The project area is located within the West Brier Townes residential subdivision, southeast of the intersection of TW Alexander Drive and Roche Drive in Durham (35.915226°N; -78.823529°W). The project is located in the Neuse River basin and onsite waters drain to Stirrup Iron Creek. The Water Quality Classification for Stirrup Iron Creek is C; NSW and the Stream Index Number is: 27- 33-4-2. The cataloging unit for the site is 03020201. Proposed Project The proposed project consists of the construction of a high flow bypass for SCM #2 within the West Brier Townes residential subdivision. The proposed outfall consists of a storm drainage pipe which will outfall into a rip -rap lined channel. The proposed stormwater outfall will convey treated stormwater from a wet detention pond (SCM #2), which will provide 90% nitrogen removal and therefore diffuse flow is not required. Project History North Carolina Division of Water Resources (NCDWR) issued a Buffer Determination (NBRRO02- 132 & 00-015) for the project area on 06/26/2002. Your Success. The US Army Corps of Engineers (USACE) issued an Approved Jurisdictional Determination (AID: SAW -2007-01242) for the project area on 01/29/2009. A copy of the Jurisdictional Determination has been provided as an Appendix. The West Brier Townes residential subdivision is part of the larger Alexander Park project. The Alexander Park project received previous 404, 401 and Buffer Authorizations for construction of two road crossings (Roche Drive and Bateau Way) and installation of utility lines which required 0.05 acres of permanent wetland impacts, 113 If of permanent stream impacts, and 12,808 sf of permanent riparian buffer impacts. All infrastructure needed for the West BrierTownes residential subdivision were permitted as part of Alexander Park. The permits for Alexander Park consist of: • NCDWR issued a 401 Water Quality Certification (DWR# 14-0048) for the Alexander Park project on 02/11/2014. A copy of the 401 Water Quality Certification has been provided as an appendix. USACE authorized use of NWP 12 and NWP 14 for the Alexander Industrial park project (AID#: SAW -2014-00239) on 02/07/2014. A copy of the 404 has been provided as an appendix. Proposed Impacts The proposed impacts for this application consist of 630 sq ft of permanent impacts to riparian buffers (zonel: 132 sq ft; zone2: 498 sq ft for the construction of a high flow bypass channel for a wet detention pond (SCM #2). Avoidance and Minimization The proposed high flow bypass channel has been designed to cross riparian buffers at a perpendicular angle to minimize impacts to buffers. The proposed project will be constructed in accordance with requirements of the erosion and sediment control plan/permit. During construction, all equipment will access construction areas from high ground. Mitigation The proposed buffer impacts are considered "Allowable" based on the Neuse River Basin table of uses; therefore, mitigation is not required.
