Project Description 1a. Provide a detailed description of the proposed activity including its purpose: The property is an existing 1.25 acre commercial lot platted in the late 1980's. Of the 1.25 acres, only 0.5 acres is located outside of the 50 -ft Neuse River Buffer. The applicant intends to build a 3 -story office building and associated parking lot and required stormwater management facility. A 3 -story office building is proposed to minimize impacts to the buffer. The purpose is to develop the lot for its intended purpose. 1b. Provide a description of how diffuse flow will be maintained through the protected riparian buffers (e.g., re -planting vegetation or enhancement of existing vegetation, gutter splash pads, level spreader to control of runoff from impervious surfaces, etc.). The property is currently undeveloped, mostly wooded, with no impervious surfaces. The project proposes to use a bioretention area to treat all new impervious surfaces. A diffuse flow plan is not provided as the bioretention area will directly discharge to the stream, after treatment. 1a. Show the location of diffuse flow measure(s) on your site plan. 1b. Attach a completed Level Spreader Supplement Form or BMP Supplement Form with all required items for each proposed measure. 1c. Attach an Operation and Maintenance (O&M) Form for each proposed level spreader or BMP. 2. For Major, Catawba, and Goose Creek variance requests, provide a description of all best management practices (BMPs) that will be used to minimize disturbance and control the discharge of nutrients and sediments from stormwater. See attached "Preliminary Stormwater Management Plan". The project will utilize a bioretention area designed to the current NC DEQ BMP Manual. The project will obtain a stormwater management plan (SMP) approval from the Town of Cary (a DWR certified local government) that will include this device. A copy of this approved SMP will be provided to DWR prior to impacts. 2a. Show the location of BMPs on your site plan. 2b. Attach a Supplement Form for each structural BMP proposed. 2c. Attach an Operation and Maintenance (O&M) Form for each structural BMP proposed. E. Demonstration of Need for a Variance The variance provision of the riparian buffer rules allows the Division or the Environmental Management Commission to grant a variance when there are practical difficulties or unnecessary hardships that prevent compliance with the strict letter of riparian buffer protection. 1. Explain how complying with the provisions of the applicable rule would prevent you from securing a reasonable return from or make reasonable use of your property. Merely proving that the variance would permit a greater profit from the property shall not be considered adequate justification for a variance. The Division will consider whether the variance is the minimum possible deviation from the terms of the applicable Buffer Rule that shall make reasonable use of the property possible. The property was platted in the late 1980's. If developed at the time the property was platted, the entire 1.25 acres could have been developed. The 50 -foot Neuse River Buffers remove more than 60% of the property from development leaving only 0.5 acres. This 0.5 acres is insufficient to room to construct an office building with associated parking and stormwater management devices. The applicant has proposed a 3 -story office building, rather than a 1 or 2 story building, to minimize impacts to the buffers. 2. Explain how the hardship results from application of the Buffer Rule to the property rather from other factors such as deed restrictions or other hardships (e.g. zoning setbacks, floodplains, etc). The applicant has obtained agreement from the Town of Cary to minimize the building setback from Laura Duncan Road, which allowed for additional minimization of buffer impacts. The applicant was also able to only require a single access drive to the property and avoided the need for a second access drive onto Center Pointe Drive. This avoided the need to cross the stream and buffer and what would have been additional buffer impacts. As such, the entire south side of the stream will be left undisturbed, to include the buffer and an additional small portion of land between the buffer and Center Pointe Drive. FORM: VAR 10-2013 Page 5 of 6 3. Explain how the hardship results from physical nature of the property, such as its size, shape, or topography, which is different from that of neighboring property. The property is bisected by a iurisdictional stream (with a 50 -foot riparian buffer) which flows in a generally westward direction. Site elevations range from roughly 402.00 feet to 422.00 feet. Existing site topography, and the existing stream and buffers, significantly reduce the buildable acreage on the property. Available survey data indicates that roughly 0.50 acres of the property is located outside of the 50 foot buffer. This means that roughly 60 percent of the property would be otherwise undevelopable without impacts to the buffer. 4. Explain whether the hardship was caused by the applicant knowingly or unknowingly violating the applicable Buffer Rule. No violation of the applicable Buffer Rule has occurred. 5. For Neuse, Tar -Pamlico, Jordan Lake and Goose Creek only: Did the applicant purchase the property after the effective date of the applicable Buffer Rule and then request a variance? Yes. The property was purchased by R.L. Properties, LLC on 01/17/2006. However, the proposed use of the property is consistent with its original intended use and the surrounding developments, and the resulting hardship to fulfill this use remains the same regardless of ownership. 