The attached Pre-Construction Notification (PCN) (After-The-Fact) is being submitted on
behalf of Mr Joe Noha to allow for the construction of a rock walkway and bank
stab�l�zat�on along Walnut Creek on approx�mately 1 99 acres in Macon County, North
Carolina on Walnut Creek Road Walnut Creek along ]oe Noha's properry �s a Corps
and DWQ perennial, important stream Also included in this applicat�on �s the request
to approve the enclosed restoration plan for a mid-channel island within Walnut Creek
that has been impacted by the addition of boulders, conduit, rebar, and cement Mr
Noha is seeking a nationwide permit combination 13, 27, 29 authorization for 20 linear
feet of fill along the edge of Walnut Creek, 60 linear feet of bank stabilization along
Walnut Creek, and the restoration of the approximately 1,355 square foot mid-channel
island to pre-existing conditions
The applicant constructed approximately 20 linear feet of stone and cement to create a
walkway to connect his decking and stair system The walkway was constructed along
the edge of Walnut Creek below the ordinary high water mark The applicant also re-
stacked, cemented, and added boulders to an ex�st�ng bank stabilizing wall along
approximately 60 linear feet of a braid of Walnut Creek The enclosed �mpact map was
created from GPS points collected at the property on October 7, 2011
The third impact at the pro�ect site is a mid channel �sland that previously existed but
that has been impacted by the applicant through the addition of a top layer of boulders,
rebar, conduit, and cement to harden the top of the island There is also a rock bench
that has been constructed at the upstream end of the island along the bottom of the
larger boulders that form the upstream boundary of the �sland The top of the bench
was cemented as well

Photographs of the impacts are �ncluded �n th�s application package The applicant
requests after-the-fact approval of the stone walkway and boulder wall The applicant
also requests approval of the enclosed restoration plan to restore the top of the island
back to pre-existing conditions similar to what was present as shown in the enclosed
photographs during 2007 and 2009 Cement, conduit, rebar, and the layer of rock that
was added will be removed to once again soften the island which will allow for
movement of material during storm events
To reiterate this information, which was included in the request for additional response
time letter, for informational purposes Mr Noha will be harvesting some water from the
stream for a waterfall/pond feature that will circulate water back to the stream There
is a sketch map showing the location of this feature included Mr Noha will also be
periodically performing silt and debris clean-up that is being deposited along his
property from where he believes to be an upstream abandoned subdivision

linear feet of the edge of Walnut Creek to create a rocked sidewalk in front of his house The applicant also re stacked

materials including rock rebar conduit and cement to an existing island ad�acent to his property in Walnut Creek This
application proposes a restoration plan for the Walnut Creek island

did not realize that he was impacting Walnut Creek by constructing the walkway The walkway impacts the edge of Walnut
Creek The stacked rock wall was pre existing when Mr Noha purchased the property on November 13 2000 He re stacked
and added rock to the wall as well as cemented the top and backs of the rock to hold it in place The island also existed when
Mr Noha bou ht this ro ert He added rock rebar conduit and cement in order to create a hard surface on the island He

Quality (DWQ)conducted a site inspection for your property located along Walnut Creek Road at
m Macon County Present at this mspection were Tyler Crumbley and Tasha McCormick(US
Army Corps of Engineers) David McHenry (NC Wildlife Resources Commission) Matt Mason
and Jack Morgan (Macon County) Bnan Tompkins (US Fish and Wildlife Service) along with
yourself
401 WQC violations were noted dunng the inspection and file review Rock/earthen/concrete
fill impacts (island build up stream bank stabilization and sidewalk creation) impacts to Walnut
Creek a Class C Trout stream were documented
As a result of the site inspection and file review the following violations were identified

I Failure to Secure a 401 Water Quality Cerhficahon (WQC)
A review of records confirmed that nerther the DWQ nor the US Army Corps of Engineers
(USACOE) has recerved an application for a 404 Permit or 401 WQC pnor to the impacts

This plan proposes restoration of the mid-channel island within Walnut Creek to
similar conditions that existed as shown in photographs from 2007 and 2009
The applicant added one to two feet of additional rock/boulders to the top of the
island Conduit and rebar were buried in a cement pad along the southeastern
side of the island A stacked rock bench was added at the front (upstream) end
of the island in front of the large boulders that were previously existed in 2007
and 2009
Mr ]oe Noha has contacted Mr Bob Stewart with Dirt Plus about contracting the
restoration services Mr Stewart is familiar with the pro�ect site and he can
provide the necessary services The restoration work will need to commence
after April 15, 2012 due to the��Trout designation of Walnut Creek The timing
of the restoration during 2012 will also be contingent upon receipt of the trout
buffer variance from the NC Division of Land Quality Once the trout buffer
variance is obtained the work wili be scheduled as soon as possible
Restoration of the stacked rock cemented bench will occur using a hand
operated �ack hammer or by hand labor using sledge hammers If neither of
these two methods proved successful then a pneumatic�ack hammer on the end
of the arm of a track hoe may be needed to loosen the material even though it is
not anticipated to be necessary at this location The loosened materials will be
transferred either by wheel barrel or by a front end loader to a dump truck and
hauled off site to an upland disposal location Any salvageable rocks removed
from the bench will be stacked on the properry for later use in landscaping in
upland areas
Restoration of the top of the island will consist of loosening the rock, cement,
and rebar with similar methods as presented above It is anticipated that
removal of the rebar/concrete pad will require a heavier method such as a track
hoe operated �ack hammer mentioned above The cement, rebar, and any
trash" rocks will be moved from the island to a dump truck with wheel barrels
and a front end loader As many of the rocks and boulders as possible will be
salvaged in this area as well Once the concrete pad is broken into pieces the
electrical conduit can be removed
The elevation of the island will be restored to as close to pre-existing as possible
The large boulders at the upstream end, the stacked rock along the sides, and
the foot bridge will remain A riparian seed mix will be spread and stabilized with
straw matting on the top of the mid channel island once restoration activities are
complete The existing hardened surface of the island will be restored to a
natural loose surface containing a mix of boulders, cobble, gravel, and sand
Restoration activities will not commence until the applicant has received approval
of the 404 Corps permit, the 401 Water Quaiity Certification, and the trout buffer
variance The timeline for restoration activities is presented below

This timeline allows for three weeks for completion of the restoration of the
island if weather conditions are not favorable then the restoration will take
longer The applicant or the applicant's consultant will notify the agencies prior
to commencement of the restoration work
The following observations and professional opinions address the concern that
the enclosed banks of the left braid of Walnut Creek create a chute effect that
could potentially create unstable conditions downstream From information
gained from Mr Noha dating back more than ten years and from photos dating
back to 2004, the left braid has always been the secondary braid and has been
narrower than the right braid The main flow of Walnut Creek is in the right
braid as well as the main flow during storm events The left braid does get
significant storm flows which create mcreased velocities and rise in water
elevations, however the fall and large pool at the downstream confluence is
capable of absorbing energy during storm flows There are also very large
boulders surrounding the pool at the confluence that absorb and dissipate
energy during higher flow storm events There is a log dam �ust downstream
that was built in con�unction with a historic water wheel that helps to absorb
energy during higher flow events The water fall and subsequent pool �ust below
the log dam also absorbs energy and slows flows during rain events
Once restored to its orig�nal elevation and more natural condition (loose material
and vegetation) the sub�ect mid-channel island will perform a positive natural
function within the channel Like the two other smaller islands immediately
downstream, the island will act as small flood prone area within the steep valley
walls during high flows During normal flows, the two braids on either side of
the island still maintain the necessary capacity to move sediment through the
system
