Based on this review additional information will be needed before a determination can be made on the 401 Water Quality Certification, the following is a list of items needed: StorrnwatPr. A formal stormwater plan should be submitted for approval. Please refer to the. atta7 hed document "STORMWATER BEST MANAGEMENT PRACTICES" for stormwater plan requirements. Mitigation. The Division of Water Quality requires mitigation for stream losses exceeding 150 feet. Because your project exceeds this criteria you are required to submit a formal mitigation plan for approval. Mitigation means that you will need to replace the loss of stream due to the piping you instalied in the unnamed tributary to the Catawba River. You can accomplish the mitigation by finding a section of degraded stream equal to the length of stream piped and repairing that stream into a stable properly functioning water body or you may be able to pay into the N. G. Wetlands Restoration Program at $125.00/foot. Please refer to the attached document "Internal Technical Guide for Stream Work in North Carolina" for mitigation plan requirements. Applications with comments: 010869 (DOT, Avery County) - the project is in WS-IV Tr. The culvert is a part of a public road crossing and therefore allowed, but DOT must show no practicable alternative, as well as, show that they have minimized BUA, diverted stormwater away from surface waters, and will use their BMPs guidelines document. DOT must also comply with the local WSWP ordinance - this is something new-ish, DOT must comply with the ord. but the local government does not have enforcement authority (that is vested solely in the EMC). 010882 (Michael Horton, Chatham Co.) - Brooks Creek is WS-IV. A private road is not allowed in the buffer, even if it is turned over to DOT later on. Horton should either redesign and/or investigate the local variance process. The local contact for Pittsboro is Mr. Hugh Montgomery. 010895 (Jimmy Loftis, McDowell Co.) - in the materials that were submitted to me there was contradictory information on the location of the project and no topo map included. ACtigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation maybe required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland .and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation'plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical. ACtigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may *be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed.