6. Explain how the hardship is rare or unique to the applicant's property, rather than the result of conditions that are widespread. There are few undeveloped commercial lots in this area platted back in the late 198O's as this lot was, and it's even more rare to have one with over 60% of the lot now taken over by riparian buffers that did not exist at the time the lot was platted. As such, we believe this is an unfortunately unique situation to this property and a widespread condition. F. See figures 1, 2 and 3. The 1.75 acre property (PIN 0753222792) is currently owned by RL Properties, LLC of Angier, NC. The property is bisected by a jurisdictional stream (with a 50 -foot riparian buffer) which flows in a generally westward direction. Site elevations range from roughly 402.00 feet to 422.00 feet. Existing site topography, and the existing stream and buffers, significantly reduce the buildable acreage on the property. Available survey data indicates that roughly 0.50 acres of the property is located outside of the 50 foot buffer. This means that roughly 60 percent of the property would be otherwise undevelopable without impacts to the buffer. A preliminary site development plan provided by the owner calls for the construction of a three-story commercial building and associated parking areas near the northern property corner. The proposed Preliminary Stormwater Management Plan (SMP) described in further detail below provides for the construction of a bioretention area to provide stormwater treatment for the developed portion of the property. Portions of both Zone 1 and Zone 2 of the riparian buffer will be impacted by site construction including the proposed bioretention area. Details of the proposed impacts are provided in the Construction Drawings in Appendix B. Preliminary Stormwater Management Plan We utilized guidance from the current version of the NCDEQ Stormwater Best Management Practices Manual (dated 07-24-2009) for the design of the proposed bioretention area retrofit. This Preliminary Stormwater Management Plan (Plan) describes the proposed preliminary site development plan, the location and general configuration of the proposed stormwater bioretention area, as well as the various components of the device. As part of our preliminary design effort an N.C. Licensed Soil Scientist performed a site visit to evaluated existing soils and to determine the depth to the seasonal high water within the vicinity of the proposed bioretention area. Site observations and boring profile data indicate that site soils will not support required infiltration from the bioretention invert and as such an under -drain is required. Site data also indicated that sufficient separation from the SNWT to the invert of the proposed device could be achieved. The bioretention area was sized using a runoff volume from the 1 -inch design rainfall for the developed portion of the site including approximately 15,700 square feet (0.36 acres) of impervious surface (including building rooftop, parking clot, sidewalk, and retaining walls). A runoff volume of approximately 1,300 cubic feet was estimated based on drainage area land -use characteristics. With a desired ponding depth of 9 - inches a bioretention surface area of approximately 1,750 square feet is necessary. Based on the preliminary site development plan, existing site topography, and the existing elevations within the vicinity of the proposed stormwater device the downslope perimeter of the bioretention area may be constructed with a low -height earthen berm or structural retaining wall. The final configuration will be determined during final design. Our preliminary design proposes a bioretention media thickness of 3 -feet with tree, shrub and herbaceous species plantings. Media depth may be reduced to 2 -feet if final design efforts (or other development conditions) indicate that a grass -lined device is desired for use. Our design also calls for the use of a small pre -cast reinforced concrete box riser with its crest elevation set to allow for the desired ponding depth (9 -inches above the bioretention surface). The preliminary sizing of the proposed riser/barrel spillway system accommodates design discharges during larger storm events (up to the 10 -year storm). As noted previously an under -drain system, connected to the riser structure, will be utilized to allow for the drainage of treated stormwater from the bioretention area within the desired time period. The riser will outlet to a high-density polyethylene (HDPE) barrel (smooth interior, corrugated exterior) or reinforced concrete pipe (RCP) which will pass through the downslope perimeter berm (or retaining wall). The length of the barrel, the outlet location and elevation, and outlet protection requirement (to reduce outlet velocities and reduce the potential for localized erosion) will be determined during final design. The riser/barrel system may be enlarged to accommodate a larger design storm event depending on local authority requirements or an overflow within the perimeter berm (or retaining wall) may be incorporated into the final design. A minimum of one tree species, three shrub species and three herbaceous species will be planted within the bioretention area. Possible planting species are shown in the planting plan provided in Construction drawings. The final number and location of plantings