3a Describe the existing conditions on the site and the general land,use in the vicinity of the project -at the time of this
application- The subject property lies within the Neuse Riverbasin and ,within the ETJ of the Town of Cary, but not
within the Town limits The current land use designation for the property is Low Density Residential (LDR), and
,the current Wake County zoning is, R -30 Residential Land use,within the vicinity of the subject property is
residential, commercial, agricultural, and,forested areas, Approximately' 60 1percent of the subject property can be
characterized as agricultural °farm land which contains a residential structure and sheds used to store farm
equipment and is primarily within•the western section of the property The remaining 40 percent can'be generally
characterized as a Dry Mesic Oak - Hickory Forest within the upland areas and a Piedmont Bottomland Forest
within the wetland areas,accordmg the NC Natural Heritage Program classification system, The upland forested
and wetland forested areas are located within the eastern section of the subject property, A, pond feature was

D. Impact Justification and Mitigation
1. Avoidance,and Minimization
1a Specifically describe measures taken to'avoid or minimize the proposed impacts in designing project Impacts to
jurisdictional streams and wetlands have been avoided and minimized to'the maximum'extent practicable for Kildaire Crossing,
however, due to required infrastructure improvements there are, proposed,impacts The, Kddaire Crossing residential
development is divided into 3 Phases, with Phase 1 located within the northwestern section of the project adjacent to Arthur
Pierce, Road, Phase 2 located within thescentral and eastern section, and finally Phase, 3 located in the southeastern section of
the project Construction of Phases 1 and 2 will occur first, and have avoided impacts to Stream Feature A and Wetland
Features A and B located within the northern, section Phase I (see Inset 1) Phase 3 is separated from Phase 1 and 2 by,an
existing stream'feature,(Stream Feature B) In,orderto gain access to Phase 3, a road crossing connecting the phases is
proposed Various road crossing alternatives were examined giving consideration to traffic from one neighborhood to the next,
geometric design considerations, and minimizing impacts to stream, wetland, and buffer features There is an existing
neighborhood located to the north of the project along Chaumont Drive and,another neighborhood located to the south along
Belnap Drive, The neighborhood along Chaumont Drive, connects to Ten-Ten Road and major secondary arterial road, while
the neighborhood along Belnap Drive connects to Holly Springs Road which is another major,secondary arterial road The
concern is1hafif there was a direct road connection between Chaumont Drive and Belnap Drive, motorists would use the road
connection as a cut through between the neighborhoods to access Ten--Ten Road and Holly Springs Road Therefore, the
road connection was,offset to the east, crossing Stream Feature "B, m,an effort to limit traffic,through the neighborhoods As
mentioned before, since the May 31, 2013 on -site field concurrence meeting, the dam associated with the pond,feature was
breached and an emergent wetland community (Wetland Feature. H) has #developed at'the toe of'slope of the formerpond
feature A direct road connection between Chaumont Drive and Belnap,Dnve would ultimately impact Wetland Feature H,
Stream Features B and B1, and the riparian buffers associated with the stream features causing for a greater amount of�
impacts-to these regulated features Therefore, a road alignment which crossed Stream B perpendicularly and impacted the
least amount of °stream, wetland, and riparian buffer areas was, examined Reduction efforts in the road crossing width were
made to further minimize impacts The road crossing proposes to'impact 145 linear feet of Stream Feature. B, 0 06 acres of
wetlands (Wetland Features E and F), and 0 -31 acres of riparian buffer It should be noted that of the total 145 If of stream
impact, 14 If will be temporary impacts associated will a rip -rap dissipator pad which will be installed flush with the existing
grade of the stream bed Therefore, only 131 If ofthe,stream impacts will be permanent The,location of the road crossing
was also selected so as'to avoid impacts'to a higher quality section of Stream Feature B, as well as to avoid FEMA 100 -year
floodplams, further downstream The section, of Stream Feature B where impacts are proposed is•deeply incised, and is of
relatively low,quality compared to the downstream section located within the floodplain
1b Specifically describe measures taken to avoid or minimize the proposed impacts through construction techniques Proper
sedimentation and erosion control methods wilt be utilized during all phases of construction and installation as described in the,
Erosion Control'Plan sheet reviewed and approved by the NC Division of Land Quality and Town of Cary All work will take
place during dry conditions and can be facilitated,from high, non - jurisdictional, stable ground The contractor shall install'sdt
fence, inlet protection; sediment traps, diversion ditches; tree protection, clearing only as necessary to install devices All
erosion and sediment control measures will be checked for stability and operation following every=runoff producing rainfall, but
in no case less than once every week Any needed repairs will be made immediately to maintain all measures designed An
erosion control inspections report is required and will be kept by the owner's representative , Temporary seeding and
permanent seeding plans are included to restore impacted areas The projectVill meet all relative requirements of Best
Management Practices,and Engineered Stormwater Control Structures as outlined through State and Local Stormwater Rules

