Murray Senior Trust (Applicant), Timmons Group is submitting this Pre -Construction Notification (PCN) for authorization of the Hodge Road Apartments (Site/Project) under the requirements of Nationwide Permit (NWP) 29, associated General Water Quality Certification #4092 and Buffer Authorization. This PCN is being submitted for unavoidable permanent and temporary impacts to one stream associated with a permanent access road for the proposed development. The completed Pre -Construction Notification Form is provided in Enclosure 1. Additional Project specific information is provided in this letter to augment the required information of the PCN Form. The Site consists of a 19 -acre parcel of land situated south of Highway 264 in Knightdale, Wake County, NC (see Enclosure 2: Vicinity Map). The site is currently forested and undisturbed. The Site is drained by an unnamed tributary to the Neuse River, Hydrologic Unit Code (HUC) 03020201 (see Enclosure 3: HUC Map). A Preliminary Jurisdictional Determination Request is included as part of the application. Based on information from the property owner, Soil and Environmental Consultants (S&EC) delineated the site previously for the Town of Knightdale, but it was not confirmed. Timmons Group performed a site visit on 5/31/2017 and confirmed the previous delineation. Supporting documentation is provided in Enclosure 4: Preliminary Jurisdictional Waters of the U.S. Delineation Map. A desktop review of the onsite Federal Emergency Management Agency (FEMA) 100 -year floodplain was completed and the site was found to be located outside of the 100 -year floodplain. A FEMA Map is enclosed for your review (see Enclosure 5: FEMA Flood Zone Map). To accomplish the goals of the project, impacts to jurisdictional areas are unavoidable due to the position of the Site in relation to the existing road infrastructure and the need to traverse existing jurisdictional features between the proposed development and said existing CIVIL ENGINEERING I ENVIRONMENTAL I SURVEYING I GIS I LANDSCAPE ARCHITECTURE I CONSTRUCTION SERVICES infrastructure. Typical road profile as well as the Conceptual Design Plan have been included in Enclosure 6: Design Details. Road placement was analyzed to determine potential impacts to Waters of the US. Estimated impacts totaled 110 linear feet of permanent stream impacts and 38 linear feet of temporary stream impacts. Riparian buffer impacts include 8,389 square feet of impacts to the Zone 1 and 4,921 of impacts to Zone 2 (Enclosure 8: Jurisdictional Waters of the U.S. Impacts Map). No permanent or temporary impacts to wetlands will occur from the project. In order to prevent the potential for secondary impacts, all erosion and sedimentation control practices, including the application of silt fences and erosion control matting, will be constructed and maintained according to the standards and specifications of the current North Carolina Erosion and Sediment Control Planning and Design Manual. The preliminary conceptual design includes two proposed wet ponds as shown on the overall site plan included as Enclosure 6. An Endangered Species Project Review was conducted to gain insight regarding the potential presence of Endangered Species Act (ESA) listed species within or in the vicinity of the Project. The following agencies and associated databases were reviewed: North Carolina Department of Natural anc Natural Heritage Program ( NC NHP) U.S. Fish and Wildlife Service Threatened County Cultural Resources (NCDNCR) — and Endangered Species for Wake Information provided by the NC NHP indicated no presence of species at or adjacent to the project area. Therefore, the proposed Project will have "No Affect" to ESA listed species. The Site is not within 330 feet of a bald eagle nest nor does it intersect with eagle concentration areas. Additionally, there is no Critical Habitat identified within the Site. The results of these database queries are included (see Enclosure 9: Threatened and Endangered Species Survey). Historical and cultural resource information for the proposed Site was obtained from the North Carolina State Historic Preservation Office (SHPO) (see Enclosure 10: NCSHPO Survev). A 0.25 -mile radius search was performed from the center of the Site to determine the effect, if any, that the Project may have on cultural resources. Initial evaluation from SHPO indicated no potential for disturbing resources within the proposed Site area. Based on the above information and attached supporting documentation, the Applicant requests approval of the proposed activity under the requirements of NWP 29, General Water Quality Certification #4092 and Buffer Authorization. The site is primarily forested. One cleared and maintained utility easement is present along the northern boundary. This site is bound to the north by Highway 264 and bound to the south by a residential subdivision. All other areas surrounding the site are forested and undisturbed. 3b. See below. FSC=Federal Species of Concern. FSC is an informal term. It is not defined in the federal Endangered Species Act. In North Carolina, the Asheville and Raleigh Field Offices of the US Fish and Wildlife Service (Service) define Federal Species of Concern as those species that appear to be in decline or otherwise in need of conservation and are under consideration for listing or for which there is insufficient information to support listing at this time.Subsumed under the term "FSC" are all species petitioned by outside parties and other selected focal species identified in Service strategic plans, State Wildlife Action Plans, or Natural Heritage Program Lists. T(S/A) = threatened due to similarity of appearance. A taxon that is threatened due to similarity of appearance with another listed species and is listed for its protection. Taxa listed as T(S/A) are not biologically endangered or threatened and are not subject to Section 7 consultation. See below. EXP = experimental population. A taxon listed as experimental (either essential or nonessential). Experimental, nonessential populations of endangered species (e.g., red wolf) are treated as threatened species on public land, for consultation purposes, and as species proposed for listing on private land. P = proposed. Taxa proposed for official listing as endangered or threatened will be noted as "PE" or "PT", respectively. Bald and Golden Eagle Protection Act (BGPA): In the July 9, 2007 Federal Register( 72:37346-37372), the bald eagle was declared recovered, and removed (de -listed) from the Federal List of Threatened and Endangered wildlife. This delisting took effect August 8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. For mor information, visit http://www.fws.-Rov/mi2ratorybirdsibaldea2le.htm Threatened due to similarity of aunearance(T(S/A)): In the November 4, 1997 Federal Register (55822-55825), the northern population of the bog turtle (from New York south to Maryland) was listed as T (threatened), and the southern population (from Virginia south to Georgia) was listed as T(S/A) (threatened due to similarity of appearance). The T (S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. Definitions of Record Status: Current - the species has been observed in the county within the last 50 years. Historic - the species was last observed in the county more than 50 years ago. Obscure - the date and/or location of observation is uncertain. Incidental/migrant - the species was observed outside of its normal range or habitat.
