This PCN is being submitted for unavoidable permanent impacts to streams associated with a proposed subdivision development. The completed Pre -Construction Notification Form is provided in Enclosure 1. Additional Project specific information is provided in this letter to augment the required information of the PCN Form. The Site consists of a 35 -acre parcel of land situated east of Mockingbird Lane in Wake County, NC. The site is largely farmland with forested and undisturbed areas. Land use at the site consists of farmland with residential single family homes in the surrounding areas. The Site is drained by Little Black Creek, a tributary of the Neuse River, and is located within the Neuse River watershed, Hydrologic Unit Code (HUC) 03020201. The Honeycutt Landing site includes Phases I, II, Illa, IIIb, and IV. A Nationwide 29 and General Water Quality Certification was approved for Phase III (SAW -2015-01035; DWR #15- 0813) dated 09/29/2015 and 10/7/2015 respectively. Impacts from Phase III included 80.48 linear feet of stream and 0.15 acres of wetland impacts. No other impacts occurred from Phases I or Il. No future phases are proposed. Copies of the 2015 404 and 401 approvals as well as the proof of payment for mitigation has been included (see Enclosure 8: Agency Correspondence). Impacts to Waters of the U.S. for Phase IV are limited to 53 linear feet of stream and 7,539 square feet of riparian buffer impacts. Impacts will result from one road crossing which will utilize twin 48 -inch pipe culverts. Outfall protection will be limited to rip rap along the banks, placed above the ordinary high water mark. The proposed culverts will be buried 1 -foot below the ground surface to facilitate aquatic life movement. This delisting took effect August 8,2007. After delisting, the Bald and Golden Eagle Protection Act (Eagle Act) (16 U.S.C. 668-668d) becomes the primary law protecting bald eagles. The Eagle Act prohibits take of bald and golden eagles and provides a statutory definition of "take" that includes "disturb". The USFWS has developed National Bald Eagle Management Guidelines to provide guidance to land managers, landowners, and others as to how to avoid disturbing bald eagles. The T (S/A) designation bans the collection and interstate and international commercial trade of bog turtles from the southern population. The T(S/A) designation has no effect on land management activities by private landowners in North Carolina, part of the southern population of the species. In addition to its official status as T(S/A), the U.S. Fish and Wildlife Service considers the southern population of the bog turtle as a Federal species of concern due to habitat loss. Definitions of Record Status: Current - the species has been observed in the county within the last 50 years. Historic - the species was last observed in the county more than 50 years ago. Obscure - the date and/or location of observation is uncertain. Incidental/migrant - the species was observed outside of its normal range or habitat. In any circumstance where a permit applicant obtains an individual permit, or a Nationwide General Permit (NWP) or other general permit verification requiring "pre -construction notification" (PCN), or requests verification for a non -reporting NWP or other general permit, and the permit applicant has not requested an approved JD for the activity, the permit applicant is hereby made aware of the following: (1) the permit applicant has elected to seek a permit authorization based on a preliminary JD, which does not make an official determination of jurisdictional waters; (2) that the applicant has the option to request an approved JD before accepting the terms and conditions of the permit authorization, and that basing a permit authorization on an approved JD could possibly result in less compensatory mitigation being required or different special conditions; (3) that the applicant has the right to request an individual permit rather than accepting the terms and conditions of the NWP or other general permit authorization; (4) that the applicant can accept a permit authorization and thereby agree to comply with all the terms and conditions of that permit, including whatever mitigation requirements the Corps has determined to be necessary; (5) that undertaking any activity in reliance upon the subject permit authorization without requesting an approved JD constitutes the applicant's acceptance of the use of the preliminary JD, but that either form of JD will be processed as soon as is practicable; (6) accepting a permit authorization (e.g., signing a proffered individual permit) or undertaking any activity in reliance on any form of Corps permit authorization based on a preliminary JD constitutes agreement that all wetlands and other water bodies on the site affected in any way by that activity are jurisdictional waters of the United States, and precludes any challenge to such jurisdiction in any administrative or judicial compliance or enforcement action, or irr any administrative appeal or in any Federal court; and (7) whether the applicant elects to use either an approved JD or a preliminary JD, that JD will be processed as soon as is practicable. Further, an approved JD, a proffered individual permit (and all terms and conditions contained therein or individual permit denial can be administratively appealed pursuant to 33 C.F.R. Part 331, and that in any administrative appeal, jurisdictional issues can be raised (see 33 C.F.R. 331.5(a)(2)).