will be based on plant density recommendations provided in the BMP Manual, the final configuration of the device, and preferences of landscape designer. Species substitutions may be made depending on plant material availability and with prior the approval of the Engineer_ NOTE: This stormwoterm anagement plan design is preliminary. Further design effort for the property's development including, but not limited to, site layout and design, final stormwater collection and connection with the proposed bioretention area, component sizing and materials selection, stormwater volume control and peak discharge attenuation, utilities design, geotechnical and structural design, and temporary sedimentation and erasion control design may or will be necessary. The site development plan and configuration of the bioretention area and its various components may change during final design however the location and extent (acreage) of buffer disturbance will be adhered to. Supporting stormwater design calculations are provided in Appendix A. Further details regarding the design are provided on the preliminary Construction Drawing provided in Appendix R. A draft Operation & Maintenance Agreement is provided in Appendix C. Limitations Our analyses, evaluations, conclusions, and recommendations are based on project and site information available to us at the time of this report and may require modification if there are any changes in the project or site conditions, or if additional data about the project or site becomes available in the future. This report is intended for use by our client, RL Properties, LLC and the North Carolina Department of Environmental Quality (NCREQ) on this project. These findings are not intended or recommended to be suitable for reuse on extensions of the project or on any other project. Properties, LLC, please find below and attached the additional information you requested in your letter dated January 28, 2016. 1. Confirm the correct spelling of Mr. Langdon's last name. The application lists Langden, but the agent authorization form lists Langdon. The correct spelling of the applicant/owner's name is Devaul Dess Langdon. (This was mistakenly spelled "Langden" with an "e" on the application.) We apologize for this error. 2. Provide the number ofparking spaces required by the Town of Cary and the number ofparking spaces proposed for the project. Table 7.8-1 of Section 7.8.2 of the Town of Cary Land Development Ordinance requires that for Office, Business or Professional space 1 parking space is required for each 300 SF of office space. Our building consists of 3 stories, each 3,500 SF, for a total of 10,500 SF. 10,500 SF / 300 SF per space = 35 parking spaces. Per Table 7.8-4 of the LDO the Town also requires 2 handicapped spaces for parking areas consisting of 26-50 spaces total. The Town does allow handicapped parking to count towards the fulfillment of parking requirements. Our plan proposes a total of 35 parking spaces, the minimum required by the Town. 3. This office believes the impacts to Zone I of the buffer could be minimized by realigning the dumpster at angle in the corner of the parking lot. Please revise the plan accordingly or explain why this realignment is not possible. During the preparation of our original design submittal we attempted to limit the buffer impacts including possible realignments of the dumpster pad but were unable to develop a solution that kept the dumpster (and parking) out of Zone 1 while at the same time meeting the parking requirements of the Town of Cary. Per DWR's request we have reconsidered this option and are still unable to find an alternative solution. See the attached figure. As you can see while it is possible to realign (angle) the dumpster pad and move it out of Zone 1, in doing so we lose parking spaces required by the Town. It must be remembered that the garbage truck will be required to back into the property from Laura Duncan Road and then turn to align itself with the dumpster. This new alignment and location requires the removal of parking spaces taking us down to 32 parking spaces. If additional spaces are added back in in the location where the dumpster pad had been located in the original site plan then these new spaces would result in more impacts in Zone 1 than the dumpster pad. Even with this change we are still short of the required 35 parking spaces. 4. Please explain how spills from the dumpster will be prevented from migrating into the riparian buffer. The proposed development is for an office building, so the likelihood of spills of any significance (such as grease, oils, or hazardous materials) from the dumpster is very low. That said the dumpster pad (as well as the entire parking lot area) are to be surrounded by curb and gutter. While not shown specifically on the plans the intent is to slope the parking lot such that it drains to a low point close to the proposed stormwater device to reduce the required length of stormwater pipe. As such any spills (or trash/debris for that matter) that did come from the dumpster would be directed towards the stormwater device and not the riparian buffer. 5. You have indicated that you are making a payment to a local mitigation bank or in -lieu fee program as your mitigation plan, please provide documentation from an appropriate mitigation bank or the Division of Mitigation Services indicating their willingness to accept your request to purchase buffer credit to mitigate for the proposed buffer impacts listed in your application.
