USGS Site Location Map, attached). The purpose of this project is to improve the storm drainage infrastructure and alleviate flooding within the neighborhood. On behalf of Charlotte- Mecklenburg Storm Water Services (CMSWS), Dewberry, Inc. has contracted Carolina Wetland Services, Inc. (CWS) to provide Section 404/401 permitting services for this project. This project was previously permitted on July 12, 2011 (Action ID 2011 - 00369). This permit has now expired. A representative photograph of on -site vegetation has been included as Photograph L. According to the Soil Survey of Mecklenburg County' (Figure 2. NRCS Soil Survey Map, attached), on -site soils consist of Cecil sandy clay loam (CeB2 and CeD2), Cecil -Urban land complex (CuB), Helena sandy loam (HeB), and Monocan and Arents (MS). Cecil soils are well drained and Helena soils are moderately well drained. Monocan soils are somewhat poorly drained and Arents refers to areas where the natural soil has been disturbed with fill. Monocan and Helena soils have been listed in the North Carolina Hydric Soils List for Mecklenburg County as having hydric inclusions2. Monacan soils are also listed as hydric soils (hydric criteria 2133, 4) on the National Hydric Soils List3. Jurisdictional Determination An Approved Jurisdictional Determination was issued for this project on July 12, 2011 (Action ID 2011- 00369). This determination remains valid until July 12, 2016. A copy of the verification letter is attached. On -Site Jurisdictional Waters of the U.S. are summarized in Table 1, below. Table 1. Summary of On -Site Jurisdictional Waters Project Permitting History A Nationwide Permit No. 3 and 27 was issued for project on July 12, 2011 (Action ID 2011 - 00369). This permit authorized pipe replacement, pipe extension, replacement/installation of rip rap, and stream enhancement/bank stabilization activities. Impacts to stream channels authorized by this permit totaled 149 linear feet of stream channel under NWP No. 3, and 450 linear feet of stream channel under NWP No. 27. Previously permitted impacts are summarized in Table 2, below and are shown in Figure 4 (attached). A copy of the permit authorizing these impacts is attached. Additional Impacts The proposed pipe extension, as originally permitted for the Cherokee - Scotland CIP, terminated at the rear of the house at 1425 Scotland Avenue. The previously permitted Cherokee - Scotland CIP (Action ID 2011 - 00369) proposed to replace the existing 96 -inch corrugated metal pipe (CMP) at 1417 Scotland Avenue with a double barreled pipe consisting of two 8' x 6' reinforced concrete box culverts (RCBC), and extend the pipe system downstream by 62 linear feet. A 48 linear foot rip rap apron at the pipe outlet was also permitted. The purpose of the Cherokee - Scotland CIP is to improve the storm drainage infrastructure and alleviate flooding within the neighborhood. The culvert extension associated with the Cherokee - Scotland CIP was limited to that length necessary to fulfill the flood alleviation goals of the project and to protect the foundations of the house at 1425 Scotland Avenue. However, the property owner at 1425 Scotland Avenue has since expressed serious safety concerns regarding the location of the pipe terminus at the rear of his property. The property owner has requested that the pipe system be extended downstream by 34 linear feet to improve safety for the residents of 1425 Scotland Avenue. The previously permitted double 8' x 6'RCBC at the rear of 1417 and 1425 Scotland Avenue will be extended downstream by 34 linear feet (Plan Sheets 6.2 and 6.3, attached). The extension of this pipe is necessary to improve safety at 1425 Scotland Avenue. The previously permitted 48 linear foot rip rap apron will be relocated to the downstream end of the proposed pipe extension. This rip rap apron is necessary to dissipate the energy of the water exiting the pipe. Figure 5 (attached) shows the currently proposed project impacts. The additional impacts to on -site jurisdictional waters that are being requested are summarized in Table 3, below. The previously permitted 48 linear foot rip rap apron will be relocated downstream of the pipe extension (Plan Sheet 6.2, attached). The primary purpose of extending the pipe relates to (i) safety concerns and (ii) the extremely close proximity of the original proposed headwall and open channel to the back of the residence, which would have the effect of destroying the residential nature of the property. By extending the pipe as requested, safety concerns can be reduced. Furthermore, because the existing channel moves at an angle away from the residential structures on the east side of Scotland Avenue, the project would not have the effect of destroying the residential character of the property or the residential character of the neighboring property. Safety Concerns The homeowners have five grandchildren whose ages range from three to ten, and for whom the proposed open channel poses significant safety concerns. In addition, the neighborhood is not fenced off. Consequently, other children in the neighborhood are accustomed to using the back yard of 1425 Scotland Avenue as a play area and short cut to other streets in the neighborhood. The homeowner believes the extraordinary width and steepness of the open channel, particularly at the headwall, pose a grave danger to young children who may be tempted to venture down the sides or who may fall accidentally into the open channel. There will be a sheer drop of over ten feet