After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3362, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Nationwide Permit Number 39 when issued by the U.S. Army Corps of,Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification and the additional conditions listed below: 1. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this Certification Approval and Authorization Certificate. The culvert must be designed, constructed and placed to allow aquatic life passage; 3. You are required to return the attached Certification of Completion form to notify DWQ when all work included in the 401 Certification has been completed. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. Please recall this case goes back to some meetings that we had with Steve Mitchell and some follow up conversations between us. My project is a residential home to be constructed in Durham County at # 3 Lytham Lane. As you will recall my project will stay below the thresholds for stream and wetlands impacts as they were on the date of application, April 4th, 2001. Enclosed you will find a copy of a General Permit (Regional and Nationwide) Verification issued by the US Army Corp of Engineers, Wilmington District. This permit was issued by Todd Tugwell on May 17th, 2001. In addition enclosed is a copy of the site plan showing the area of the house, retaining wall, and driveway plan. As you can see from the site plan, we do not plan to disturb the natural creek area. The ditch along the front of the property will be piped, but the linear footage will be well below the 150-foot restriction. Therefore per my conversation with Mr. Todd St. John on September 24, 2002 I don't believe that I need written concurrence to proceed with the project.
