PO Box 1225 Cary, NC 27513 Subject Property: Lot 37 Evans Estates Subdivision UT to Crabtree Creek [030402, 27-33-(1), C, NSW] REQUEST FOR MORE INFORMATION Dear Mr. Bailey: DWQ Project # OS-2015v.3 Wake County On October 19, 2006, the Division of Water Quality (DWQ) received your Pre-Construction Notification application dated August 22, 2006, with additional information and your Minor Variance application received on January 19, 2007 by DWQ, to impact 46 square feet of Zone 2 Neuse River basin protected riparian buffer for the proposed house at the above referenced site. The DWQ has determined that your minor variance application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The Operation and Maintenance agreement that you provided for your proposed rain barrels and level spreaders was not signed. Please complete and return the attached O&M agreement. Please respond within three weeks of the date of this letter by sending this information to me in writing and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Maintenance activities shall be performed as follows: 1. The rain barrel(s) shall be inspected at least every month and more frequently during the fall season and after heavy rainfall events: a. Accumulated sediment, leaves, and trash shall be removed if required. b. Inspect barrel drain orifice to remove any blockage. Barrel(s) should be empty 24 hrs after fmal rain fall. c. Inspect the gravel pad and remove any debris and keep level. d. Repair any eroded areas leading from the landscape timbers. Replace or repair and reseed area as needed. 2. Inspect and repair the collection system (gutters, downspouts, etc.) four (4) times a year to maintain proper functioning. LEVEL SPREADER: The level spreader is defined as an elongated, level threshold, designed to diffuse stormwater runoff. Maintenance activities shall be performed as follows: 1. After construction and until vegetation has been established, level spreader(s) shall be inspected after every rainfall. Thereafter, level spreader(s) shall be inspected at least every month and more frequently during the fall season and after heavy rainfall events: a. Accumulated sediment, leaves, and trash shall be removed, and repairs made if- required. b. Inspect level spreader(s) for evidence of scour, undercutting, settlement of the structure, and concentrated flows downhill from the level spreader(s). c. A level elevation shall be maintained across the entire flow-spreading structure at all times. Repair or replace the level spreader if it is damaged. d. Mow vegetative cover to a height of six (6) inches and prune plants if they cover over half of the level spreader surface. e. Repair eroded areas and replace/replant dead or damaged vegetation. 2. The contractor should avoid the placement of any material on and prevent construction traffic across the structure. If the measure is damaged by construction traffic, it shall be repaired immediately. 3. Inspect and repair the collection system (e.g., catch basins,. pipes, swales, riprap) four (4) times a year to maintain proper functioning. UNDERGROUND INFILTRATION WELL: The dry well is defined as a short, deep, rock-filled trench with no outlet that receives stormwater runoff. Runoff is stored in the void space between the stones and infiltrates through the bottom and into the soils. Maintenance' activities shall be performed as follows: 1. After every runoff-producing event and at least monthly inspect the bypass/overflow structure for blockage and deterioration and the infiltration system for erosion, grass cover, and general condition. 2. Repair eroded areas immediately, reseed as necessary to maintain adequate vegetative cover, mow vegetative cover to maintain a maximum height of 6 inches, and remove trash and blockages as needed to maintain system performance. 3. If the dry well does not drain or if unusual ponding is noted (over a three month period) then a possible failure of the dry well shall be reported to the Town of Chapel Hill immediately. 4. If the Town of Chapel Hill determines that the system is failing, the system will immediately be repaired or replaced to original design specifications with the addition of a monitoring well. If the system cannot be repaired to perform its design function, other stormwater control devices as allowed by the Town of Chapel Hill must be designed, approved and constructed. 5. If repair or replacement is required the system shall be restored to the original depth without over-excavating. Over-excavating may cause the required water table separation to be reduced and may compromise the ability of the system to perform as designed. Removed sediment shall be disposed of in an appropriate manner and shall not be handled in a manner that will adversely impact water quality (i.e. stockpiling neat a stormwater treatment device or stream, etc.). A benchmark shall be established in the infiltration system. The benchmark will document the original design depth so that accurate sediment accumulation readings can be taken. The measuring device used to determine the depth at the benchmark shall be such that it will give an accurate depth reading and not readily penetrate into accumulated sediments.
