We also plan to Ln utilize IWGP100000 for 0.256 acres of permanent isolated, non-jurisdictional wetland impact. L, � o+ Green Level Estates is an 18.79 acre, proposed 29 lot subdivision., for single-family detached y dwellings and associated infrastructure (e.g., roads and utilities). The project is located at 0, ko 3929, and 4005 Green Level West Road,Apex, Wake County (Latitude: 35.7754-N Longitude:- 78.9144-M. The project is in the Jordan Lake Watershed in the Cape Fear River Basin.The o Water Quality Classification for White Oak Creek is WS-IV; NSW. Mr. James Lastinger(USACE W Raleigh Regulatory Field Office)visited the site with Timmons Group environmental staff on L January 6, 2016 to confirm the delineation. The delineated jurisdictional areas include forested wetlands (isolated and non-isolated) and two jurisdictional stream features, which are buffered under the Jordan Lake Riparian Buffer rules. Mr. Ricky Temple, with the Town of Apex Public m E Works and Utilities Department issued a riparian buffer determination letter on March 28, 2016 6 U (Apex 16-002). L N V C N O We submitted a Pre-Construction Notification (PCN) Form with supporting information to your ~ E office and to Mr. James Lastinger on July 7, 2016. Subsequently, Mr. Lastinger issued a Y General Permit Verification on July 28,for impacts proposed in that application. However, your 3 office issued a "DENIAL of 401 Water Quality Certification" on September 29 for this application, 3 based on your staff's concerns that avoidance and minimization of wetland impacts was 3 insufficient for issuance of the 401 WQC. The attached, new PCN Form and supporting documents illustrate a reduction of proposed impacts at Impact Area#4 from 0.203 acres (July 7, 2016 PCN) to 0.113 acres, resulting in a reduction of proposed permanent impacts at this location by more than 44%, and a 40% reduction for the entire project. This proposed wetland impact reduction was discussed in detail during an on-site meeting with Ms. Chem Smith, Ms. Jennifer Burdette, Mr.Andy Petty(Curry Engineering), Mr. Shaun Smith (Drees Homes), and myself on October 25, 2016. During this meeting, we all discussed reasons why the proposed wetland impacts are unavoidable, as well as how we could reduce these impacts, while still maintaining viable building lots. Plan changes utilized to minimize wetland impacts in Impact 0. E Area#4 include: v 0 1. Reducing clearing and grading limits to the southern edge of the building setback, where these impacts were originally proposed to extend to the lot boundary. This change moves the impact limits north by 25 feet. 2. Requirement of a fence at the southern building setback line to clearly demarcate the permanent limits of wetland impacts on these lots. • 0 TIMMONS GROUP YOUR VISION ACHIEVED THROUGH OURS. 3. Protection of wetlands remaining on the affected lots through restrictive covenants enforceable by the homeowner's association. Proposed plan changes are graphically illustrated on the attached "Green Level Estates Lot 13, 14, 15 Grading Exhibit". This exhibit illustrates proposed building envelopes, individual lot grading, and the required fence, as discussed during our on-site meeting. The applicant offers mitigation for the proposed permanent non-isolated wetland impacts at a 2:1 ratio, through the purchase of credits from the NCDMS In-Lieu Fee Program. The required NCDMS acceptance letter is attached for your review. Lastly, in order to allow timely processing of this revised application, the applicant offers the attached letter that formally waives his right to contest the "DENIAL of 401 Water Quality Certification"that your office issued September 29, 2016.
