We wish to thank Mr. Robert Joyce for being present and assisting us during this inspection. You are hereby notified that, having been permitted to have a non -discharge permit for the subject animal waste management system pursuant to 15A NCAC 2T .1304, you have been found to be in violation of your Certified Animal Waste Management Plan (CAWMP) and the Swine Waste System General Permit No. AWG100000 as follows: VioR nlu®n 10 Failure in inspecting and documenting, waste collection, treatment and storage structure and runoff control measures, at a frequency to insure proper operation but at least monthly and after all storm events of greater than one (1) inch in 24 hours in accordance with Condition IIl. 1, of the Swine Waste System Individual Permit No. AWI160001. During compliance inspection, permittee did not have any one (1) inch rainfall lagoon inspections documentation available. During compliance inspection, permittee did not have freeboard records for lagoon available. Required Corrective Action for Violations: Option 1: Apply for renewal of the Swine Animal Waste Operation State Non -Discharge Individual Permit "Zero Animal Permit' No. AWI160001. All required documentation and requirements stated in the permit must be up to date. Option 2: Close out the Lagoon associated with this permit to meet all NRCS specifications and criteria and in accordance with Swine Animal Waste Operation State Non -Discharge Individual Permit No. AWI160001 Section V.3. You may wish to contact your County Soil & Water Conservation District Office, County Extension office, a qualified technical specialist, and/or a professional engineer for any assistance they may be able to provide. Failure to comply with the required corrective actions specified in this Notice may result in an additional Notice of Violation with the recommendation for enforcement action including the Assessment of Civil Penalties.
