The proposed project includes development of a commercial warehouse for tenant(s) that do business at the Intermodal facility and Charlotte airport. Site development will include construction of a 421,900 square foot building, two trailer parking areas, two employee parking areas, two truck courts, and two stormwater best management practice ponds. The property is located less than 1.5 driving miles from the Intermodal facility and the Charlotte airport. The developer, SL Horton LLC, purchased the property in June 2018. The requested impacts include 0.017 acre of wetland impacts at four polygonal wetlands (WL 1000 = 0.006 acre, WL 3000 = 0.002 acre, WL 3100 = 0.006 acre, and WL 3200 = 0.003 acre), 115 linear feet of intermittent stream (CH 200), and 1.009 acres of open water (Pond 1). Wetland impacts have been limited to less than 0.10 acre. Three of the wetlands are in a field area and are low quality. The fourth wetland has been created by a leak in the dam. Stream impacts have been limited to less than 150 linear feet. The stream proposed for impact is located immediately below the pond and has been manipulated in the past. The flow in this stream is also coming from a leak in the dam. The outlet pipe of the pond does not contain flowing water. The stream below the pond flows adjacent to an old road bed and was likely straightened when the road was constructed. The site has been used as a farm by the property owners for at least 53 years. The site has most recently been used as a tree farm. The man-made pond was constructed sometime between 1958 and 1965 based on historic aerial photographs. All other waters on the subject property are being avoided. This avoidance includes CH 100 = 1,171 linear feet (both intermittent and perennial), CH 200 = 61 linear feet, and WL 2000 = 0.041 acre. The perennial stream on site has been avoided. A further reduction of 30 linear feet of the requested stream impacts occurred when the grading plan was finalized and stream impacts below the pond were reduced from 145 linear feet to 115 linear feet. The stormwater BMP's are dry ponds due to the proximity to the Charlotte airport. The BMP's include sand filters which are used to remove a wide variety of pollutant concentrations in stormwater by settling, filtering, and adsorption. Runoff discharging from the site outside of the regulated floodplain has been controlled beyond local requirements to include peak attenuation for the 50 -year storm to reduce the potential for downstream erosion. Stream buffers along the perennial stream at the eastern property boundary range from 35 linear feet to 230 linear feet. This buffer area is 5.7 acres. A 100' buffer is provided along the southern, western, and northern property boundaries except for a 762 linear foot section at the southern border and a 282 linear foot section at the entrance off Horton Road that are reduced to 75'. This buffer area along the southern, western, and northern property boundaries includes 6 acres. The buffers are a zoning requirement due to adjacent property zoning. Almost 12 acres of the 42.5 acres (over 25% of the property) has been designated and reserved as buffer. Enclosed are the necessary individual permit application documents and additional information. The project area consists of one parcel that is 42.62 acres. The proposed development includes construction of one commercial warehouse building that will be approximately 421,900 square feet and will be available for single or multi -tenant leasing. The overall project purpose is to provide warehouse space for vendors that do business at the Charlotte Regional Intermodal Facility (CRIF) and Charlotte International Airport (CLT). The intermodal hub, which was completed in 2014 and is managed by Norfolk Southern, links air, rail, and truck to east coast seaports. The facility is expected to generate $7.6 billion in regional economic development in the next 20 years. The facility anticipates creating more than 7,000 jobs in Charlotte and the surrounding region by 2030. The 200 -acre facility, which is capable of 200,000 lifts annually, transfers containers between trucks and trains. Project Marketing and Need The nearest building of similar size, which is also owned by The Silverman Group or one of its other companies, will be almost 411,000 square feet and will be in Concord 22 miles from the intermodal hub. Completion of this building is also scheduled for 2019. The second largest building will be 370,000 square feet and will be in Fort Mill 16 miles from the intermodal hub. Completion of this building is scheduled for 2019 as well. The third largest building in the area is 360,000 square feet, is in Concord, and is 23 miles away from the intermodal hub. This building, which was constructed in 2014, is the largest building that is constructed in the surrounding area to compare to the Charlotte Intermodal Logistics Center. Earlier this month an article in the Charlotte Business Journal announced that Amazon.com Inc. and its suppliers continue to grab building space in the Charlotte region. NFI, a Cherry Hill, New Jersey -based privately -owned supply chain company, which is one