This letter is being written as a follow-up to your Certified Letter dated February 28, 2002 (received March 14). The
February 28`h letter indicated that no response had been received for a January 24, 2001 letter from your office
requesting additional information concerning the above referenced project.
Please find attached our February 2, 2001 response letter to Ms. Cyndi Karoly of your office. As indicated, we felt that
both projects met the basic threshold conditions of NWP 12 and that 401 Water Quality Certifications were not
necessary. Also attached are U.S. Army Corps of Engineer Permits that were subsequently issued for both projects.
Your office was initially contacted concerning these projects as a requirement of the Army Corps of Engineers' Pre-
Construction Notification.

On January 24, 2001 the Division of Water Quality wrote to you concerning your plans to impact an unreported
amount of wetlands and/ or linear feet of streams regarding the Park Drive and Mondovi Foods waterline extensions in
Surry County. This letter informed you that the project was incomplete and was being placed on hold until the additional
information outlined in the letter was supplied. To date, we have not received this additional information. Unless we hear
from you in writing within 3 weeks of the receipt of this letter, we will consider that you no longer want to pursue this
project and we will retire the file and consider the application as withdrawn. Please be aware that reapplication for this
project will require a Certification fee and new applications.

Dear Mr. Heath:
On January 23, 2001, your applications for 401 Water Quality Certifications on
behalf of the City of Mount Airy for two projects in Surry County were received by the
N.C. Division of Water Quality. Please note that beginning January 1, 1999, the N.C.
General Assembly passed legislation requiring payment of a fee for all 401 applications.
Your applications are being placed on hold since no payment was received with the
package. The fee for applications is $200 for projects impacting less than an acre of
wetland and less than 150 linear feet of streams. For projects impacting one. or more
acres of wetland or 150 or more feet of streams, the fee is $475. In order for DWQ to
review and process your request, you must send a check in the appropriate amount made
payable to the N.C. Division of Water Quality for each project.
Please note that if you meet our basic threshold conditions for NWP 12, for which
you are applying, you would not need written concurrence from DWQ. Please see the
conditions for NWP 12 on our website to see if this is the case:

concurrence then an application fee will not be required and we ask you send us written
notification to this effect.

Dear Sir/Madam:
This letter is being written to serve as notification of a proposed water line extension project and request clearance from
youragency.
The City of Mount Airy proposes to construct a water line extension in Surry County as shown on the attached vicinity
map. The project would involve a subaqueous water line crossing of Stewart's Creek and Ararat River. The City is
applying to the Army Corps of Engineers for a permit to complete the work. As a requirement of the Corps permit, your
agency is required to be notified of the project and asked to determine if the project could potentially impact any

The City of Mount Airy proposes to construct a water line extension in Surry County as shown on the attached vicinity
map. The project would involve a subaqueous water line crossing of Stewart's Creek and Ararat River. The City is
applying to the Army Corps of Engineers for a permit to complete the work. As a requirement of the Corps permit, your
agency is required to be notified of the project and asked to determine if the project could potentially impact any
resource(s) under your agency's jurisdiction near the stream crossing.

On January 23, 2001, your applications for 401 Water Quality Certifications on
behalf of the City of Mount Airy for two projects in Surry County were received by the
N.C. Division of Water Quality. Please note that beginning January 1, 1999, the N.C.
General Assembly passed legislation requiring payment of a fee for all 401 applications.
Your applications are being placed on hold since no payment was received with the
package. The fee for applications is $200 for projects impacting less than an acre of
wetland and less than 150 linear feet of streams. For projects impacting one or more
acres of wetland or 150 or more feet of streams, the fee is $475. In order for DWQ to
review and process your request, you must send a check in the appropriate amount made
payable to the N.C. Division of Water Quality for each project.
Please note that if you meet our basic threshold conditions for NWP 12, for which
you are applying, you would not need written concurrence from DWQ. Please see the
conditions for NWP 12 on our website to see if this is the case:

concurrence then an application fee will not be required and we ask you send us written
notification to this effect.
