REQUEST FOR MORE INFORMATION for the use of the MAJOR VARIANCE; From the Tar-Pamlico
Riparian Buffer Rules for the Construction of Residential Structures on Existing Lots on Barrier Islands

Dear Mr. and Ms. Marron,
The NC Division of Water Quality (DWQ) has reviewed your plans to impact 576 ft2 of protected riparian
buffers on the subject property for the expansion of an existing deck as described in your application received by
this office on 3/14/01. Insufficient evidence is present in our files to conclude that your project must be built as
planned in protected riparian buffers in accordance with 15A NCAC 213 .0259. Therefore, unless modifications of
the proposal are made as described below, we will have to move toward denial of your Major Variance Approval
as required by 15A NCAC 2B .0259 and will place this project on hold as incomplete until we receive this
additional information.
Please provide us with information supporting your position that states your project must be constructed as
planned and that you have no practicable alternative to impacting these protected riparian buffers. Specifically
can you;
? Provide additional information as to why the proposed deck needs to be expanded. This office believes that
it would be possible to plant additional woody and herbaceous vegetation or to use other methods to stabilize
the subject area. The DWQ can provide you with additional guidance in this matter at your request. The
DWQ is required to ensure that all impacts to Zone 1 are minimized to the maximum extent practical per
Condition No. 4 of the "Major Variance from the Tar-Pamlico Riparian Buffer Rules for the Construction of
Residential Structures on Existing Lots on Barrier Islands" approved by the Environmental Management.
Commission on 4/13/00.
Any documentation such as maps, construction plans and narrative that you can supply to address alternative
designs for your project may be helpful in our review of the variance request.
Please respond within three weeks of the date of this letter by sending a copy of this information to me and
to Ms. Deborah Sawyer, DWQ Washington Regional Office (252-946-6481). If we do not hear from you in three

The above subject variance request was reviewed by the WaRO. A site visit was made on
2/21/01. The applicant proposes to construct a ground-level deck between the existing house and
the existing bulkhead. All impacts are in Zone 1.
The WaRO has concerns as to the "hardship" on this project. A deck and screened porch already
exists on the site. Most of the site is already built upon area. It is the opinion of the WaRO that
this proposed construction is unnecessary. It is recommended that the applicant supply the DWQ
with a reason for the construction stating what the hardship will be if the ground deck is not built.
If the applicant cannot show a hardship reason for the construction, them the Wa.RO recommends
denial of the proposal.
