Box 1180 Rocky Mount, NC 27801 Re: Patterson Drive Park renovation plan Tar- Pamlico River Buffer Rules Nash County DWQ 010809 Dear Mr. Warren: On May 31, 2001 the Division of Water Quality wrote to you concerning your plans to fill an unreported amount of acres of wetlands and/or 30 inner linear feet of Zone 1 regarding the proposed Patterson Drive Park renovation plan in Nash County. This letter informed you that the project was incomplete and was being placed on hold until the additional information outlined in the letter was supplied. To date, we have not received this additional information. Unless we hear from you in writing within 3 weeks of the receipt of this letter, we will consider that you no longer want to pursue this project and we will retire the file and consider the application as withdrawn. Please be aware that reapplication for this project will require a Certification fee and new applications. Box 1180 Rocky Mount, NC 27801 Dear Mr. Warren: RE: Patterson Drive Park renovation plan Tar-Pamlico River buffer rules Nash County DWQ # 010809 Thank you for your letter dated May 15, 2001 (received on May 20, 2001). As we discussed the plan to renovate Patterson Drive Park must be consistent with the Tar-Pamlico River buffer rules which protect a 50 foot wide zone on both sides of all streams, ponds and estuaries in the basin. The plan and plantings as submitted is generally acceptable with two possible exceptions. First, the pathway should be located outside the 50 foot zone. If this is not possible, you may be able to obtain written approval from DWQ to impact the buffer zone if there is no practical alternative. Also the gazebo must be located beyond the buffer zone. If it must be located in Zone 2 (the outer 30 feet), then staff could issue a Minor Variance assuming there is no practical alternative. If you believe that it must be located in Zone 1 (inner 30 feet), then a Major Variance would have to be obtained from the N.C. Environmental Management Commission if there is no practical alternative. Thank you for your letter and recent telephone conversations. Raleigh, N.C. 27604 Dear Mr. Dorney, A Enclosed is a plan for Patterson Dr. Park that we discussed recently by phone. The plan is not very detailed but does show the proposed locations of some of the improvements that we wish to install. The Parterre garden would be a series of four foot wide brick- on- sand walkways bordered by plantings of boxwood, roses, and a central focal ornamental tree-like shrub. The gazebos would have ornamental plantings surrounding them. The idea is to take a park with an unattractive ditch running through it and turn it into a garden spot. As I mentioned , there is a young man interested in using the Parterre Garden for his Eagle Scout Project. The neighboring elementary school is interested in planting for part of their educational programs and there are volunteers interested in donating their time and resources for the cause. We understand the importance of water quality and yield to your expertise. I only ask that you provide an answer expeditiously and with enough detail to adequately communicate what is allowed and what is not to all of the parties involved. Thank you for your time.
