Dear Mr. Charles and Ms. Higgins,
On behalf of Blue Treasure LLC., we are requesting authorization from the USACE to use NWP 12
for 0.41 acres of temporary wetland impacts for construction of 30,000 If of 8 -inch gravity sewer
line. We are also requesting a 401 WQC from NCDWR for the above referenced impacts.
The project area associated with the proposed sewer easement is ±27.32 acres in size and is located
in the northeast portion of Beau Coast development. Beau Coast (formerly Beaufort East Village) is
±257.16 acres in size and is located adjacent to Lennoxville Road (SR 1310), east of downtown
Beaufort and abuts Turner Creek to the north in Beaufort, Carteret County, North Carolina
(Latitude: 34.719269'N; Longitude: -76.634425'W). Beau Coast is located in the White Oak River
Basin and onsite waters drain to both Turner Creek and Taylor Creek. The Water Quality
Classification for Turner Creek is SA;HQW and the Stream Index Number is: 21-35-1-11-1. The
Water Quality Classification for Taylor Creek is classified as SC and the Stream Index Number is:
20-20. The cataloging unit for the site is 03030002.
Proposed Project
The proposed project consists of the installation of 30,000 If of 8 -inch gravity sewer within the Beau
Coast subdivision (formerly Beaufort East Vil lage) in order to provide future residents with sanitary
sewer service. The Beau Coast subdivision is currently under construction, and is being constructed
in phases.
The original 404/401 permitting in 2011 authorized the permanent and temporary impacts
necessary for construction of the roads and lots. But due to the size of the project, only the initial 2
phases were actually designed due to the recovering real estate market in 2011. During 2011
permitting, it was understood that the layout of future phases may change to meet market
demands, and that the final utility alignments could not be determined under the layouts had been
finalized, at which point a NWP 12 would be required to install utilities. The applicant has finalized
the design for all future phases, and sufficient topo survey data has been collected to finalize the
alignment of the sewer line. Please note that this application includes all wetland impacts necessary
for installation of the sewer service for the entire Beau Coast project, and no future impacts are
anticipated.

Please note that all permanent impacts authorized in the 2011404/401 permits were completed
prior to the expiration of the permits on March 18, 2012.
Project History
Onsite 404 wetlands were originally delineated and approved by the Corps of Engineers in 2007
(AID: SAW -2010-00207), and re -approved in 2016. The 2016 Signed Wetland Surveys have been
provided as an Appendix.

Please note that the 2016 Jurisdictional Determination identified several wetlands which were
determined to not have a significant nexus to downstream waters, and therefore were not
jurisdictional. Legislative revisions to the isolated wetland rules (IWGP100000) result in only"bog"
and "basin" wetlands being regulated. It should be noted that none of the non -jurisdictional or
isolated wetlands within the Beau Coast project are classified as "bogs" or "basin" wetland in the
"Dichotomous Key to General NC Wetland Types". Therefore, the non -jurisdictional and isolated
wetlands as shown on the 2/12/16 signed wetland surveys are not regulated by NCDWR.
NCDWR issued a 401 WQC and Isolated Wetlands Certification (DWQ Project # 01-0825) for the
Beaufort East Village project (now Beau Coast) on October 10, 2011 authorizing 0.467 acres of
permanent jurisdictional wetland impacts and 0.409 acres of permanent isolated wetland impacts
for lot construction, road construction, stormwater features and retaining walls. A copy of the 401
and Isolated Wetlands Certification has been provided as an Appendix.
The Corps of Engineers issued NWP 29 (AID: SAW -2010-00207) for the Beaufort East Village
project (now Beau Coast) authorizing 0.467 acres of permanent jurisdictional wetland impacts for
lot construction, road construction, stormwater features and retaining walls on October 11, 2011.
A copy of the 2011 NWP 29 has been provided as an Appendix.
NCDCM issued a CAMA Major Development Permit (Permit #137-11) on November 17, 2011.
Permit #137-11 expired on February 13, 2015, however all conditions and stipulations of permit
#137-11 remain in force under renewals issued on May 8, 2015 and February 28, 2017. A copy of
the major CAMA renewal has been provided as an Appendix.
The proposed temporary wetland impacts for installation of the sewer line are not located within
CAMA wetlands or within the 75' CAMA AEC. Therefore, a modification of the CAMA Major
Development Permit, or coordination with NCDCM is not required.
During the original permitting of the Beau Coast project (formally Beaufort East Village) in 2011,
the applicant coordinated with the NC SHPO for a project review. SHPO requested an
archeological survey, which was completed and the results submitted to SHPO. In a letter dated
12/13/2011, NCSHPO concurred with the results and recommendations of the archeological
survey. Therefore, the installation of the proposed sewer line will not result in impacts to historic
or archeological resources. A copy of the SHPO letter has been included as an Appendix.