at the headwall which is currently proposed to be located immediately to the rear of the residence. Effect on Property Value In an email dated April 19, 2013, Mr. Shoemaker stated that, without the proposed pipe extension the City's Cherokee Scotland CIP, "...would have a devastating effect on our property value. We do not envision anyone (with or without children/grandchildren) purchasing our home after the project is constructed unless the requested extension is approved. Without the extension of the pipe, our property would be viewed as extremely hazardous to anyone looking to purchase a residential structure and we do not envision anyone would find it suitable for residential use. Extending the pipe would result in our property having a grass covered back yard for most of its width and as such it would present a significantly reduced safety risk and it would preserve the most of the residential nature of the property. For those reasons, while we believe there would be an adverse impact to our property value even with the requested extension of the pipe, we believe the adverse effect would be much less ". The negative effects on the value of the property can be significantly mitigated by moving the headwall away from the rear of the house as proposed by this project. 0 Cherokee Scotland CIP June 25, 2013 Nationwide Permit No. 3 and 27 Project No. 2008 -2256 Avoidance and Minimization The proposed extension does not go all the way to the property line. Instead, the new headwall will be located approximately 15 feet short of the property line. Because of the angle of the channel, that would move the culvert headwall further away from the residence and allow the property owner to develop a safety plan for the headwall that would not destroy the residential character of the property. The option of fencing the headwall in -situ was examined. This option was determined to be unfeasible for the following reasons. No fence would be completely effective to keep out children who are determined to explore or get into the open channel. In addition, any fence that could be designed with safety in mind would likely make the property lose its residential character entirely if installed so close to the house. By moving the headwall downstream closer to the property line, more substantial safety measures could be installed without the loss of the residential character of the property. The option of using a bottomless culvert was examined and discounted due to the excessive cost of this option. A bottomless culvert of sufficient size would cost over $100,000 more than the proposed option. This is cost prohibitive for the property owner who is self funding this project. Adjacent Property Owner Permission The City of Charlotte holds a drainage easement on the stream channel downstream of 1425 Scotland Avenue. A copy of the easement option document is attached. Total Proposed Impacts to Jurisdictional Waters of the U.S. The overall project will involve the replacement of existing pipe systems, pipe extension, replacement of existing rip rap aprons, and stream enhancement. Stream A downstream of 1425 Scotland Avenue will be enhanced by laying back the banks and installing live - stakes on the banks to provide improved bank stability (Plan Sheet 6.2, attached). The length of the proposed stream enhancement has been reduced to easement acquisition issues. Unavoidable impacts to Jurisdictional Waters of the U.S. total 440 linear feet of stream impacts. These impacts include 183 linear feet of permanent impacts and 257 linear feet of temporary impacts (Figure 5, attached). Compensatory Mitigation The project, as originally proposed and permitted, had a total of 149 linear feet of permanent stream impacts. Therefore, compensatory mitigation was not originally required for this project. Based on email correspondence (attached) and telephone conversations, with Ms. Amanda Fuemmeler of the USACE and Mr. Alan Johnson of the NCDWQ, mitigation will only be required for the additional impacts that are being added to the previously permitted project at the behest of the property owner of 1425 Scotland Avenue. CMSWS proposes to mitigate at a 1:1 ratio for the 34 linear feet of additional permanent impacts through a credit purchase from the Charlotte Umbrella Stream and Wetland Mitigation Bank ( "Umbrella Bank "). The resident at 1425 Scotland Avenue will reimburse CMSWS for the mitigation cost: This mitigation proposal was reached in accordance with correspondence between CMSWS, the USACE, and NCDWQ (email attached). Describe the existing conditions on the site and the general land use in the vicinity of the project at the time of this application: The project area is approximately 270 acres in extent and consists of long established residential subdivisions with maintained lawns and gardens, and small adjacent wooded areas. Typical on -site vegetation includes sweetgum (Liquidambar styraciflua), willow oak (Quercus phelos), Chinese privet (Ligustrum sinense), glossy privet (Ligustrum lucidum), fescue (Festuca spp.), and Japanese honeysuckle (Lonicera japonica). 