of the primary logistics firms for Amazon.com, has leased a 507,500 square foot building in the Riverwalk Business Park in Rock Hill. McCraney Property Co., which says it is based in West Palm Beach, Florida and Charlotte, completed the $25 million building, called Logistics 77@Riverwalk, during the last quarter (second quarter of 2018). NFI has leased the entire building less than three months after completion. Amazon.com plans to construct a 2,000,000 square foot distribution center building within approximately 4 miles of the project. The Center is also located in an area with future plans for office space, shops, restaurants, hotels, apartments, townhomes, single family homes, retirement homes, industrial, and commercial development. The Charlotte Douglas International Airport is located less than 2.5 miles northeast of the Center. Uptown Charlotte is located less than eight miles to the east. The Silverman Group The Silverman Group (TSG) and subsidiaries is a family owned and operated private equity and real estate development organization. Based in Basking Ridge, New Jersey, TSG look for new and exciting opportunities in the commercial, residential, and industrial real estate sectors. TSG has 2.5 million square feet of industrial space currently under development in 7 states. TSG has 2,000 multi -family units under development in 3 states. The Silverman Group has a portfolio that stretches across 14 states with 3,000 multi -family units and 12 million square feet of office, industrial, retail, and aviation properties. In the greater Charlotte region growth of ecommerce is very active requiring warehouse space for logistical and high-volume storage of goods for transport. The Silverman Group has an extremely low vacancy of industrial buildings. 90% of the buildings constructed by TSG are leased prior to completion of construction. The Silverman Group finances all their projects in house so they can offer lower lease rates than their competitors. TSG has obtained many tenants while in competition with other warehouse space providers by being able to offer lower lease rates. Project History Historical aerial imagery indicates that the project area was forested in 1951 with no visible residences or structures. Between 1958 and 1965 the project area was mostly cleared, the pond had been constructed, a residence had been built, and multiple barns and outbuildings were constructed. Interviews with the previous property owner, William H. Kelly III, who sold the property to SL Horton Road LLC in June 2018 confirm that the property was initially used for hog farming after land clearing. Once William H Kelly II I acquired the property from his father, in 1984, a portion of the land was used as an ornamental tree farm. The man-made pond was used for irrigation of the tree farm and any water that did not infiltrate flowed back into the pond and was re -circulated for irrigation. In 2016 the property was no longer used as an ornamental tree farm and was cut and replanted with loblolly pines under a forestry management plan. Maintenance of the planted area was completed by the U.S. Forest service which consisted of spraying herbicides and pesticides as recently as the spring of 2018. The man-made pond was constructed between 1958 and 1965 determined by historical aerial imagery. All wetlands within the project site were ranked as high, medium, or low quality using the North Carolina Wetland Assessment Method (NC WAM). Wetland 1000 ranked as medium, wetland 2000 ranked as high, and wetlands 3000, 3100, and 3200 ranked as low quality. The requested impacts include 0.017 acre of wetland impacts at four polygonal wetlands (WL 1000 = 0.006 acre, WL 3000 = 0.002 acre, WL 3100 = 0.006 acre, and WL 3200 = 0.003 acre), 115 linear feet of intermittent stream (CH 200), and 1.009 acres of open water (Pond 1). The site has been used as a farm by the property owners for at least The intermittent stream (CH 200) begins near the outlet of the pond and flows to the perennial stream (CH 100). The perennial stream generally follows along the eastern property boundary. Priority was placed on avoiding the higher quality aquatic resources. Impacts will occur to the man-made pond, the three low quality wetlands, the one medium quality wetland, and a reach of the intermittent stream. The high quality wetland (WL 2000) and perennial stream (CH 100) have been entirely avoided. A table of the aquatic resources is included in the application package. This avoidance includes CH 100 = 1,171 linear feet (both intermittent and perennial), CH 200 = 61 linear feet, and WL 2000 = 0.041 acre. The perennial stream on site has been avoided. The wetland that has been avoided is a higher quality floodplain wetland. No development will occur within the delineated floodplain areas. 