The proposed impacts consist of 0.41 acres of temporary wetland impacts.
The proposed 0.41 acres of temporary wetland impacts will occur from installation of a sewer line.
Also, please note that the 20' sewer easement will be maintained/mowed in perpetuity, resulting in
0.19 acres of permanent conversion impacts as a result of conversion from forested wetlands to
herbaceous wetlands.
The cumulative impacts for Beau Coast (formerly Beaufort East Village) do not exceed 0.50 acres
of permanent impacts to jurisdictional wetlands, and therefore the proposed sewer line is eligible
for authorization under a standalone NWP 12.
The routine mowing/maintenance of the entire 20' sewer easement will result in 0.19 acres of
permanent conversion impacts, which will result in the permanent conversion of forested wetlands
to herbaceous wetlands.
Please note that Map C depicts the impacts to Wetland M, which was determined to be non -
jurisdictional by the Corps of Engineers during the reissuance of the JD in 2016. Wetland M is not
classified as a "bog" or "basin" wetland using the "Dichotomous Key to General NC Wetland Types".
Therefore, per the 2017 IWGP100000, impacts to this wetland are not regulated by the NCDWR,
and therefore have not been assessed as an impact in this application. Map C has been provided
simply for clarity.
Avoidance and Minimization
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted
so that impacts to wetlands and "waters" could be minimized.
Due to the location of the wetlands within the corridor, as well as site constraints dictating design,
impacts could not be avoided completely. The vast majority of the proposed gravity sewer
alignment has been located within roads and uplands. However, due the significant amount of

wetlands and their landscape location, impacts could not be avoided entirely. Due to the extremely
flat topography of the site, the sewer crossings through the wetlands could not be designed as aerial
crossings and achieve the necessarygrade to maintain positive flow. Therefore, the sewer line must
be trenched. However, impacts for installation of sewer lines have been minimized to only 0.41
acres of temporary wetland impacts at five wetland crossings for±30,000 If of sewer line. Wetland
impacts were minimized by designing the sewer alignment to cross the wetlands perpendicularly at
the narrowest area practical.
Upon completion of the installation of the proposed sewer line, the disturbed wetland areas will be
returned to natural grade and seeded with a wetland seed mix to restore wetland vegetation. Only
the 20' permanent access/maintenance corridor will be regularly mowed/maintained, and the
temporary construction easement will be left undisturbed to return to forested wetlands.
Construction techniques used to avoid or minimize the prosed impacts include the installation or
erosion & sedimentation control devices prior to construction of the unity line. Access to impact
areas will be from high ground.
Mitigation
The applicant does not proposed mitigation for the 0.41 acres of temporary wetland impacts, since
the impacts are temporary.
As a result of the permanent wetland conversion impacts exceeding 0.10 acres, mitigation is
required by the Corps of Engineers. Therefore, the applicant proposes to mitigate for the 0.19 acres
of permanent conversion impacts at a 1:1 mitigation ratio through the purchase of 0.19 acres of
riparian wetland mitigation. There are no private mitigation banks in which service the White Oak
03030002 basin. Therefore, the 0.19 acres of wetland mitigation will be provided through the NC
Division of Mitigation Services In -Lieu Fee Program. A copy of the DMS Letter of Acceptance has
been provided as an Appendix.
The current request is for 0.41 acres of temporary wetland impacts (see the attached maps and
PCN for details).

The proposed project is located within the Beau Coast subdivision (formerly Beaufort East Village), which is currently
under construction. The general land use in the vicinity of the project is undeveloped woodlands, residential use and the
project site is bordered to the north by Turner Creek and to the south by Taylor Creek. Additionally, Freedom Park, a
Town of Beaufort Park, is located in the middle of the Beau Coast site, but is not a part of the project.

D. Impact Justification and Mitigation
1. Avoidance and Minimization
1a. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project.
Prior to site plan design, the applicant requested that a detailed wetland delineation be conducted so that impacts to wetlands
and "waters" could be minimized.
Due to the location of the wetlands within the corridor, as well as site constraints dictating design, impacts could not be
avoided completely. The vast majority of the proposed gravity sewer alignment has been located within roads and uplands.