3b. Explain the purpose of the proposed project: The purpose and need for this project is to alleviate flooding and erosion issues within the project limits. The need for these repairs was identified through the 336 -RAIN call database maintained by the City of Charlotte. The 336 -RAIN call database is a telephone hotline where citizens of the City of Charlotte and Mecklenburg County can call in and report storm water requests or ask general storm water related questions. Typical storm water requests include maintenance and repair requests, flooding, and other storm water issues. Each call is given a priority rating (by a City-County representative), A through C, with A being the highest priority. Calls may also be logged as ADM (administrative requests), DNQ (call does not qualify for service), and /or U (undefined). The 336 -RAIN database contains a total of two hundred and four (204) calls within the project study area that have been made from one hundred twenty-two (122) unique addresses. Two or more calls were made from forty -one (41) addresses. One hundred nine (109) of the total two hundred and four (204) calls pertain to either flooding or erosion problems, whereas the remaining calls are for a variety of requests or administrative issues. Of the total number of calls, thirty -four (34) are indicated as being "open" (i.e. unresolved) requests, whereas, the others are closed and have been resolved. As indicated above, there have been a large number of calls made for a variety of requests, however, the majority of the requests are related to flooding and /or erosion. A map taken from a planning report prepared for the project has been attached as Figure 4. This map shows the locations of both citizen questionnaire responses and 336 -RAIN calls within the project area. Inspection of the call records revealed that flooding due to clogged or blocked storm drains has been one of the most common service requests. Many of these requests were resolved by the City through the clearing of blockages. Sink holes from blowouts or leaking system pipes /structures were also noted in many of the calls. These issues were often resolved through repair and /or replacement of deteriorated systems. Tree roots were identified in several of these calls as the cause of the damage. Overall, 1993, 1995, 1997, 1998, and 2003 resulted in a large number of calls concerning flooding, most severely from Perrin Place and Middleton Drive. These years are coincident with years in which Charlotte received large storm events.Of the thirty -four (34) RAINS requests which are listed as being "open" (i.e. unresolved), twenty-four (24) of the requests relate to eleven properties within close proximity to the proposed drainage improvements. The open RAINS requests relate to erosion (9 requests), street and property flooding (7 requests), and blockages (5 requests). There are also three general storm water inquiry requests. One property, 1417 Scotland Avenue is classified as 'Priority A' for erosion, and one property (708 Cherokee Road) is classified as 'Priority B' for flooding. Other properties with open requests are classified as 'Priority C' or 'Undefined'. These properties include 728 Cherokee Road (erosion), 1118 Scotland Avenue (erosion), 1134 Scotland Avenue (erosion), 1609 Scotland Avenue (blockage), 1613 Scotland Avenue (blockage), 1623 Scotland Avenue (blockage), 1620 Twiford Place (erosion and flooding), 1126 Providence Road (flooding), and 2533 Hampton Avenue (flooding). Flooding and erosion problems within the project area have been reported by neighborhood residents and are documented in formal responses to City questionnaires and service requests. The purpose of this project is to reduce flooding, dissipate high velocity storm flows at outfalls, and reduce storm - induced erosion downstream of culverts. In addition, the project will stabilize and enhance the stream channel downstream of 1417 Scotland Avenue through laying back of the banks and the planting of deep rooted, native plants. Specifically describe measures taken to avoid or minimize the proposed impacts in designing project. Impacts to on -site jurisdictional waters of the U.S. have been reduced to the maximum extent practicable. Proper sediment and erosion control measures will be used to minimize disturbances to downstream waters. All work will be constructed in the dry in accordance with Water Quality Certification No. 3883 and 3885. Initial project designs called for extensive use of rip rap between Cherokee Road and Scotland Avenue. This would have resulted in an unacceptably high level of impact to jurisdictional waters. An in -depth existing conditions study was carried out to identify approaches to reduce impacts to jurisdictional waters. This study, in conjunction with detailed shear stress calculations, led to a significant reduction in the proposed impacts for this project. Rip rap aprons have now been limited to the areas immediately up and downstream of existing pipe systems. There are already currently serviceable rip rap aprons in these locations. Figure 3 (attached) shows the location of existing rip rap aprons. Existing rip rap aprons at pipe inlets and outlets will be refreshed as necessary. Wherever possible the length of new rip rap has been limited to the length of the existing rip rap and therefore new impacts to jurisdictional waters of the U.S. have been minimized. A new high flow bypass pipe will be installed between Scotland Drive and Colville Road (Plan Sheets 6.4 & 6.5, attached). This 7 foot by 6 foot reinforced concrete box culvert (RCBC) will carry high water flows (in excess of bankfull flow) from Perennial Stream A and will tie into the existing culvert just upstream of Colville Road. Bankfull stream flow will continue to be routed through the existing pipe and open channel sections between Scotland Avenue and Colville Road. The existing pipes and open stream channel between Scotland Avenue