88.5% of the streams on site have been avoided and 70.7% of the wetlands on site have been avoided. The delineation was completed by Atlas and approved by the Corps and NC DWR prior to the project engineers finalizing the grading plan which allowed impacts to be minimized. The amount of trailer parking spaces has been reduced due to the site constraints. Based upon other buildings that The Silverman Group owns in the area tenants want as many trailer spaces as possible especially with the apparent future use of autonomous tractors. Mitigation Wetland impacts have been limited to less than 0.10 acre (0.017 acre). Three of the wetlands are low quality. The fourth wetland is medium quality but was created by seepage from the dam. Stream impacts have been limited to less than 150 linear feet (115 linear feet intermittent stream). This stream has been manipulated in the past. The site has been used as a farm for at least 53 years, most recently as a tree farm. No mitigation is offered for the stream and/or wetland impacts. The man-made pond was constructed sometime between 1958 and 1965 based on historic aerial photographs. Impacts to the pond exceed '/2 acre, however, the open water aquatic resource was created by a man-made dam 53-60 years ago. The Corps has not required mitigation for open water impacts in the past especially given the fact that this pond was constructed so long ago. However, the applicant is proposing on site alternatives to compensate for the open water impact. These include stormwater and stream buffers. The larger stormwater BMP has been designed to treat a larger storm event than what is required to help attenuate additional storm flows to protect the downstream receiving water quality. Stream buffers are provided along CH 100 that are wider than those required by Mecklenburg County to also help protect downstream water quality. Increasing the peak attenuation of the large stormwater basin from a 25 -year storm to a 50 -year storm will reduce the volume and frequency of discharges from the site. This reduction of flow will decrease potential sediment from bank erosion at the downstream receiving waters and reduce flashy storm flows. Stream Buffers and Project Buffers Stream buffers along the intermittent/perennial stream at the eastern property boundary range from 35 linear feet to 230 linear feet. This buffer area is 5.7 acres. These buffer widths exceed the 30 linear foot and 35 linear foot post construction stream buffers required by Mecklenburg County. A 100' buffer is provided along the southern, western, and northern property boundaries except for a 762 linear foot section at the southern border and a 282 linear foot section at the entrance off Horton Road that are reduced to 75'. Pond Details for Draining Drainage of the onsite pond will occur drawing down the water level with a commercial grade pump attached to a simmer. The skimmer will allow for water to be pumped from the surface of the pond without disturbing sediment on the bottom. For increased protection of downstream receiving water, the pump outlet will be covered with a silt bag. The existing road bed near the dam will be used as a diffuse flow path for the pumped water to disperse, lose energy, and give time to infiltrate before reaching the stream. The receiving water will be monitored hourly during pumping to ensure no adverse effects to receiving waters. Fish have been stocked in the pond by the previous land owner. Fish and/or any wildlife in the pond will be captured to prevent any potential non-native or invasive species from entering downstream waters. T&E Species A representative from US Fish and Wildlife Service and North Carolina Wildlife Resources Commission have conducted a site visit. A T&E report and request for comment was sent to Mr. Byron Hamstead in April 2018. Byron has indicated that he would comment on the project once the public notice was issued. Nature of Activity (Description of project, include all features) The site development plan will require aquatic resource impacts to Waters of the United States in the form of filling a man-made pond that was created between 1958 and 1965, filling four small lower quality wetlands, and piping an intermittent stream. An Individual Permit is required because the open water impacts exceed 1/2 acre. Historically the pond was used as a source of irrigation water. Most of the property has been intensively managed and historically graded in areas for use as an ornamental tree farm and a single family residence. Water was withdrawn from the pond and used to water the ornamental trees. Prior to being used as a tree farm the property was a hog farm. The eastern boarder of the property is forested along an intermittent and perennial stream corridor where there are no planned impacts or disturbances. The pond will be drained and the ground surface re -graded for a suitable building pad. Atlas delineated two streams, five wetlands, and one man-made pond located within the project boundary. Two BMP's will be constructed on site to treat and attenuate stormwater. The larger BMP will exceed design requirements and treat a 50 year storm event. 