The trails have been designed to minimize the removal of wooded vegetation and is proposing bridges to avoid impacts to streams and wetlands. Bridge crossings are perpendicular and parallel trails have been designed in Zone 2 only. Existing structures and topography were considered in trail location. Impact sheet EX -3 shows avoidance of wetland area. 1 b. Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques. This project will utilize both tree protection fencing as well as silt fencing with silt fence outlets to minimize erosion impacts. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Numbers 3287 and 3289. This Certification allows you to use Nationwide Permit Numbers 39 and 14 when issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non -Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. Open Bottom & Bottomless Arch Culverts - You've stated within your application that open bottom culverts will be used to cross the stream and that no impacts will occur to either wetlands or streams (at Crossing # 7 and Crossing # 10). The proposed project must comply with all applicable water quality standards as listed in 15A NCAC 02B .0200. The placement of the culverts shall not be conducted in a manner that may result in aggradation, degradation or significant changes in hydrology of the stream bed and bank, adjacent to or upstream and downstream of the structure. The openings must be provided to maintain the natural hydrology of the system as well as prevent constriction of the floodway that may result in aggradation, degradation or significant changes in hydrology of streams. 3. Previously Approved Water Quality Certification & Authorization Certificate— For this authorization to be valid, you shall follow all of the conditions and mitigation requirements listed within your water quality certification and authorization certificate approved by the DWQ on June 19, 2002. 4. Construction Plans - Any final construction plans for this project must include or reference the application and plans approved by the DWQ under this authorization letter and certification. The devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased borrow pits associated with the project. 6. No Impacts Beyond the Footprint of the Impacts Depicted in the Approved PCN - No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the footprint of the impacts depicted in the Preconstruction Notice Application. All construction activities, including the design, installation, operation, and maintenance of sediment and erosion control Best Management Practices, shall be performed so that no violations of state water quality standards, statutes, or rules occur. 7. No Sediment & Erosion Control Measures w/n Wetlands or Waters - Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable, they shall be removed and the natural grade restored within six months of the date that the Division of Land Resources has released the project. 8. Diffuse Flow -An additional condition is that all stormwater shall be directed as diffuse flow at non-erosive velocities through the protected stream buffers and will not re -concentrate before discharging into the stream as identified within 15A NCAC 2B.0233(5). 9. Certificate of Completion - Upon completion of all work approved within this authorization, and any -subsequent modifications, the applicant is required to return the attached certificate of completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service Center, Raleigh, NC, 27699-1650. Any disputes over determinations regarding this Authorization Certificate (associated with the approved buffer impacts) shall be referred in writing to the Director for a decision. The Director's decision is subject to review as provided in Articles 3 and 4 of G.S. 1506. This Authorization Certificate shall expire five (5) years from the date of this letter.
