Dear Mr. Bailey:
On October 19, 2006, the Division of Water Quality (DWQ) received your Pre-Construction Notification
application dated August 22, 2006, to impact 46 square feet of Zone 2 Neuse River basin protected
riparian buffer, for the proposed house at the above referenced site. The DWQ has determined that your
application was incomplete and/or provided inaccurate information as discussed below. The DWQ will
require additional information in order to process your application to impact protected wetlands and/or
streams on the subject property. Therefore, unless we receive the additional information requested below,
we will have to move toward denial of your application as required by 15A NCAC 2H .0506 and will
place this project on hold as incomplete until we receive this additional information. Please provide the
following information so that we may continue to review your project.
Additional Information Requested:
1. There is an outstanding Notice of Violation (NOV) for this site. The DWQ Raleigh Regional
Office issued an NOV on March 20, 2006. This NOV must be resolved before we can process
your application for this site. Please contact Mike Horan at the DWQ Raleigh Regional Office to
resolve this NOV. Once this NOV has been resolved to the satisfaction of the DWQ Raleigh
Regional Office, please forward the specifics of the resolution to the DWQ Central Office.
2. For the construction of the house in Zone 2 of the protected riparian buffers, you must submit the
application information on a Minor Variance application form. Please submit two copies of the
completed Minor Variance application form.
3. Diffuse Flow
Please indicate the diffuse flow provision measures on the site plan. Be sure to include applicable
Operation and Maintenance agreements and worksheets for the diffuse flow provision.
