In accordance with Title 15 NCAC 2H .0500, the following DEED NOTIFICATION sllall be recorded in the Durham
County Registry prior to the conveyance of lots. Said Deed Notification sllall apply to Surrey Green, being all of Lot 3
revised, as shown on final plat of survey showing recombination of Lots 1, 2 and 3; block at Surrey Green II as per
plat and survey thereof now on tale in the office of the Register of Deeds of Durham County in Plat Book 133 at page
23, to which plat referenced is hereby made for a more particular description of same. See also Plat Book 117 at page
68 Durham County registry.
"A portion of this lot has been determined to meet the requirements for designation as a wetland, stream or protected stream
buffer. Any subsequent fill or alteration of this area shall conform to the requirements of the state rules adopted by the State
of North Carolina in force at the time of the proposed alteration. The intent of this provision is to prevent additional wetland,
stream or buffer filling or draining, so the property owner should not assume that a future application for filling or draining
would be approved. The property owner shall report the name of the subdivision in any application pertaining to said rules.
This covenant is intended to ensure continued compliance with all rules adopted by the State of North Carolina and therefore
the State of North Carolina may enforce benefits. This covenant is to nut with the land and shall be binding on all Parties and
all persons claiming under them".

APPROVAL of 401 Water Quality Certification with Additional Conditions
Dear Mr. Smith:
You have our approval, in accordance with the attached standard conditions and the special conditions listed below, to
place fill in 100 linear feet of perennial streams and 0.17 acre of wetlands in order to construct a residence at #3 Lytham
Lane in Durham County, as described in your application received by the Division of Water Quality on April 4, 2002, and in
additional correspondence received October 31, 2002. After reviewing your application, we have determined that this fill is
covered by General Water Quality Certification Number 3362, which can be viewed on our web site at
http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Nationwide Permit Number 39 when issued by
the U.S. Army Corps of,Engineers. In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the
General Certification.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us and you may be required to send us a new application for a new certification. If the property is
sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying
with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in
the attached certification and the additional conditions listed below:
1. Deed notifications or similar mechanisms shall be placed on all retained jurisdictional wetlands, waters and
protective buffers in order to assure compliance for future wetland, water and buffer impact. These mechanisms
shall be put in place prior to impacting any wetlands, waters and/or buffers approved for impact under this
Certification Approval and Authorization Certificate. A sample deed notification can be downloaded from the
401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands.
2. The culvert must be designed, constructed and placed to allow aquatic life passage;
3. You are required to return the attached Certification of Completion form to notify DWQ when all work included in
the 401 Certification has been completed.
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings6714 Mail Service Center,
Raleigh, N.C. 27699-6714. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

Thank you very much for all of your guidance. I am sorry it has taken me this long to
follow up with the information we discussed. Please recall this case goes back to some
meetings that we had with Steve Mitchell and some follow up conversations between us.
My project is a residential home to be constructed in Durham County at # 3 Lytham
Lane. As you will recall my project will stay below the thresholds for stream and
wetlands impacts as they were on the date of application, April 4th, 2001. Enclosed you
will find a copy of a General Permit (Regional and Nationwide) Verification issued by
the US Army Corp of Engineers, Wilmington District. This permit was issued by Todd
Tugwell on May 17th, 2001. In addition enclosed is a copy of the site plan showing the
area of the house, retaining wall, and driveway plan. As you can see from the site plan,
we do not plan to disturb the natural creek area. The ditch along the front of the property
will be piped, but the linear footage will be well below the 150-foot restriction.
Therefore per my conversation with Mr. Todd St. John on September 24, 2002 I don't
believe that I need written concurrence to proceed with the project.

Dear Mr. smith:
The Division of Water Quality has reviewed your plans for the discharge of fill material
into 140 linear feet of streams and 0.17 acres of wetlands located at Lythom Lane and Surray
Green Subdivision in Durham County for constructing a home. Insufficient evidence is present in
our files to conclude that your project must be built as planned in waters and/or wetlands in
accordance with 15A NCAC 2H .0506. Therefore, unless modifications of the proposal are made
as described below, we will have to move toward denial of your 401 Certification as required by
15A NCAC 2H .0507(e) and will place this project on hold as incomplete until we receive this
additional information, we are requesting (by copy of this letter) that the U.S. Army Corps of
Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must
be constructed as planned and that you have no practicable alternative to placing fill in these
waters and/or wetlands. Specifically can you discuss why these areas must be impacted? Can the
house be realigned to minimize wetland or stream impact? Also please clarify what is planned for
the stream on-site? Any documentation such as- maps and narrative that you can supply to
address alternative designs for your project may be helpful in our review of your 401 Certification.
Please respond within three weeks of the date of this letter by sending a copy of this
information to me and one copy to Steve Mitchell at the Raleigh Regional Office at (919) 571-
7400. If we do not hear from you in three weeks, we will assume that you no longer want to pursue
this project and we will consider the project as withdrawn. If you have any questions, please

realize that he was still on vacation.

I recommend a hold letter. The application does not discuss what is proposed. More specifically, there is
no discussion on what is being done to the stream. The application indicates that the stream will be longer
post-construction. Is there a proposed relocation? Or are they putting into a pipe? Also, there is no
discussion on avoidance and minimization. Why is it necessary to fill all 0.17 acres of wetlands on the
site? Can't they rework design to minimize?

I recommend a hold and additional information letter. There are numerous places on the site where I
believe additional avoidance and minimization can occur. Additionally, the maps are deficient in quality to
allow a full understanding of what is occurring. Primarily, the lack of a legend precludes identifying what
zone the impacts to buffers is occurring in many cases.
The places where additional minimization may need to occur is as follows:
Sheet 2: Can road be shifted to avoid wetland?
Sheet 3: Can sewer be shifted to miss buffer impact? Are the impacts shown on sheet 2 Zone 2? Without
legend cannot tell?
