However, based on your conversation with Mr. St. John of this Office the applicants are no longer planning to conduct any activities that require a 404 Permit or 401 Water Quality Certification in regards to your request. Nevertheless, if either applicant decides to pursue the project as requested an application and appropriate fee would be required in this case in order for us to decide whether this project is approvable. The.other property u-us A?? . owner is The Lake Toxaway Company who is developing a golf learning center. The respective J properties are located in Lake Toxaway on US Hwy 64. Mr. Baker and Mr. Mike Parker have both conducted site visits in the past. Mr. Owen Anderson conducted a 'site visit in December. For Mr. Dorney and Mr. St John, I have spoken with Mr.Baker, Mr. Parker, and Mr. Anderson concerning the possibility of The Lake Toxaway Company using one of Mr. Hamby's permitted road crossings: Mr. Hamby did not use the approved crossing during construction. Mr. Hamby was permitted to construct one minor road crossing on Bearwatlow Creek and one minor road crossing on an unnamed tributary to Bearwallow Creek. The Lake Toxaway Company was permitted to construct one minor road crossing on a different unnamed tributary to Bearwallow Creek and one minor road crossing on a linear wetland. Mr. Baker and Mr. Parker would like to see letters in,each file explaining that The Lake Toxaway Company used one of Mr. Hamby's road crossings. The net wetland impact does not change. This letter, the other enclosed letter, and enclosed plans serve as the notice to each file. . As can be seen on the attached Plan I of 2, Mr. Hamby used an, existing logging road crossing during road construction. This logging road crossing has been approved through the Corps, since it was an existing crossing. Also shown downstream on this plan is the location where Mr. Hamby had originally, been approved to cross Bearwallow Creek.: The crossing that The Lake Toxaway Company, is now proposing in its' place, is shown on Plan 2 of 2. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. as well as the additional conditions listed below: 1. Instream work is prohibited during trout spawning season; 2. Stormwater from the roads shall be directed to buffer areas or retention basins and shall not be routed directly to streams; 3. The culverts shall be installed to allow for aquatic life and wildlife movement; 4. The culverts shall be installed so as not to alter the stream profile upstream or downstream of the culverts; 5. The Division of Land Resources' Design Standards in Sensitive Watersheds (15A NCAC 04B .0124) must be adhered to throughout the life of this project; 6. Live or fresh concrete shall not be allowed to come into contact with waters of the state until the concrete has hardened; 7. The use and presence of construction equipment in the channel must be minimized to the extent practical. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The.wetlands have been surveyed and are shown on the attached maps. ` The.project requests channel impacts to approximately 130 linear feet of jurisdictional channels for the proposed construction and installation of two road crossings to access the development. These stream impacts are on two separate ' channels (Bearwallow Creek and an unnamed tributary to Bearwallow Creek). This road will serve as an access road for the development from NC Hwy 64. Bear Wallow Springs Development will be a gated community accessible only to the residents of Bear Wallow Springs. Gates at the Main Entrance and at the intersection with The Lake Toxaway Company's access road are shown on the attached Site Plan Map. C ?-' -7 c Mr. Hamby will own Bear Wallow Springs and The Lake Toxaway Company owns the ? Learning Center and the access road to the Learning Center. There is a contractual o rn ? agreement between Mr. Hamby and The Lake Toxaway Company that ownership will - -i be in place prior to construction. The closing date for Bear Wallow Springs is June - 25, 2001. Mr. Hamby will own the remaining approximately 365 acres as of this date: Responsibility of channel and wetland impacts will lie on the appropriate Newton OFFoeperty owner. Melrose & Associates, P.A. walking the road alignment to examine the .possibility of shifting the road at all stream and wetland crossings to avoid impacts. Areas labeled on the attached full size Site Plan Map as 3a and 4a were realigned to avoid additional stream and linear wetland impacts. The area. labeled as 3a is located where one of the original road alignments impacted . a linear wetland adjacent to the channel This section of the road has been realigned to avoid this area and is evident of the Site Plan Map. Avoidance Area 4a is a location where one of the original road alignments called for the road to, go straight as opposed to the current curved alignment. The new road alignment is placed upslope of where the springhead for this channel is located, thus avoiding channel impacts. There are many areas in the stream system, within the project site that take on a characteristic of loosing a surface water connection. Some of these areas are indicated on the Site Plan Map., For this reason and due to the relatively high placement of these crossings on the drainages, we feel that aquatic life, movement will not be impeded with the installation of these two minor road crossings. Additionally, the culverts will be 1 foot below the existing streambed elevation to " further allow for the passage, of aquatic life movement. There were also early discussions and plans to construct some smaller amenity ponds. within Bearwallow Creek, and its unnamed tributaries. These plans have been completely` abandoned now to avoid stream and wetland impacts.' Any amenity pond will be constructed off-line. Additionally,. a thirty foot vegetated` buffer (estimated to be 2 acres). will be left adjacent to both sides of all remaining channels on the project site as a mitigative action. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands. This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. as well as the additional conditions listed below: 1. Instream work is prohibited during trout spawning season; 2. Stormwater from the roads shall be directed to buffer areas or retention basins and shall not be routed directly to streams; 3. The culverts shall be installed to allow for aquatic life and wildlife movement; 4. The culverts shall be installed so as not to alter the stream profile upstream or downstream of the culverts; 5. The Division of Land Resources' Design Standards in Sensitive Watersheds (15A NCAC 04B.0124) must be adhered to throughout the life of this project; 6. Live or fresh concrete shall not be allowed to come into contact with waters of the state until the concrete has hardened; 7. The use and presence of construction equipment in the channel must be minimized to the extent practical. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act.
