If no organic compounds are detected in the soil sample (other than compounds
attributable to sampling or laboratory artifacts), and metals are consistent with
Site‐specific or regional background levels, then the soil will be deemed suitable
for use as on‐Site fill.
ii. If detectable levels of compounds are detected in the soil sample which are below
the Industrial/Commercial PSRGs (other than compounds attributable to sampling
or laboratory artifacts or which are consistent with Site‐specific or regional
background levels for metals) and the TCLP concentrations (if TCLP analysis
needed, based on a 20 times rule of thumb evaluation of the total analytical
results) are below hazardous waste criteria, then the soil may be used on‐site as
fill without conditions.
iii. If detectable levels of compounds are found which are above the Industrial PSRGs
(other than compounds attributable to sampling or laboratory artifacts or which
are consistent with Site‐specific or regional background levels for metals) and the
TCLP concentrations (if needed, based on a 20 times rule of thumb evaluation of
the total analytical results) are below hazardous waste criteria, then the soil, with

DEQ’s written approval, may be used on‐site in the “Area of Possible Soil
Contamination” as fill below an impervious surface, or at least 2 ft of compacted
clean soil. The location of such soil will be provided to DEQ in the final EMP report.

Although not anticipated, in the event contaminated soil and/or vapors are encountered in the utility
trenches during redevelopment activities, the trench will be evacuated and appropriate safety

monitored using a calibrated photoionization detector). If results indicate further action is warranted

The depth to groundwater in the southern portion of the property (MW‐5 and MW‐7) is

Figure 6 for monitoring well locations).

Groundwater sampling has been performed at the site beginning in the early 1990s as part of
previous investigations. The source of the groundwater contamination is historical activities at
the Site. Former remediation efforts included the operation of a pump and treat groundwater
recovery system and a network of air sparge wells. On‐Site groundwater is impacted by VOCs
and metals at concentrations exceeding the April 2013 North Carolina Administrative Code
(NCAC) 02L.0202 Groundwater Quality Standard (2L Standard) and/or the February 2018 DEQ
Division of Waste Management (DWM) Non‐Residential Groundwater Screening Levels (GWSL).
VOCs detected above 2L Standards in on‐Site groundwater include carbon tetrachloride,
chloroform, 1,1‐dichloroethane, 1,2‐dichloroethane, 1,1‐dichloroethene, cis‐1,2‐dichloroethene,
methylene chloride, 1,1,1,2‐tetrachloroethane, tetrachloroethene (PCE), 1,1,1‐trichloroethane,
1,1,2‐trichloroethane, and trichloroethene (TCE). Metals detected above 2L Standards in on‐Site
groundwater include chromium and manganese. VOCs detected above the Non‐Residential
GWSL include carbon tetrachloride, chloroform, 1,1‐dichloroethene, PCE, 1,1,2‐trichloroethane,
and TCE. Groundwater analytical data and sampling locations are provided in Table 2 and Figure
6, respectively.
3) What is the direction of groundwater flow at the Brownfields Property?
Groundwater flow is generally to the east towards an unnamed stream (Figure 3) located east of
the railroad tracks.
4) Will groundwater likely be encountered during planned redevelopment activities?

Based on the cut/fill exhibit (Appendix B), the southern cut area will extend to an approximate
depth of 6 to 7 feet bgs; however, groundwater elevations in this area are approximately 11 to
13 ft bgs. Consequently, groundwater is not anticipated to be encountered during
redevelopment. The cut/fill exhibit also depicts a cut area north of the proposed building in the
area of a planned stormwater retention pond and parking lot area. In these areas, groundwater
may be encountered at depths of 4 to 5 ft bgs; however, based on groundwater analytical data in
the vicinity (AMW‐106 and AMW‐410), groundwater impacts are not expected. Should
groundwater be exposed/encountered during redevelopment of the Brownfields property, the
PD or the PD’s contractor will contact the project environmental engineer and where
appropriate, steps will be taken as noted below. The environmental engineer will update the
DEQ Brownfields project manager within two business days.
Regardless of the answer; in the event that contaminated groundwater is encountered
during redevelopment activities (even if no is checked above), list activities for contingent
management of groundwater (e.g., dewatering of groundwater from excavations or
foundations, containerizing, offsite disposal, discharge to sanitary sewer, NPDES permit, or
sampling procedures).
Although not anticipated at this time, appropriate worker safety measures will be undertaken if
groundwater gathers in an open excavation within an area determined to be impacted during
construction activities. The accumulated water will be allowed to evaporate; tested and
disposed off‐site (if impacted); or tested and discharged to the ground outside of the grading
area if not impacted above DEQ surface water standards (in accordance with applicable
municipal and State regulations for erosion control and construction stormwater control).

redevelopment. These monitoring and remediation wells were abandoned in May and June 2018

associated with a surface water body or stream, but rather a former drain line effluent run‐off
area and associated former intermittent drainage swale. These locations are within a fill area of

