To date, we have not received this additional information. Unless we hear from you in writing within 3 weeks of the receipt of this letter, we will consider that you no longer want to pursue this project and we will retire the file and consider the application as withdrawn. Cary Wallace Property UT to Crabtree Creek [03-04-02; 27-33-1; C NSW] Dear Mr. and Mrs. Wallace, On November 22, 2000, I met with you at the subject property in Cary, Wake County (see attached map). The purpose of this meeting was to determine the applicability of a stream feature located on the property to the Neuse River Riparian Buffer Protection Regulations (15A NCAC 213 .0233). As a result of this meeting, it was determined that the stream is indicated on the attached Wake County, NC Soil Survey and it was confirmed to be at least an intermittent stream in the field. Therefore, this stream is subject to the attached 50-foot riparian area protection rules (15A NCAC 2B .0233). It appears that the house and deck have been constructed within Zone 2 (the outer 20 feet) of the 50-foot protected riparian buffers. It, also, appears that the landscaping wall and till dirt is within Zone 1 (the inner 30 feet) of the 50- foot protected riparian buffers. These activities are not allowed within the protected buffers without a variance from the rules. The requested + 50 feet of pipe to be placed within the stream is also not allowed without a variance from the rules. Please refer to the attached rules for information on how to obtain a variance from the rules [T15A: 02B .0233 (9); page 67] or feel free to call our office 733-1786. I have attached a copy of the Minor Variance Request Form for any impacts proposed within the Zone 2 (only) of the protected buffers. Impacts that are not "allowable" or "exempt" within Zone 1 require a Major Variance from the NC Environmental Manavement Commission (EMC). 10 It is possible for the Division of Water Quality (DWQ) to pursue a violation case for the unauthorized activities listed in paragraph 2. However, this office will recommend to the DWQ RALEIGH REGIONAL OFFICE that a violation case not be pursued if you submit and receive a Minor Variance for the impacts to Zone 2 and restore the area within Zone 1. Restoration of the area within Zone 1 should include at a minimum; the removal of the landscaping wall, regrading of the area to a uniform slope and replanting per the attached DWQ Wetlands Restoration Program, "Draft Guidelines for Riparian Buffer Restoration". It may be possible that this property has a "Vested Right" ("Grandfathering") from the riparian area protection rules. This office recommends that you contact the previous landowner to determine if a "Vested Right" was ever granted for the property.
