Debit $570 from WBS 41499.1.1 Dear Madam: The North Carolina Department of Transportation (NCDOT) proposes to widen 5.3 miles of the US 701 Bypass from south of SR 1166 (Pleasant Plains Road) to north of US 74/76 Bypass in Whiteville, Columbus County (R-5020). The purpose of this letter is to request approval for a Section 404 Individual Permit and Section 401 Water Quality Certification. In addition to this cover letter, this application package includes the following for R- 5020: ENG Form 4345, USFWS concurrence letter, stormwater management plan, final permit drawings for Section B, preliminary permit drawings for Section A, DMS acceptance letters for both sections, 4B and 4C merger meeting minutes. Purpose and Need The purpose of the proposed project is to increase the traffic carrying capacity and safety of US 701 Bypass within the project limits. Improvements to US 701 Bypass are needed to provide adequate capacity for future traffic volumes in the project study area. With no improvements, US 701 Bypass is projected to operate at level of service (LOS) E along the two-lane segments under future (2035) conditions. The proposed four -lane median divided facility would improve the overall mainline operations on US 701 Bypass in the project study area to LOS C with 2035 traffic volumes. Improvements to US 701 Bypass are also needed to provide increased safety on the roadway in the project study area. The current crash rates on US 701 Bypass exceed the statewide average and critical crash rates for similar facilities for every crash type analyzed, with the exception of the critical fatal crash rate. This project has been broken into two sections: Section A • US 701 Bypass from SR 1166 (Pleasant Plains Road) to SR 1437 (Virgil Avenue) (approximately 3.1 miles) Section B • US 701 Bypass from SR 1437 (Virgil Avenue) to US 74/76 Bypass (approximately 2.2 miles) Summary of Impacts Section A (Prelimina Proposed preliminary impacts to jurisdictional areas total 1,207 linear feet of permanent impact and <0.01 acre of temporary impacts to jurisdictional streams. There are a proposed 7.95 acres of permanent impact to riparian wetlands, with an additional 0.39 acre of hand clearing. A permit modification request will be submitted when final plans are completed. Section B (Final) Proposed impacts to jurisdictional areas total 55 linear feet of permanent impact and 31 linear feet of temporary impact to jurisdictional streams. There are a proposed 0.21 acre of permanent impact and 0.04 acre of temporary impact to riparian wetlands. Summary of Mitigation The NCDOT has avoided and minimized impacts to jurisdictional resources to the greatest extent possible. The Department has acquired the compensatory mitigation for these unavoidable impacts from the North Carolina Department of Environmental Quality (NCDEQ)-Division of Mitigation Services (DMS) for both the B section and the preliminary impacts presented for Section A. Project Schedule Currently, R-5020B is scheduled to Let July 21, 2020, however this project may be accelerated if funding becomes available. R-5020A is scheduled to Let on July 18, 2023. NEPA Document Status The Environmental Assessment (EA) was approved in June 2015. A Finding of No Significant Impact (FONSI) was completed in September 2016. These documents are available at https://xfer. services.ncdot.gov/pdea/EnvironmentalDocs/Documents/. NEPA Merger Process A project scoping meeting was held in August 2012 to begin early coordination between federal, state and local agency project stakeholders. The NEPA Merger Process started with Concurrence Point (CP) 2, held in March 2015. CPs 3 and 4A was held in July 2016. CPs 4B and 4C was held in December 2019. Resource Status The project is located in the Lumber River Basin and lies within Hydrologic Unit 03040206. Jurisdictional streams in the project area are rated as Class C;Sw, No streams impacted are listed in the Final 2018 303(d) report. This is within the coastal plain physiographic region. A jurisdictional wetland and stream verification was conducted on July 30, 2013 with Ronnie Smith (USACE) and Mason Herndon (NCDWR). Written verification for an isolated wetland near the intersection of the US 701 Bypass and NC 130 was received on October 9, 2013 (SAW-2012-00758). Impacts to Jurisdictional Resources Wetlands Wetland impacts occur in the Lumber River Basin in HUC 03040206. Wetland impacts for R-5020A/B total 8.16 acres. Tables 1 and 2 list the impacts to wetlands for this project. Impacts are based upon final design for R-5020B and preliminary impacts for R-5020A. Table 1. Protected Species As of April 15, 2019, the United State Fish and Wildlife Service (USFWS) lists seven (7) federally protected species for Columbus County (Table 7). Table 7. Concurrence was received on October 28, 2019 agreeing with NCDOT's biological conclusion (see attached). The USFWS has developed a Programmatic Biological Opinion (PBO) in conjunction with the Federal Highway Administration (FHWA), USACE and NCDOT for the Northern long-eared bat (NLEB) in eastern North Carolina. The PBO covers the entire NCDOT program in Divisions 1-8, including all NCDOT project and activities. The programmatic determination for NLEB for the NCDOT program is May Affect, Likely to Adversely Affect. The PBO provides incidental take coverage for NLEB and will ensure compliance with Section 7 of the Endangered Species Act for five years for all NCDOT projects with a federal nexus in Divisions 1 — 8, which includes Columbus County, where this project is located. All other species listed for Columbus County received biological conclusions of No Effect and did not require concurrence. An updated survey for Cooley's meadowrue is required for the project. As a stipulation of the informal concurrence with USFWS, the survey will be completed prior to the project construction Let. Bald and Golden Eagle Protection Act (BGPA) A desktop-GIS assessment of the project study area, as well as the area within a 1.13-mile radius (1.0 mile plus 660 feet) of the project