Director Division of Water Quality February 19, 2007 DWQ Project # OS-2015v2 Wake County Page 1 of 2 CERTIFIED MAIL: RETURN RECEIPT REQUESTED Mr. Robert Longo 402 Telia Point Cary, NC 27513 Subject Property: Lot 35 Evans Estates Subdivision UT to Crabtree Creek [30402, 27-33-(1), C, NSW, 303d] REQUEST FOR MORE INFORMATION Dear Mr. Longo: On October 17, 2006, the Division of Water Quality (DWQ) received your application for a Major Variance dated October 9, 2006 with additional information received on January 19, 2007 to impact 102 square feet of Zone 1 of the protected riparian buffer and 1,088 square feet of Zone 2 of the protected riparian buffer for the already constructed portion of the house and driveway and to construct the proposed staircase, deck and sunroom/patio at the above referenced site. The DWQ has determined that your application was incomplete and/or provided inaccurate information as discussed below. The DWQ will require additional information in order to process your application to impact protected wetlands and/or streams on the subject property. Therefore, unless we receive the additional information requested below, we will have to move toward denial of your application as required by 1 SA NCAC 2H .0506 and will place this project on hold as incomplete until we receive this additional information. Please provide the following information so that we may continue to review your project. Additional Information Requested: 1. The Operation and Maintenance agreement that you provided for your proposed rain barrels was not signed. Please complete and return the attached O&M agreement. 2. Please reconfigure your plans to avoid the impacts to Zone 1 of the buffers for the proposed deck and staircase and to avoid or minimize the impacts to Zone 2 of the buffers for the proposed sunroom. Please respond within three weeks of the date of this letter by sending this information to me in writing and Mike Horan of the DWQ Raleigh Regional Office. If we do not hear from you within three weeks, we will assume that you no longer want to pursue this project and we will consider the project as withdrawn. This letter only addresses the application review and does not authorize any impacts to wetlands, waters or protected buffers. Maintenance activities shall be performed as follows: 1. The rain barrel(s) shall be inspected at least every month and more frequently during the fall season and after heavy rainfall events: a. Accumulated sediment, leaves, and trash shall be removed if required. b. Inspect barrel drain orifice to remove any blockage. Barrel(s) should be empty 24 hrs after final rain fall. c. Inspect the gravel pad and remove any debris and keep level. d. Repair any eroded areas leading from the landscape timbers. Replace or repair and reseed area as needed. 2. Inspect and repair the collection system (gutters, downspouts, etc.) four (4) times a year to maintain proper functioning. I acknowledge and agree by my signature below that I am responsible for the performance of the maintenance procedures listed above. I agree to notify Wake County DWQ of any problems with the system or prior to any changes to the system or responsible party.