However, due the significant amount of wetlands and their landscape location, impacts could not be avoided entirely. Due to
the extremely flat topography of the site, the sewer crossings through the wetlands could not be designed as aerial crossings
and achieve the necessary grade to maintain positive flow. Therefore, the sewer line must be trenched. However, impacts for
installation of sewer lines have been minimized to only 0.41 acres of temporary wetland impacts at five wetland crossings for
±30,000 If of sewer line. Wetland impacts were minimized by designing the sewer alignment to cross the wetlands
perpendicularly at the narrowest area practical.
Upon completion of the installation of the proposed sewer line, the disturbed wetland areas will be returned to natural grade
and seeded with a wetland seed mix to restore wetland vegetation. Only the 20' permanent access/maintenance corridor will
be regularly mowed/maintained, and the temporary construction easement will be left undisturbed to return to forested
wetlands.
Construction techniques used to avoid or minimize the prosed impacts include the installation or erosion & sedimentation
control devices prior to construction of the unity line. Access to impact areas will be from high ground.

The proposed project consists of the installation of a gravity sewer line to provide sewer service to the entire Beau Coast
subdivision (formerly Beaufort East Village). The gravity sewer will only service the approved Beau Coast subdivision,
and there are no future phases of Beau Coast. Therefore, the proposed project will not be a catalyst for future
development that could impact nearby downstream water quality.

WR reviewed the NC Natural Heritage Program database, located at http://www.ncnhp.org/web/nhp/home, as well as
NCNHP GIS data to identify if there were any known occurrences of endangered species on or near the proposed project.
The review of the NHP data identified four (4) occurrences of federally listed threatened or endangered species within 1.0
miles of the project, see attached NCNHP project review letter. However, these species were marine species (Atlantic
sturgeon & west Indian manatee) and two occurred only on the beach/ocean front (seabeach amaranth and piping
plover), and there is no potential habitat for any of these species within the proposed sewer alignment. Field reviews did
not identify any potential habitat for federally listed species within the proposed sewer alignment. Additionally, this project
is located within the Beau Coast subdivision (formerly Beaufort East Village), which received a NWP 29 in 2011, which
documented that the project would not result in impacts to Federally listed threatened or endangered species.

adjacent (northeast) of the proposed project, as Essential Fish Habitat. However, the proposed project will have sediment
and erosion control measures in place to prevent sediment from escaping into Essential Fish Habitat, which will prevent
adverse impacts to Essential Fish Habitat within the North River.

archeological survey. Therefore, the installation of the proposed sewer line will not result in impacts to historic or
archeological resources. A copy of the SHPO letter has been included as an Appendix.

Dear Ms. Russ:
Thank you for your letter of November 21, 2011 transmitting the archaeological survey report for the proposed
Beaufort East Village development. We have reviewed the report and offer the following comments.
Forty-two acres of the tract were surveyed at an intensive level. The field methods were appropriate and
undertaken in accordance with our recommendations. Three archaeological sites were located as a result of this
effort. These sites include: 31CR397, 31CR398, and 31CR399.
Site 31CR397 is a marked cemetery. While this site was not considered eligible for inclusion in the National
Register of Historic Places (NRHP), avoidance was recommended for this cemetery. We concur with these
recommendations. We recommend avoidance of 31CR397 by all development activities and compliance with
North Carolina state laws regarding cemeteries.
Sites 31CR398 and 31CR399 were recommended as ineligible for the NRHP. No further work was
recommended for these two sites. We concur with these recommendations. As a result of the archaeological
survey, clearance to proceed was recommended for the Beaufort East Village development. We concur with
this recommendation and consider that the conditions placed upon the applicant's CAMA permit regarding
archaeological resources have been fulfilled.
The above comments are made pursuant to Section 106 of the National Historic Preservation Act and the
Advisory Council on Historic Preservation's Regulations for Compliance with Section 106 codified at 36 CFR
Part 800.