PROJECT HISTORY & EXISTING CONDITIONS:
Mr. Martin Richmond (DWR representative) issued a Neuse River Buffer
Determination on May 31, 2013 (NBRRO# 13 -159). Mr. David Shaeffer
( USACE representative) issued a Preliminary Jurisdictional Determination on
February 3, 20,14 (SAW- 2013 - 01603).
The subject property lies' within the Neuse River basin and within the ETJ of
the Town of Cary, but not within the Town limits. The current land use
designation for the property is Low Density Residential (LDR), and the
current Wake County zoning is R -30 Residential. Land use within the vicinity
of the subject property is residential, commercial, agricultural, and forested
areas. Approximately 60 percent of the subject property can be characterized
as agricultural farm land which, contains a residential structure and sheds used
to store farm equipment and is primarily within the western section of the
property. The remaining 40 percent can be generally characterized as a Dry
Mesic Oak - Hickory Forest within the upland areas and a Piedmont
Bottomland Forest within the wetland areas according the NC Natural
Heritage Program classification system. The upland forested and wetland
forested areas are located within the eastern section of the subject property. A
pond feature was observed within eastern section of the subject property
during an on-'site field concurrence meeting conducted on May 31, 2013 with
both the USAGE (USAGE AID# SAW- 2013 -01603; dated February 3, 2614)
and NCDWR (DWR Project Number NBRO# 13 -159; dated July 10, 2013)
representatives. Since May 31, 2013, the dam associated with the pond feature
was breached and an emergent wetland community has developed at the toe of
slope of the former pond feature.
PROPOSED PROJECT:
The proposed Kildaire Crossing development is a single family residential
subdivision which will be constructed in three phases and will include roads,
utilities, city sewer, and storm water management facilities. The proposed
development will consist of approximately 125 single - family lots and
associated recreation center and pocket parks. In addition, there is a future 40
foot Town of Cary Public Greenway easement associated with ,this project
which will be constructed by the Town of Cary in the future ,and currently not
associated with the proposed development. The Kildaire Crossing ,residential
development is divided into 3 Phases, with Phase 1 located within the
northwestern section of the project adjacent to Arthur Pierce Road, Phase 2
located within the central and eastern section, and finally Phase 3 ,located in

the southeastern section of the project. Construction of Phases 1 and 2 will
occur first. To gain access to Phase 3, a proposed road crossing aligned across
an unnamed tributary to Camp Branch (existing Stream Feature B). As a
result, there are proposed wetland, stream, and ,riparian buffer impacts
associated with the road crossing. Additional impacts to the unnamed tributary
to Camp Branch or to additional wetlands and streams, located within the
project area are not proposed.

