On behalf of WBTH LLC., we are requesting Buffer Compliance from the NC-DWR for 630 sq ft of
permanent Neuse River buffer impacts for construction of a rip rap bypass stormwater outfall
within the West Brier Townes SCM #2 Outfall project.
The project area is located within the West Brier Townes residential subdivision, southeast of the
intersection of TW Alexander Drive and Roche Drive in Durham (35.915226°N; -78.823529°W).
The project is located in the Neuse River basin and onsite waters drain to Stirrup Iron Creek. The
Water Quality Classification for Stirrup Iron Creek is C; NSW and the Stream Index Number is: 27-
33-4-2. The cataloging unit for the site is 03020201.
Proposed Project
The proposed project consists of the construction of a high flow bypass for SCM #2 within the West
Brier Townes residential subdivision. The proposed outfall consists of a storm drainage pipe which
will outfall into a rip -rap lined channel. The proposed stormwater outfall will convey treated
stormwater from a wet detention pond (SCM #2), which will provide 90% nitrogen removal and
therefore diffuse flow is not required.
Project History
North Carolina Division of Water Resources (NCDWR) issued a Buffer Determination (NBRRO02-
132 & 00-015) for the project area on 06/26/2002. A copy of the Buffer Determination has been
provided as an Appendix.

The US Army Corps of Engineers (USACE) issued an Approved Jurisdictional Determination (AID:
SAW -2007-01242) for the project area on 01/29/2009. A copy of the Jurisdictional Determination
has been provided as an Appendix.
The West Brier Townes residential subdivision is part of the larger Alexander Park project. The
Alexander Park project received previous 404, 401 and Buffer Authorizations for construction of
two road crossings (Roche Drive and Bateau Way) and installation of utility lines which required
0.05 acres of permanent wetland impacts, 113 If of permanent stream impacts, and 12,808 sf of
permanent riparian buffer impacts. All infrastructure needed for the West BrierTownes residential
subdivision were permitted as part of Alexander Park. The permits for Alexander Park consist of:
• NCDWR issued a 401 Water Quality Certification (DWR# 14-0048) for the Alexander Park
project on 02/11/2014. A copy of the 401 Water Quality Certification has been provided as
an appendix.
USACE authorized use of NWP 12 and NWP 14 for the Alexander Industrial park project
(AID#: SAW -2014-00239) on 02/07/2014. A copy of the 404 has been provided as an
appendix.
Proposed Impacts
The proposed impacts for this application consist of 630 sq ft of permanent impacts to riparian
buffers (zonel: 132 sq ft; zone2: 498 sq ft for the construction of a high flow bypass channel for a
wet detention pond (SCM #2).
Avoidance and Minimization
The proposed high flow bypass channel has been designed to cross riparian buffers at a
perpendicular angle to minimize impacts to buffers.
The proposed project will be constructed in accordance with requirements of the erosion and
sediment control plan/permit. During construction, all equipment will access construction areas
from high ground.
Mitigation
The proposed buffer impacts are considered "Allowable" based on the Neuse River Basin table of
uses; therefore, mitigation is not required.
The current request is for 630 sq ft of permanent impacts to Neuse River basin riparian buffers
(see the attached maps and PCN for details).

Originally this site was evaluated as NBR 00 -tat S and all four features were determined to be subject
to the Nouse River Basin: Nutrient Sensitive Waters Management Strategy; Protection and Maintenance
of Existing Riparian Areas, Administrative Code Ti 5A.02B.0233 (NCAC 0233). This site was revisited
on May 21, 2002 to aflow a determination to be made as to whether or one of the unnamed tributaries
would require complienca with the Neuse Buffer Ruls, This specHic project is referenced by the Raleigh
Regional Office as NBRRQ 02.132.
The main creek and unnamed tributaries 2 and 3 remain subject to the fifty (501 foot protection but
feature 4 was reevaluated and classified as not present on the ground as a stream. This letter
addresses only the applicability of the Neuse Buffer Rules. For information relative to the buffer and

2. Stormwater Management Plan and Diffuse Flow
The applicant has requested the Division's review of the impacts of this development prior to submitting a
plan for stormwater management and diffuse flow. As a result, when this additional information is
available for a complete review of this project, it must be resubmitted with the appropriate fee to the
DWR Webscape Unit (1650 Mail Service Center, Raleigh, NC 27699-1650). Since the approval of these
impacts is conditional, no impacts can occur until the City/County of Durham approves the Stormwater
Management Plan and the Division reviews and approves the diffuse flow plan.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Pre -Construction Notification. All construction activities, including
the design, installation, operation, and maintenance of sediment and erosion control Best Management
Practices, shall be performed so that no violations of state water quality standards, statutes, or rules
occur.
4. Protective Fencing
The outside buffer, wetland or water boundary and along the construction corridor within these
boundaries approved under this authorization shall be clearly marked with orange warning fencing (or
similar high visibility material) for the areas that have been approved to infringe within the buffer, wetland
or water prior to any land disturbing activities to ensure compliance with 15 NCAC 02H .0500.
S. This approval is for the purpose and design described in your application. The plans and specifications for
this project are incorporated by reference as part of the Certification and Buffer Authorization. If you
change your project, you must notify the Division and you may be required to submit a new application
package with the appropriate fee. If the property is sold, the new owner must be given a copy of this
approval letter and General Certification and is responsible for complying with all conditions.
6. This approval and its conditions are final and binding unless contested.