In October 2011, Hart & Hickman, PC performed a soil gas investigation at the Site within the Limits
of Groundwater Contamination, as depicted on the Brownfields Plat, and within and around the
footprint of the proposed building. Seven soil gas samples were collected at approximately 6 ft bgs.
Several VOCs (carbon tetrachloride, chlorobenzene, chloroform, 1,2‐dichlorobenzene, 1,2‐
dichloroethane, 1,1‐dichloroethene, ethylbenzene, hexachlorobutadiene, 1,1,2,2‐trichloroethane,
tetrachloroethene, 1,1,1‐trichloroethane, 1,1,2‐trichloroethane, trichloroethene, and m,p‐Xylene)
were detected in at least one sample at concentrations exceeding the DEQ IHSB Non‐Residential Soil
Gas Screening Levels (SGSLs).
In December 2015, Terracon collected four soil gas samples west of the Limits of Groundwater
Contamination at the Site and within the footprint of the proposed building from depths of 3 to 5 ft
bgs. VOCs were not detected above Non‐Residential SGSLs. Soil gas analytical data and sampling
locations are provided in Table 3 and Figure 7, respectively

CONTINGENCY PLAN – encountering unknown tanks, drums, or other waste materials
In this section please provide actions that will be taken to identify or manage unknown
potential new sources of contamination. During redevelopment activities, it is not uncommon
that unknown tanks, drums, fuel lines, landfills, or other waste materials are encountered.
Notification to DEQ Brownfields Project Manager, UST Section, Fire Department, and/or other
officials, as necessary and appropriate, is required when new potential source(s) of
contamination are discovered. These Notification Requirements were outlined on Page 1 of this
EMP.

Please provide details on the proposed methods of managing the following commonly
encountered issues during redevelopment of Brownfields Properties.
If buried piping is encountered and must be removed to allow development to proceed, the
contractor will inspect the pipe for fluids, collect the fluids where appropriate, and inspect the area
for signs of a release using field methods. The collected fluids will be sampled for VOCs, SVOCs, and
RCRA 8 metals to determine appropriate disposition of the fluid.
Underground Storage Tanks:
In the event that impacts associated with an underground storage tank (UST) release are found to
be present on the subject site, they will be addressed through the Brownfields Program.
Sub‐Grade Feature/Pit:
If a sub‐grade feature or pit is encountered and does not require removal for geotechnical or
construction purposes, it will be filled with soil or suitable fill and construction will proceed. Where
appropriate, the bottom may be penetrated before back filling to prevent fluid accumulation. If the
pit contains waste, the waste may be set aside in a secure area and will be sampled for waste
disposal purposes for TCLP VOCs, TCLP SVOCs, TCLP RCRA 8 metals and disposed off‐site at a
permitted facility, or the waste will be managed in accordance with Part 1.A Managing On‐Site Soil
section outlined above in the EMP above, whichever is most applicable based on the type of waste
present. If the pit must be removed and the observed waste characteristics indicate the concrete
may potentially be contaminated to a significant degree, the concrete will be sampled and analyzed
by methods specified by the off‐Site disposal facility.
Buried Waste Material:
If excavation into buried wastes or significantly impacted soils occurs, the contractor is instructed to
stop work in that location and notify the environmental consultant. The environmental consultant
will review the materials and collect samples if warranted. In this event, confirmation sampling will
be conducted at representative locations in the base and the sidewalls of the excavation after
the waste or significantly impacted soil is removed. The confirmation samples will be analyzed for

Brownfields Plat.
Re‐Use of Impacted Soils On‐Site:
The procedures for the re‐use of impacted soils is presented above in Part 1.A.4 Managing On‐Site

If unknown, impacted soil is identified on‐site, management on‐site can be considered after the
project team provides the necessary information, outlined in Part 1.A. Item 11, for Brownfields
Project Manager approval prior to final placement on‐site.
If other potential contingency plans are pertinent, please provide other details or scenarios as
needed below:
In the event that soil within an excavation cannot be dried adequately for construction purposes
using the methods described above, the soil may be amended with clean soil, aggregate, drying
agents, and/or stabilizing agents to achieve the desired geotechnical qualities or placed beneath
impervious surface cover. Amendment may be conducted inside or outside the excavation and the
material replaced into the excavation. If an amendment is used, the type of amendment will be
provided to DEQ for approval prior to its use. DEQ will be notified prior to movement of the soil to
other areas at the Site if results of laboratory analysis for soil samples collected from the excavation
indicate that compound concentrations are detected above Industrial/Commercial Use PSRGs
(other than which are attributable to sampling or laboratory artifacts or which are consistent with
Site‐specific background levels for metals).
POST‐REDEVELOPMENT REPORTING

project. If the project duration is longer than one year, an annual update is required and will be
due by January 31 of each year, or 30 days after each one‐year anniversary of the effective date of

Redevelopment Summary Report will be submitted within 90 days after completion of

report, with a summary and drawings, that describes:
1. actions taken on the Brownfields Property;

environmental media;
4. stockpiling, containerizing, decontaminating, treating, handling, laboratory analysis and
ultimate disposition of any soil, groundwater or other materials suspected or confirmed
to be contaminated with regulated substances; and
5. removal of any contaminated soil, water or other contaminated materials (for example,

concrete, demolition debris) from the Brownfields Property (copies of all legally required
manifests shall be included).