19. Project Purpose (Describe the reason or purpose of the project, see Instructions) The proposed project includes development of a commercial warehouse for tenant(s) that do business at the intermodal facility and Charlotte airport. Site development will include construction of a 421,900 square foot building, two trailer parking areas, two employee parking areas, two truck courts, and two stormwater best management practice ponds. There is a need for additional warehouse space for ecommerce businesses. The area in which the building is planned to be constructed is where the historic tree farm and residence was located. Minimal tree clearing will be required due to the historic use of the property. Much of the land in the area of the proposed building is early successional vegetation resulting from the previous land use as the tree and hog farm. Grading will be required to prepare a suitable building pad. USE BLOCKS 20-23 IF DREDGED AND/OR FILL MATERIAL IS TO BE DISCHARGED 20. The avoidance includes CH 100 = 1,171 linear feet (both intermittent and perennial), CH 200 = 61 linear feet, and WL 2000 = 0.041 acre. The wetland that has been avoided is a higher quality floodplain wetland. A further reduction of 30 linear feet of the requested stream impacts occurred when the grading plan was finalized which reduced the stream impact from 145 linear feel to 115 linear feet. As part of the alternatives analysis delineative criteria were established based on the project purpose outlined in the public notice. Project Purpose: The overall project purpose is to provide warehouse space for vendors that do business at the Charlotte Regional Intermodal Facility (CRIF) and Charlotte International Airport (CLT). The established criteria for the selection of potential alternate sites is that the property must be between 42 and 60 acres in size, must be less than 5 miles from the Charlotte Regional Intermodal Facility (CIRF), and it must be for sale. Initial research began with a Geographical Information System (GIS) query of all parcels between 42 and 60 acres that were within a 5 mile buffer of the CRIF and located on the East side of Lake Wiley. The search returned 56 results. Of the initial 56 parcels 30 are held by Duke Energy, City of Charlotte, Mecklenburg County, or Charlotte Mecklenburg Board of Education or contain recent development. Seventeen additional parcels were eliminated due to the shape of the parcel not being fit for commercial development and/or being surrounded by residential development. From the remaining parcels nine sites were selected including the purchased property at 10137 Horton Road. Of the 56 parcels only three were for sale which included sites # 1, 2, and 6 below. The purchase price was $49,296 per acre at a total price of $2,100,000. Compared to all 8 of the other potential parcels that meet the preliminary screening criteria the chosen location is closest to the CIRF, has fewer potential impacts to Waters of the U.S. when compared to Site #2 or Site #6, and will require less forest clearing due to the previous ornamental tree farm. Site 1 also has plans of sewer installation for Horton Road that connects to an existing sewer line behind Berewick Elementary School. The proposed sewer line will have multiple connections in addition to the project site at Horton Road. The purchased property at 10137 Horton Road will serve the needs and purpose of the project with the fewest impacts of any purchasable alternative site. Figure 2: Horton Road, Purchased Property N O O n Page 51 of 79 Site # 2: This property has no assigned address but is located at approximately 10015 Walkers Ferry Road, Charlotte, NC. Atlas Environmental staff contacted the listing realtor and there is currently no sewer or water service to the parcel and the property. The asking price of the parcel is $2,553,000 which is approximately $453,000 more than the purchased property at 10137 Horton Road. Additionally, a detailed GIS analysis of the terrain, using LiDAR to create a digital elevation model, indicates a strong likelihood of perennial and or intermittent streams on site. Mecklenburg County Polaris GIS does show post construction and SWIM buffers that extend into the site. Impacts at this location would exceed those at Horton Road and would likely impact higher quality resources. Current zoning at Site 2 is R3 and is generally surrounded by RMH zoning and residential housing. Due to the strong potential of surface waters and residential location of Site 2 it is not considered a practicable alternative site. According to the realtor the parcel is currently for sale at approximately $75,000 per acre and the total asking price is currently $4,443,750. GIS analysis indicates a strong likelihood of perennial and or intermittent streams on site. Mecklenburg County Polaris GIS does show post construction and SWIM buffers that extend into the site. A utility easement does exit bisecting the southern extent of the parcel close to the entrance from Dixie River Road. There is currently no water or sewer and is located near the upcoming "River District". The parcel is owned by nine entities posing encumbrances during conceptual negotiation. It is not likely that the planning board will considered an industrial zoning. Lastly, the potential re -alignment of Dixie River Road could impact the parcel. Due to the highly elevated price, potential zoning restrictions, and potential aquatic resource on site this location is not considered a practicable alternative site.