The proposed stormwater management plan for Phase 1 of Kildaire Crossing
will be designed to protect the downstream environment. The plan
incorporates stormwater management techniques to manage both water
quantity and quality aspects of site runoff. Stormwater management for
Kildaire, Crossing will be accomplished by incorporating engineered
stormwater best management practice facilities to capture and treat the
istormwater runoff from developed ,areas. A total of five (5) stormwater ponds
are proposed; three (3) ponds are proposed for Phase 1 of the project, and two
(2) ponds are proposed for Phases 2 and 3. Other stormwater treatment
devices that will be used are level spreaders in conjunction with vegetated
filter strips, which are designed to remove a minimum of 40% average annual
total ,suspended solids (TSS), and provide ,30% total nitrogen and 35% total
phosphorus removal. The stormwater ponds will serve the dual purpose of
water quality and water quantity (ie. detention) control. The stormwater
management facilities proposed for Phase 1 have been sized for a 90% TSS
removal efficiency to provide TSS removal to the greatest extent _possible
within Phase 1 of the development: Since the Town of Cary is a delegated
authority for NCDWR Stormwater Management Plans, the review and
approval of the SWMP is part of the Town of Cary review process.

AVOIDANCE & MINIMIPZA'TION:
Impacts to jurisdictional streams and' wetlands have been avoided and
minimized to the maximum extent practicable for Kildaire Crossing; however,
due to required infrastructure improvements there are proposed impacts. The
Kildaire Crossing residential development is divided into 3 Phases, with Phase
1 located within the northwestern section of the project adjacent to Arthur
Pierce Road, Phase 2 located within the central and eastern section, and finally
Phase 3 located in the southeastern section of the project. Construction of
Phases 1 and 2 will occur first, and have avoided impacts to Stream Feature A
and Wetland Features A and B located within the northern section Phase I (see
Inset 1).
Phase 3 is separated from Phase 1 and 2 by an existing stream feature (Stream
Feature B). In order to ,gain access to Phase 3, a road crossing connecting the
phases is proposed. Various road crossing alternatives, were examined giving
consideration to traffic from one neighborhood to the next, geometric design
considerations, and minimizing impacts to stream, wetland, and buffer
features. There is an existing neighborhood located to the north of the project
along Chaumont Drive and another neighborhood located to the south ,along
Belnap Drive. The neighborhood along Chaumont.Drive connects to Ten -Ten
Road and major secondary arterial road, while the neighborhood along Belnap
Drive, connects to Holly Springs Road which is another major secondary
arterial road. The concern is that if there was a direct road connection
between Chaumont Drive and Belnap Drive, motorists would use the road
connection as a cut through between the neighborhoods to access Ten -Ten
Road and Holly Springs Road. Therefore, the road connection was offset to
the east, crossing Stream Feature B, in ,an effort to limit traffic through the
neighborhoods.
As mentioned before, since the May 31, 2013 on -site field concurrence
meeting, the dam associated with the pond feature was breached and an
emergent wetland community (Wetland Feature H) has developed at the toe of
slope of the former, pond feature. A direct road connection between
Chaumont Drive and Belnap Drive would ultimately impact Wetland Feature
H,, Stream Features B' and BI, and the riparian buffers associated with the
stream features causing for a greater, amount of impacts to these regulated
features. Therefore, a road alignment which crossed Stream B
perpendicularly and impacted the least amount of stream, wetland, and
riparian buffer areas was examined.

