Preconstruction Notification (PCN) Form for the above mentioned project as application for
Nationwide Permit 29 as well as 401 Certification and Riparian Buffer Authorization. These
permits are required for the proposed residential development located at 0 Beau View Rd
(Vineyards at Tuscan Ridge Subdivision) Wendell, NC.
PROJECT BACKGOUND
W & T Development, LLC proposes to build a residential subdivision on the properties located
at and near 0 Beau View Rd, Wendell, NC including all requires roads, utilities, sewer system,
parking, greenway and stormwater BMPs. The site is currently in Phase 2 of development with
part of the utilities, roads and BMPs installed and part of the site is forested. This application for
permits is required to move forward with Phase 3 of the subdivision.

PROPOSED IMPACTS
The original wetland delineation was completed by Soil Services, PLLC on March 31, 2016. The
USACE concurred with the delineation maps emailed on May 10, 2016 (Appendix II). Soil
Services, PLLC delineated the streams on-site and were verified by the Division of Water
Recourses on April 26, 2016 (Appendix IX). Plans for this site will impact I wetland areas and 3
streams & buffer areas (Appendix V).
The site plan has been designed to minimize impacts to Waters of the US. This was done by
avoiding all unnecessary impacts to the waters accept where it was unavoidable such as routing
roads in upland areas where at all possible. The proposed impacts were necessary to provide
access and linear transportation to the proposed subdivision. Wake County Planning Department
required a thoroughfare to be constructed connecting the Vineyards at Tuscan Ridge subdivision
to the adjacent southern subdivision (Appendix XI).

The above -referenced stormwater management plan has been reviewed and conditionally
approved.
Further Conditional Stormwater Approval Conditions are:
1. Add following note to Recorded plat: Maximum Impervious Area Square
Footage on each Individual Lot will be Stringently Enforced with no
Exceptions into Perpetuity. Plan Approved limiting the Impervious Surface to
6,212 square feet per lot.
In addition you are to make a Nitrogen Offset Payment of $ (see above) in a check
made payable to the "North Carolina Ecosystem Enhancement Program" (NC EEP), sent
to the attention of Mr. David Robinson with the N.C. Ecosystem Enhancement Program:
1619 Mail Service Center, Raleigh, North Carolina 27699-1652. As an option, you may
hand deliver it to 2728 Capital Blvd., Suite 1H 103, Raleigh, NC 27604. Mr. Robinson
can be reached at 919-715-0476. A payment Receipt letter from the NCEEP is required
prior to the release of the Stormwater Permit. Finally, there is an outstanding
Stormwater Permit Fee to be paid to Wake County. Please submit this payment in a
check made out to Wake County at the Environmental Services Waverly F. Akins Wake
county Office Building located on the 1" floor of the building off of the Fayetteville Mall
entrance prior to the release of your Land Disturbing Permit. Your memo should
reference your Stormwater Permit #.

This request for Wake County to evaluate a stormwater management plan does not
relieve the applicant from their responsibility to meet all applicable State and Federal
Laws, including, but not limited to necessary approvals from Federal Emergency
Management Area Flood regulations/requirements, Division of Water Quality stormwater
or other water quality regulations/requirements, U.S. Army Corps of Engineers Article
404/401 (Wetlands/Streams) jurisdiction/requirements, and/or any Federal, State, County
and Local municipal regulations or permit requirements. The approval issued in this letter
cannot supersede any other required permit or approval. Once your fees to the N.C.
Ecosystem Enhancement Program have been paid and documented, your Land

Birds are protected by the Migratory Bird Treaty Act and the Bald and Golden Eagle
Protection Act.

Wetlands
Wetlands in the National Wetlands Inventory
Impacts to NWI wetlands and other aquatic habitats may be subject to regulation under
Section 404 of the Clean Water Act, or other State/Federal statutes.
For more information please contact the Regulatory Program of the local U.S. Army
Corns of Engineers District.
DATA LIMITATIONS
The Service's objective of mapping wetlands and deepwater habitats is to produce reconnaissance level information
on the location, type and size of these resources. The maps are prepared from the analysis of high altitude imagery.
Wetlands are identified based on vegetation, visible hydrology and geography. A margin of error is inherent in the use
of imagery; thus, detailed on -the -ground inspection of any particular site may result in revision of the wetland
boundaries or classification established through image analysis.
The accuracy of image interpretation depends on the quality of the imagery, the experience of the image analysts,
the amount and quality of the collateral data and the amount of ground truth verification work conducted. Metadata
should be consulted to determine the date of the source imagery used and any mapping problems.
Wetlands or other mapped features may have changed since the date of the imagery or field work. There may be
occasional differences in polygon boundaries or classifications between the information depicted on the map and the
actual conditions on site.
DATA EXCLUSIONS
Certain wetland habitats are excluded from the National mapping program because of the limitations of aerial
imagery as the primary data source used to detect wetlands. These habitats include seagrasses or submerged
aquatic vegetation that are found in the intertidal and subtidal zones of estuaries and nearshore coastal waters.
Some deepwater reef communities (coral or tuberficid worm reefs) have also been excluded from the inventory.
These habitats, because of their depth, go undetected by aerial imagery.
DATA PRECAUTIONS
Federal, state, and local regulatory agencies with jurisdiction over wetlands may define and describe wetlands in a
different manner than that used in this inventory. There is no attempt, in either the design or products of this
inventory, to define the limits of proprietaryjurisdiction of any Federal, state, or local government or to establish the
geographical scope of the regulatory programs of government agencies. Persons intending to engage in activities
involving modifications within or adjacent to wetland areas should seek the advice of appropriate federal, state, or
local agencies concerning specified agency regulatory programs and proprietary jurisdictions that may affect such
activities.

connection to the stub road to the south (Cortona Way) is required per the

Subject: Vineyards at Tuscan Ridge - Phase 3
Celena,
It is my understanding that Wake County is requiring the Vineyards at
Tuscan Ridge subdivision to make a road connection to the existing road
stub out at the south western comer of Vineyards Tuscan Ridge. Also, that
Wake County will not allow any further development of the Vineyards at
Tuscan Ridge without this road connection being constructed. Could you
please respond verifying this information?
