The trails have been designed to minimize the removal of wooded vegetation and is proposing bridges to
avoid impacts to streams and wetlands. Bridge crossings are perpendicular and parallel trails have been
designed in Zone 2 only. Existing structures and topography were considered in trail location. Impact sheet
EX -3 shows avoidance of wetland area.

techniques. This project will utilize both tree protection fencing as well as silt fencing with silt fence outlets to
minimize erosion impacts. Existing trees, grading, drainage, and stream structure were all considered while
locating the trails to reduce the impact to the surrounding area.

Per your request, on May 5, 2000, I met with you at the subject property located northeast of the
intersection of SRI 917 and SRI 921, on either side of SR 1920 (Frank Bailey Road) and north of Highway
98, Wake County. The purpose of this meeting was to determine the applicability of stream features
located on the property to the Neuse River Riparian Buffer Protection Regulations (15A NCAC 2B .0233).
As a result of this meeting, it was determined that the features indicated on the attached "Detailed Soils /
Site Suitability Evaluation and Preliminary Wetlands Evaluation" map received by this office on 5/30/00
and initialed by me on 6/13/00 are subject to 15A NCAC 2B .0233. The map indicates streams, including
the approximate location of the start of several intermittent streams (locations "A to S"), subject to the
.buffer regulations as confirmed and flagged in the field on 5/5/00. This office recommends that these
streams be properly located and identified prior to any site design to ensure compliance with 15A NCAC
2B.6233.
This letter only addresses the applicability of 15A NCAC 2B.0233(3) and does not authorize any activity

APPROVAL of 401 Water Quality Certification and Additional Conditions
Dear Mr. Dickerson:
You have our approval, in accordance with the attached conditions, to place fill in 0.07787 acre of wetlands and 357 linear
feet of streams to construct the Hasentree Subdivision in Wake County, as you described in your application received by the
Division of Water Quality on August 11, 2000. After reviewing your application, we have determined that this fill is covered
by General Water Quality Certification Numbers 3287 and 3289. This Certification allows you to use Nationwide Permit
Numbers 39 and 14 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or
local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non -Discharge
and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless
otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new
owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions.
If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as
described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached
certification and the additional condition listed below.
1. Deed restrictions or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas within 50 feet
of all streams and ponds in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in
place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification ca
be found on our web site at htip7/lh2o.enr.state.nc.us/ncwetiands .
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition conforming to Chapter 150B
of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447.
This certification and its conditions are final and binding unless you ask for a hearing.

APPROVAL of 401 Water Quality Certification and AUTHORIZATION CERTIFICATE per the Neuse River Buffer
Protection Rules (15A NCAC 2B .0233) with ADDITIONAL CONDITIONS
You have our approval, in accordance with 15A NCAC 02B .0233 and any conditions listed below, to impact
approximately 3,993 fe of Zone 1 and 2,749 ft2 of Zone 2 of the protected riparian buffers for the purpose of constructing
the proposed road crossing # 10 at the subject property as described within your application dated March 11, 2004. In
addition, you should obtain or otherwise comply with any other required federal, state or local permits before you go
ahead with your project including (but not limited to) Erosion and Sediment Control, Non -discharge and water supply
7ulations.
Th. iproval is only valid for the purpose and design that you described in your application. If you change your project,
you must notify us and you may be required to send us a new application. If the property is sold, the new owner must
be given a copy of this authorization and approval letter and is thereby responsible for complying with all conditions. For
this approval to be valid, you must follow the conditions listed below.
Conditions:
1. New Plan — The proposed development shall be constructed as per the new plan submitted with your March 11,
2004 application. Notably, impacts to the protected riparian buffers shall not exceed 7,812 fe for road Crossing # 3,
6,742 ft2 for road Crossing # 10, and 6,486 ft2 for road Crossing # 7 (unless otherwise approved by the DWQ).
Also, open bottom culverts (that do not place fill within the stream channel) must be used for Crossing # 7 and
Crossing # 10.
2. Open Bottom & Bottomless Arch Culverts - You've stated within your application that open bottom culverts will be
used to cross the stream and that no impacts will occur to either wetlands or streams (at Crossing # 7 and Crossing
# 10). The proposed project must comply with all applicable water quality standards as listed in 15A NCAC 02B
.0200. The placement of the culverts shall not be conducted in a manner that may result in aggradation,
degradation or significant changes in hydrology of the stream bed and bank, adjacent to or upstream and
downstream of the structure. The openings must be provided to maintain the natural hydrology of the system as
well as prevent constriction of the floodway that may result in aggradation, degradation or significant changes in
hydrology of streams.
3. Previously Approved Water Quality Certification & Authorization Certificate— For this authorization to be valid, you
shall follow all of the conditions and mitigation requirements listed within your water quality certification and
authorization certificate approved by the DWQ on June 19, 2002.
4. Construction Plans - Any final construction plans for this project must include or reference the application and plans
approved by the DWQ under this authorization letter and certification.

Erosion & Sediment Control Practices - Erosion and sediment control practices must be in full compliance with all
specifications governing the proper design, installation and operation and maintenance of such Best Management
Practices in order to protect surface waters standards:
a. The erosion and sediment control measures for the project must be designed, installed, operated, and
maintained In accordance with the most recent version of the North Carolina Sediment and Erosion Control
Planning and Design Manual.
b. The design, installation, operation, and maintenance of the sediment and erosion control measures must
be such that they equal, or exceed, the requirements specified in the most recent version of the North
Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all construction sites,
borrow sites, and waste pile (spoil) projects, including contractor -owned or leased borrow pits associated
with the project.
6. No Impacts Beyond the Footprint of the Impacts Depicted in the Approved PCN - No waste, spoil, solids, or fill of any
kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the
Preconstruction Notice Application. All construction activities, including the design, installation, operation, and
maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of
state water quality standards, statutes, or rules occur.
7. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures shall
not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion
control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within
six months of the date that the Division of Land Resources has released the project.
8. Diffuse Flow -An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities
through the protected stream buffers and will not re -concentrate before discharging into the stream as identified
within 15A NCAC 2B.0233(5).
9. Certificate of Completion - Upon completion of all work approved within this authorization, and any -subsequent
modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit,
North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts)
shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in
Articles 3 and 4 of G.S. 1506. This Authorization Certificate shall expire five (5) years from the date of this letter.
This letter completes the review of the "No Practical Alternatives" determination under 15A NCAC 2B .0233. If you have
any questions or would like a copy of the buffer rules, please call [phone]. This letter does not authorize any
impacts to either Waters of the United States or Waters of the State. Please contact the US Army Corps of Engineers
(USAGE) or NC Division of Water Quality (DWQ) if any impacts are proposed to either of these waters.