limits, was performed on September 18, 2019. There were no waterbodies large enough and sufficiently open to be considered potential feeding source. A review of the NCNHP database updated October 2019 indicated no known occurrence of the bald eagle within five miles of the project. Moratoria There are no proposed in -water work moratoria for this project. Cultural Resources The proposed project involves widening the existing US 701 Bypass to the west in the vicinity of the Beth Israel/Whiteville Hebrew Center in order to minimize impacts to the historic property. A landscaping plan was developed to mitigate the minor encroachment to this property and a concurrence of "No Adverse Effect" was received from HPO on January 13, 2015. One other property, Williamson House, was determined to be an eligible historic property. Construction will not encroach upon this property and a concurrence of "No Effect" was rendered. FEMA Compliance The project has been coordinated with appropriate state and local officials and the Federal Emergency Management Agency (FEMA) to assure compliance with FEMA, state, and local floodway regulations. Indirect and Cumulative Effects R-5020 was reevaluated by the NCDOT Community Studies Group in September 2019 with regard to potential indirect and cumulative effects. Based on these evaluations, it was determined that the project will not alter travel patterns, reduce travel time, affect access to properties in the area, or open areas for development or redevelopment. Due to its minimal transportation impact -causing activities, this project will neither influence nearby land uses nor stimulate growth. Therefore, a detailed indirect and cumulative effects study will not be necessary. Wild and Scenic Rivers There have been no waterbodies within the study area that have been designated under the National Wild and Scenic Rivers Act of 1968. Mitigation Options The NCDOT is committed to incorporating all reasonable and practicable design features to avoid and minimize jurisdictional impacts, and to provide full compensatory mitigation of all remaining, unavoidable jurisdictional impacts. Avoidance measures were taken during planning and NEPA compliance stages; minimization measures were incorporated as part of the project design. Avoidance and Minimization All jurisdictional features were delineated, field verified and surveyed within the corridor for R-5020. Using these features, preliminary designs were adjusted to avoid and/or minimize impacts to jurisdictional areas. NCDOT employs many strategies to avoid and minimize impacts to jurisdictional areas in all of its designs. Many of these strategies have been incorporated into BMP documents that have been reviewed and approved by the resource agencies and which will be followed throughout construction. All wetland areas not affected by the project will be protected from unnecessary encroachment. Individual avoidance and minimization items are as follows: • The proposed curb and gutter was extended to avid impacts to a cemetery adjacent to the existing road, which also reduced impacts to wetlands in this area. • At Wetland Site WL (Soules Swamp), existing US 701 Bypass will be widened to the east, this will reduce wetland impacts by approximately 0.9 acre. • The use of 3:1 slopes in wetland areas to reduce wetland impacts. • The preferred alternative would bridge the man-made ditch (i.e., unnamed tributary to Soules Swamp) parallel to Main Street and the railroad tracks, thereby not impacting this tributary to Waters of the U.S. Compensation The NCDOT has avoided and minimized impacts to jurisdictional resources to the greatest extent possible as described above. The unavoidable permanent stream impacts of 1,262 linear feet and wetland impacts of 8.16 acre will be offset by compensatory mitigation provided by the North Carolina Department of Environmental Quality (NCDEQ)-Division of Mitigation Services (DMS). Acceptance letters from DMS are attached. Regulatory Approvals Section 404: Application is hereby made for a USACE Individual 404 Permit as required for the above - described activities. We note that although the biological conclusion for Cooley's meadowrue (Thatictrum cooleyi) is "no effect", NCDOT has committed to conducting another survey for the species during the appropriate survey window in 2020. Also, we note that the northern long-eared bat has been previously addressed in a programmatic biological opinion. We believe that the requirements of Section 7(a)(2) of the ESA have been satisfied. Annual Avg Daily Traffic (veh/hr/day): Design/Future: 26,900 Year: 2040 Existing: 21,650 Year: 2020 General Project Narrative: (Description of Minimization of Water Quality Impacts) The R-5020A project involves widening existing US-701 south of Whiteville, improving intersections, and replacing bridges along with other improvements to adjacent roadways, including replacing an undersized culvert under US-701 Business. Curb and gutter drainage has replaced existing roadway ditches. Rip rap dissipation has been incorporated at drainage pipe outlets and outfalls where applicable. Proposed cross pipes in jurisdictional streams will be buried. In areas adjacent to wetlands, 3:1 roadway fill slopes were used to reduce wetland impacts. There are two existing major structures crossing waterways within the project limits that will be replaced. The first proposed structure is a 3 span (1 @45', 1 @55', 1 @45') 36" girder bridge with 4' end bent caps over Soules Swamp. The proposed bridge will have spill -through abutments. In the area of the causeway and bridge, 1 Y of mechanized clearing will be provided to allow enough room for the conctractor to successfully construct the proposed slopes. In the project limits, Soules Swamp is a FEMA detailed study area with non -encroachment widths established. The second proposed structure is a 9'x7' RCBC buried Von UT to Richardson Swamp, which is not in a FEMA study area. Both structures have been designed to have as little environmental and surface water impacts as is practicable.
