The Conetoe II Solar project site is an existing solar panel farm located approximately 0.5 miles east of the intersection of Ellis Road and NC HWY 42 in Conetoe, North Carolina within Edgecombe County. Currently, the solar panel farm is experiencing severe flooding which is a safety concern issue. The purpose of the proposed wetland swale conveyance ditches is to convey existing flood waters from the solar panel farm area into Knights Canal and Mitchell Swamp Canal. The wetland conveyance ditches are proposed to control nitrogen and attenuate flow before the conveyance discharges through the riparian buffer and discharges into the receiving stream. The site was formerly an agricultural field and currently consists of a solar panel farm. Wetlands and streams have been delineated by Keller Environmental. There are approximately 20,000 linear feet of perennial stream located within the project site. A Tar -Pamlico Riparian Area Buffer Determination was issued on November 14, 2014 (DWQ EXP# 14-1188, attached). An on-site jurisdictional determination was conducted by the USACE (Craig Brown, USACE representative) on May 5, 2015 with Keller Environmental (not attached). CIVIL ENGINEERING I ENVIRONMENTAL I SURVEYING I GIS I LANDSCAPE ARCHITECTURE I CONSTRUCTION SERVICES PROPOSED PROJECT: Currently, the solar panel farm is experiencing severe flooding which is a safety concern issue. The purpose of the proposed wetland swale conveyance ditches is to convey existing flood waters from the solar panel farm area into Knights Canal and Mitchell Swamp Canal. Wetland swale conveyance ditches are proposed to control nitrogen and attenuate flow before the conveyance discharges through the riparian buffer. As the conveyance system enters the riparian buffer, a culvert will be trenched and backfilled through riparian buffer and discharge into the receiving stream. This is an effort to provide structural stability at the confluence of the conveyance system and the receiving stream. Temporary and permanent seeding will be applied to the impacted riparian buffer area. Traditional earthen ditch and/or rip -rap lined ditch options were examined; however, neither of these options bests controls nitrogen and/or attenuates flow through the riparian buffer. It was determined that constructing a conveyance system in the form of wetland swale conveyance ditches through the riparian buffer would control nitrogen and attenuate flow the best. Measures will be taken to prevent oil, tar, trash, debris and other pollutants from entering the adjacent jurisdictional streams and buffers. Any excess excavated materials not utilized as back fill will be placed and contained within upland areas and permanently stabilized to prevent erosion into adjacent jurisdictional streams. Stockpiling of excavated material within jurisdictional streams will be strictly prohibited as part of the construction of this project. Proper sedimentation and erosion control methods will be utilized during all phases of construction and installation. The contractor shall install silt fence only as necessary to install devices. All erosion and sediment control measures will be checked for stability and operation following every runoff producing rainfall, but in no case less than once every week. Any needed repairs will be made immediately to maintain all measures designed. An erosion control inspections report will be kept by the owner's representative. Temporary seeding and permanent seeding plans are included to restore impacted areas. The project will meet all relative requirements of Best Management Practices and Engineered Stormwater Control Structures as outlined through the State Stormwater Rules. MITIGATION: All proposed stream buffer impacts are considered an Allowable Use within the stream buffer in accordance with 15A NCAC 02B .0259 Tar -Pamlico River Basin; and therefore, mitigation is not required nor is it proposed at this time. SUMMARY: The proposed construction of wetland swale conveyance ditches at the Conetoe II Solar project site is required to alleviate existing flooding conditions within the solar panel farm area. The wetland swale conveyance ditches will control nitrogen and attenuate flow before the conveyance discharges through the riparian buffer and into Knights Canal and Mitchell Swamp Canal. As a result, there are proposed stream buffer impacts which are considered an Allowable Use within the stream buffer in accordance with 15A NCAC 026 .0259 Tar -Pamlico River Basin; and therefore, mitigation is not required nor is it proposed at this time. The proposed project is a single and complete project with appropriate land use control and stormwater measures in place for the specific areas which require them. Therefore, at this time, we are requesting Authorization of the proposed project under the Tar -Pamlico Buffer Rules. Consideration of this project is greatly appreciated. On November 12, 2014, at your request, Mr. Roberto Scheller of this Office conducted an on-site determination of a drainage features located at the subject property. The drainages were reviewed for applicability to the Tar -Pamlico Buffer Rules in accordance with (15A NCAC 2B .0259). The features are labeled as "# 008 to # 016" on the attached maps and initialed on October 10, 2014. The Division of Water Resources (DWR) has determined that the features labeled as "# 008 and # 011" on the attached maps and highlighted in blue are subject to the Tar -Pamlico Buffer Rules. The features labeled as " # 009, # 010, #012, # 013, # 014, # 015 and, # 016" on the attached maps and highlighted in red are not subject to the Tar -Pamlico Baffer Rules. Please note that the feature highlighted in yellow does not exist on the ground as depicted on the Edgecombe County NRCS Soil Survey. The confluences of the aforementioned drainage features that now into Mitchell Swamp Canal and Knight Canal are marked on the ground with yellow DWQ flagging and are illustrated on the enclosed maps. The owner (or future owners) should notify the DWR (and other relevant agencies) of this decision in any future correspondences concerning this property. This on-site determination shall expire five (5) years from the date of this letter. Landowners or affected parties that dispute a determination made by the DWR or Delegated Local Authority that a surface water exists and that it is subject to the buffer rule may request a determination by the Director.