and Colville Road will remain in -situ with the exception of the short open channel section immediately upstream of Colville Road. This section will be piped for safety reasons and to accommodate the tie -in of the new proposed high flow bypass pipe. The use of a high water flow bypass pipe avoids impacting the approximately 122 linear foot open channel section at 1301 Scotland Avenue. If a bypass pipe were not used the approximately 122 linear foot open channel section would have been impacted by rip rap. The proposed pipe extension at 1417 and 1425 Scotland Avenue is necessary to protect the foundation of the house at 1425 Scotland Avenue, which is currently being threatened by the stream (Plan Sheets 6.2 & 6.3, attached). Due to the potential legal liability associated with conducting storm water improvements in such close proximity to the foundations of the property no suitable alternative could be found to extending the pipe. An additional 34 lineer feet of culvert extension were added to the project due to safety concerns expressed by the home owner at 1425 Scotland Avenue. Furthermore, the project includes 257 linear feet of stream enhancement (Plan Sheets 6.1 and 6.2, attached). This enhancement work will stabilize currently eroding stream channel and will result in a reduction in sediment input to the stream and a net improvement in stream quality. This approach addresses the erosion issues in this portion of the channel, while avoiding hard stabilization such as rip rap which would have resulted in stream impacts.. 1 b. What data sources did you use to determine whether your site would impact historic or archeological resources? The project is located within the historic Eastover neighborhood. CWS consulted the Charlotte Mecklenburg Historic Landmarks Commission database and found a number of listed properties within and on the periphery of the project area. Since the purpose of this project is to improve drainage and protect properties within the project area. This project will have no negative impacts on any historic properties within the project area. Furthermore the proposed drainage improvements do not occur close to any listed properties. A letter was forwarded to the State Historic Preservation Office (SHPO) on November 15, 2010 to determine the presence of any areas of architectural, historic, or archaeological significance that would be affected by the project. In a response letter dated November 24, 2010 (attached), the SHPO stated "According to our records Archaeological Site 31 MK259 is either located in or immediately adjacent to your proposed project area. We therefore recommend that this site be relocated and archaeologically tested to determine its National Register of Historic Places eligibility prior to any earth moving activities ". The SHPO also stated that "Work confined to the existing public rights -of -way will not adversely affect the historic properties, but further review will be necessary if any work is proposed outside of the existing public rights -of -way ". In a letter dated February 8, 2011, CWS provided SHPO with additional information regarding the project, including detailed maps showing the location of proposed soil disturbing activities and detailed construction plans for the project. These drawings and plans show that the area of the proposed drainage improvement activities is confined to a very small portion of the original project study area. Furthermore, a large majority of the proposed improvements are located in public roadway rights -of -way. In a second response letter dated February 25, 2011, the SHPO stated that, "Based on the information contained in your recent letter regarding the scope of the project and the previous ground disturbing activities in the project area, we are withdrawing our (North Carolina Office of State Archaeology) request that a comprehensive archaeological survey be conducted at the above noted project locale. Although previously recorded prehistoric archaeological site 31 MK259 is situated within the corridor, given the amount and scope of previous earth moving activity associated with residential home construction in and around the project area the likelihood that significant, intact archaeological resources are present is nil." The letter also stated that, "Based upon the additional information supplied, the proposed project will have no adverse effect upon historic properties! 8. There is no hurry and she said this may be something you can discuss at next week's IRT meeting. There is a property owner on the Cherokee - Scotland SDIP who wants to coordinate with us to install additional pipe at the end of the pipe that we are replacing as part of the project. Since the new pipe isn't necessary to meet the goals of our project and doesn't have good purpose and need, Amanda said they would have to permit the impact on their own and mitigate for the 34 LF of additional impacts. EEP has agreed to provide the mitigation out of HUC. Amanda prefers that the mitigation stay in Charlotte so wants to see if we can get creative and figure out some way for the property owner to mitigate through our bank. Some possible scenarios: 1. Property owner pays our mitigation bank. Drawback: this isn't allowed under current MBI. 2. Property owner pays EEP. Drawback: mitigation leaves Charlotte. 3. Amanda adds impact to our upcoming permit application. Drawback: this sets a bad precedent and causes the entire project to exceed the 150 LF mitigation threshold (we are at about 140 LF now). 4.