Dear Mr. Blackley:
You have our approval, in accordance with the attached conditions and those listed below, to permanently impact
0.467 acres of jurisdictional wetlands, temporarily impact 0.046 acres of jurisdictional wetlands and permanently
impact 0.409 acres and temporarily impact 0.0205 acres of isolated wetlands for the development of a
subdivision and infrastructure, as described within your CAMA application dated August 25, 2011 and received
by the Wilmington Regional office (WiRO) on August 29, 2011 and additional information received on
September 20, 2011, October 5, 2011 and October 7, 2011. After reviewing your application, it has been
determined that the impacts are covered by General Water Quality Certification Number 3821 (GC3821) and the
General Permit for Impacts to Isolated Wetlands and Other Non jurisdictional Wetlands and Waters (IWGP
100000). These Certifications allow you to use Nationwide Permit 29 when issued by the US Army Corps of
Engineers (USACE). In addition, you should obtain or otherwise comply with any other required federal, state
or local permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with your proposed impacts
or to conduct impacts to waters as depicted in your application shall expire upon expiration of the 404 Permit.
This approval is for the purpose and design that you described in your application. The approved plans and
specifications for this project are incorporated by reference and are an enforceable part of the permit. If you
change your project, you must notify us and you may be required to send us a new application. Additional
wetland impacts that may cause the impacts to exceed the 0.5 acre threshold will be required to be submitted as an
Individual Permit application. If the property is sold, the new owner must be given a copy of this Certification
and approval letter and is thereby responsible for complying with all conditions. If total fills for this project (now
or in the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be required
as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the conditions listed in the
attached certification and any additional conditions listed on the following pages.

2. Sedimentation and Erosion Control

b. The design, installation, operation, and maintenance of the sediment and erosion control measures
must be such that they equal, or exceed, the requirements specified in the most recent version of the
North Carolina Sediment and Erosion Control Manual. The devices shall be maintained on all
construction sites, borrow sites, and waste pile (spoil) projects, including contractor -owned or leased
borrow pits associated with the project.
c. For borrow pit sites, the erosion and sediment control measures must be designed, installed, operated,
and maintained in accordance with the most recent version of the North Carolina Surface Mining
Manual.
d. The reclamation measures and implementation must comply with the reclamation in accordance with
the requirements of the Sedimentation Pollution Control Act.
3. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas beyond the
footprint of the impacts depicted in the Pre -Construction Notification. All construction activities,
including the design, installation, operation, and maintenance of sediment and erosion control Best
Management Practices, shall be performed so that no violations of state water quality standards,
statutes, or rules occur.
4. No Sediment & Erosion Control Measures w/n Wetlands or Waters
Sediment and erosion control measures shall not be placed in wetlands or waters to the maximum extent
practicable. If placement of sediment and erosion control devices in wetlands and waters is unavoidable,
they shall be removed and the natural grade restored within six months of the date that the Division of
Land Resources has released the project.
5. Protective Fencing
The outside wetland or water boundary and within 50 feet of all construction and land clearing activity
shall be clearly marked with orange warning fencing or similar high visibility material for the subdivision.
This is to be done prior to any land disturbance for the areas that have been approved to infringe within
the wetland or waters;
6. Culvert Installation
Culverts required for this project shall be installed in such a manner that the original /stream wetland
profiles are not altered. Existing stream dimensions (including the cross section dimensions, pattern, and
longitudinal profile) must be maintained above and below locations of each culvert. Culverts shall be
designed and installed to allow for aquatic life movement as well as to prevent head cutting of the
streams. If any of the existing pipes are or become perched, the appropriate stream grade shall be re-
established or, if the pipes installed in a perched manner, the pipes shall be removed and re -installed
correctly.

7. Construction Stormwater Permit NCGO10000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division of Land
Resources (DLR) or a DLR delegated local erosion and sedimentation control program, an NPDES
General stormwater permit (NCGO10000) administered by DWQ is automatically issued to the project.
This General Permit allows stormwater to be discharged during land disturbing construction activities as
stipulated by conditions in the permit. If your project is covered by this permit [applicable to
construction projects that disturb one (1) or more acres], full compliance with permit conditions including
the sedimentation control plan, self-monitoring, record keeping and reporting requirements are required.

"Re -opener" Clause
Blue Treasure, LLC and its authorized agents shall conduct its activities in a manner consistent with State
water quality standards (including any requirements resulting from compliance with section 303(d) of the
Clean Water Act) and any other appropriate requirements of State law and federal law. Blue Treasure,
LLC shall require its contractors (and/or agents) to comply with all of the terms of this Certification,
and shall provide each of its contractors (and/or agents) a copy of this Certification. A copy of this
Certification shall be included in the construction contract and available on the job site at all times. If
DWQ determines that such standards or laws are not being met (including the failure to sustain a designated
or achieved use) or that State or federal law is being violated, or that further conditions are necessary to
assure compliance, DWQ may reevaluate and modify this certification to include conditions appropriate to
assure compliance with such standards and requirements in accordance with 15A NCAC 2H.0507(d).
Before modifying the certification, DWQ shall notify E Blue Treasure, LLC and the US Army Corps of
Engineers, provide public notice in accordance with 15A NCAC 2H.0503 and provide opportunity for
public hearing in accordance with 15A NCAC 2H.0504. Any new or revised conditions shall be provided
to Blue Treasure, LLC in writing, and shall be provided to the United States Army Corps of Engineers for
reference in any permit issued pursuant to Section 404 of the Clean Water Act, and shall also become
conditions of the 404 Permit for the project.
9. Deed Notifications
A recorded copy of the deed notifications and the associated wetland map approved by the US Army
Corps of Engineers Wilmington Regulatory Office must be submitted to this Office and to the 401
Oversight and Express Unit in Raleigh within 15 days of lots having been platted and recorded.
10. Determination of Impacts
At the completion of the project, the DWQ may require a determination of the area impacted which is to
encompass the location and acreage of the impacts (it can be shown on an aerial or done as a survey).
This is to be included with the Certification of Completion and sent to the Wilmington Regional Office
(address on the letterhead page) and to Raleigh (address below).

11. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or applicable Buffer
Rules, and any subsequent modifications, the applicant is required to return the attached certificate of
completion to the 401/Wetlands Unit, North Carolina Division of Water Quality, 1650 Mail Service
Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may result in
criminal and/or civil penalties. The authorization to proceed with your proposed impacts or to conduct impacts to
waters as depicted in your application and as authorized by this Certification shall expire upon expiration of the
404 or CAMA Permit.
If you wish to contest any conditions in the enclosed certification (associated with the approved wetland or waters
impacts) you must file a petition for an administrative hearing. You may obtain the petition form from the office
of Administrative hearings. You must file the petition with the office of Administrative Hearings within thirty
(3 0) days of receipt of this notice. A petition is considered filed when it is received in the office of
Administrative Hearings during normal office hours. The Office of Administrative Hearings accepts filings
Monday through Friday between the hours of 8:00 am and 5:00 pm, except for official state holidays. The
original and one (1) copy of the petition must be filed with the Office of Administrative Hearings.
The petition may be faxed -provided the original and one copy of the document is received by the Office of
Administrative Hearings within five (5) business days following the faxed transmission.

Your work is authorized by the above referenced permit provided it is accomplished in strict accordance with the attached
conditions and your submitted plans. Any violation of the attached conditions or deviation from your submitted plans may subject
the permittee to a stop work order, a restoration order and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide authorization is modified,
suspended or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or
modified, this verification will remain valid until the expiration date identified below, provided it complies with all requirements of
the modified nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are
under construction) or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the
activity is completed within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless
discretionary authority has been exercised on a case-by-case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401 Water Quality Certification. You
should contact the NC Division of Water Quality (telephone (919) 733-1786) to determine Section 401 requirements.
For activities occurring within the twenty coastal counties subject to regulation under the Coastal Area Management Act (CAMA),
prior to beginning work you must contact the N.C. Division of Coastal Management.
This Department of the Army verification does not relieve the permittee of the responsibility to obtain any other required Federal,
State or local approvals/permits.

1/27/17.
This permit, issued on February 28, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) This renewal shall be attached to Permit No. 137-11, which was issued to the permittee on 11/17/11,
as well as all subsequent renewals, and copies of all documents shall be readily available on site
when a Division representative inspects the project for compliance.
2) All conditions and stipulations of the active permit remain in force under this renewal.
NOTE: A permit renewal application processing fee of $100 was received by DCM for this project.
This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on-site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2018

The purpose of this letter is to notify you that the NCDEQ Division of Mitigation Services (DMS) is willing to
accept payment for compensatory mitigation for impacts associated with the above referenced project as
indicated in the table below. Please note that this decision does not assure that participation in the DMS in -
lieu fee mitigation program will be approved by the permit issuing agencies as mitigation for project impacts.
It is the responsibility of the applicant to contact permitting agencies to determine if payment to the DMS will
be approved. You must also comply with all other state, federal or local government permits, regulations or
authorizations associated with the proposed activity including G.S. § 143-214.11.
This acceptance is valid for six months from the date of this letter and is not transferable. If we have not
received a copy of the issued 404 Permit/401 Certification/CAMA permit within this time frame, this
acceptance will expire. It is the applicant's responsibility to send copies of the permits to DMS. Once DMS
receives a copy of the permit(s) an invoice will be issued based on the required mitigation in that permit and
payment must be made prior to conducting the authorized work. The amount of the in -lieu fee to be paid by
an applicant is calculated based upon the Fee Schedule and policies listed on the DMS website.
Based on the information supplied by you in your request to use the DMS, the impacts for which you are
requesting compensatory mitigation credit are summarized in the following table. The amount of mitigation
required and assigned to DMS for this impact is determined by permitting agencies and may exceed the
impact amounts shown below.
