Dear Mr. Reed:
PS Energy Group, Inc. (PS Energy) is providing this written response in reference to the Notice of
Violation (NOV-2019-PC-0779) letter we received, dated December 20, 2019. The NOV references
PS Energy's Skyview Energy facility located at 416 Old Ranger Road in Murphy, Cherokee
County, North Carolina.
It is PS Energy's understanding that the NOV notice was sent to PS Energy due to lack of
certificate of coverage under a National Pollutant Discharge Elimination System (NPDES) General
Permit, for stormwater discharges from the Skyview Energy site.
PS Energy understands that an inspection was conducted on December 18, 2019 by the Asheville
Regional Office of the Division of Energy, Mineral and Land Resources (DEMLR), at the Skyview
Energy facility located at 416 Old Ranger Road in Murphy, Cherokee County, North Carolina.
Information derived from the site inspection and a follow-up review of DEMLR files revealed that
the Skyview Energy facility did not apply for, nor receive coverage under, an NPDES General
Permit No. NCG080000 to allow stormwater discharges from the facility. The Skyview Energy
facility currently discharges stormwater affected by site operations to receiving waters designated
as an unnamed tributary of the Hiwassee River, a Class C waterbody in the Hiwassee River Basin.
From the conditions and requirements spelled out in the NOV letter, it is PS Energy's belief that this
response to the DEMLR falls within the required 30 calendar days of receipt of the NOV notice
response timeframe defined in the notice. Therefore, by submitting this response within the
required 30 days, PS Energy has taken the first step toward bringing the Skyview Energy facility
into compliance with stormwater discharge permitting requirements in accordance with G.S. 143-
215.1(a) and 15A NCAC 2H .0126.
To achieve full compliance with these requirements PS Energy plans to prepare and submit, by
February 7t", 2020, a notice of Intent (NOI) application to obtain a certificate of coverage under the
NPDES General Permit NCG080000. PS Energy will submit the NOI application to the Asheville
Region of the North Carolina Department of Environmental Quality (NCDEQ).
PS Energy will prepare the NOI application utilizing necessary site specific information on Skyview
Energy's facility activities, stormwater discharge location and receiving water information, best
management practices and stormwater controls, hazardous waste storage and disposal, as well as
other site related information as needed.
The NOI application, for the Skyview Energy facility, will be prepared in accordance with federal
EPA and state NCDEQ regulatory permitting requirements pertaining to storm water rules and
guidance.