Reduction, efforts in the road crossing width were made to further minimize
impacts. The road crossing proposes to 'impact 145 linear feet of Stream
Feature B, 0.06 acres of wetlands (Wetland Features E and F), and 0.31 acres
of riparian buffer. It should be noted that of ,the total 145 if of stream impact;
14 if will be temporary impacts associated will a, rip -rap disssipator pad which
will be installed flush with the existing grade of the stream bed. Therefore;
only 131 if of the stream impacts will be permanent. The location of the road
crossing was also selected so as to avoid impacts to a`higher quality section of
Stream Feature B, as well as to avoid FEMA 100 -year floodplains, further
downstream. The section of Stream Feature B where impacts are proposed is
,deeply incised, and is of relatively low quality compared to the downstream
section located within the floodplain.
SUMMARY:
Phase 3 of the Kildaire Crossing project is separated from Phase 1 and 2 by an
existing stream feature (Stream Feature B). Various road crossing alternatives
were examined giving consideration to traffic from one neighborhood to the
next, geometric design considerations, and minimizing impacts to stream,
wetland, and buffer features. The location of the road crossing was also
selected so as to avoid impacts to a higher quality section of Stream Feature
B, as well as to avoid FEMA 100 -year floodplains, further downstream. The
section of Stream Feature B where impacts are proposed is deeply incised, and
is of relatively .low,quality compared to the downstream section located within,
the floodplain. Reduction efforts in the road crossing width were made to
minimize impacts. The road crossing proposes to impact 145 linear feet of
Stream Feature B, 0.06 acres of wetlands (Wetland Features E and F), and
0.31 acres of riparian buffer. It should be noted that of the total 145 If of
stream, impact; 14 if will be temporary impacts associated will a rip -rap
dissipator pad which will be installed, flush with the existing ,grade of the
stream bed. Therefore, only 13;1 if of the stream impacts will be permanent.
The proposed project is a single and complete project and confined within the
property boundary. Appropriate land, use control measures will be in place for
areas which will require them. Additional impacts to streams and wetlands
located on the property are not proposed. At this time, the applicant proposes
avoiding and minimizing impacts to waters of the U.S. and does not ,propose
compensatory mitigation; however, if compensatory stream and wetland
mitigation is re_ quired, the applicant would propose payment for mitigation
bank credits.

1. The Corps of Engineers believes that there may be jurisdictional waters ofthe
United States on the subject site, and the permit applicant or other affected party
who requested this preliminary JD is hereby advised of his or her option to
request and obtain an approved jurisdictional determination (JD) for that site.
Nevertheless, the permit applicant or other person who requested this
preliminary JD has declined to exercise the option to obtain an approved JD in
this instance and at this time.
2. In any circumstance where a permit applicant obtains an individual permit, or
a Nationwide General Permit (NWP) or, other, genera permit verification requiring
"pre- construction notification" (PCN), or requests verification for a non-,reporting
NWP or other general permit, and the permit applicant has not requested an
approved JD for the activity, the permit applicant is hereby made aware of the
following: (1) the permit applicant has elected to seek a permit authorization
.based on a preliminary JD, which does not make an official determination of
jurisdictional waters; (2) that the applicant has the option °to, request an approved
JD before accepting the terms and conditions ofthe permit authorization, and
that basing a- permit authorization on an approved JD could possibly' result in less
compensatory mitigation being required or different special conditions; (3) that
the applicant has the right to� request an individual permit rather than accepting
the terms and conditions of the NWP or,other general permit authorization; (4)
that�the applicant can accept a,permit authorization and thereby agree to comply
with all the terms and conditions of that,permit, including whatever mitigation
requirements the Corps has determined to be necessary; (5) that undertaking
any activity in reliance upon the subject permit authorization without'requesting
an approved JD constitutes the applicant's acceptance of the use ofthe
preliminary JD, butthat either form of JD will be processed as soon as is
practicable; (6) accepting a permit authorization (e.g., signing a proffered
individual permit) or undertaking any activity in reliance on any form of Corps
permit authorization based on a preliminary JD constitutes.agreement that all
wetlands and other water bodies on the site affected in any way by that activity
are jurisdictional waters ofthe United States, and precludes any challenge to
such- jurisdiction in any administrative or judicial compliance or enforcement
action, or in any administrative, appeal or in any Federal court; and (7) whether
the applicant elects to use either an approved JD or a preliminary JD, that JD
will be processed as soon as is practicable. Further, an approved JD, a proffered
individual permit (and all terms and conditions contained therein), or individual
permit denial,can be administratively appealed pursuant to 33 C.F.R. Part 331',
and that in any administrative appeal, jurisdictional issues can be raised (see 33
2
C.F.R. 331.5(a)(2)). If, dunng that administrative appeal, it becomes necessary
to make an official determination whether CWA jurisdiction exists over a site, or
to provide an official delineation of jurisdictional waters on the site, the Corps will'
provide an approved JD to accomplish that result, as soon as is practicable.
This preliminary JD finds that there "may be "'waters of the United States on the
subject project site, and identifies all aquatic features on the site that could be
affected by the proposed activity, based on the following information:
