received this additional information. Unless we hear from you in writing within 3 weeks of the receipt of this letter, we will
consider that you no longer want to pursue this project and we will retire the file and consider the application as
withdrawn. Please be aware that reapplication for this project will require a Certification fee and new applications.

This Office is in receipt of information, supplied by Mr. Chris Huysman, Wetland and
Natural Resource Consultants, Inc., which refers to a quoted design, permitting, construction
management, and monitoring fee for the subject stream restoration plan. While it is
understandable that the costs for stream restoration are considerable, the Division cannot
determine, based on the information submitted, that the project meets our definition of stream
restoration. Stream restoration is defined as the process of converting an unstable, altered, or
degraded stream corridor, including adjacent riparian zone and flood-prone areas to its natural or
referenced, stable conditions considering recent and future watershed conditions. This process
also includes restoring the geomorphic dimension, pattern and profile as well as biological and
chemical integrity, including transport of water and sediment produced by the stream's
watershed in order to achieve dynamic equilibrium.
Simply stated, a detailed stream restoration plan must be submitted to and approved by
the Division prior to the issuance of a Section 401 Water Quality Certification for stream
restoration. Please respond both to this Office and to John Dorney, 4401 Reedy Creek Rd,
Raleigh, NC 27607 within three weeks of receipt of this letter outlining your intent to proceed
with this project or withdraw your application. Once the project is withdrawn, you are welcome
to re-apply if and when you reach the decision to pursue this stream restoration.

Staff report completed for 00 1332. Comments: I am recommending that
the NWP 14 portion of the project be issued and the NWP 27 be given a
separate #?and put on hold. I was unsure as to whether or not to write
the on hold letter (I didn't). If the restoration is assigned a
separate project number, then will the initial review (and hence the
request for more info), start with the CO? We can talk about this later
this week.

Dear Ms. Razete:
The Division of Water Quality has reviewed your plans for the restoration of
approximately 2100 linear feet of an Unnamed Tributary to Wallace Creek, Class C Tr+
waters, New River Basin. Insufficient evidence is present in our files to conclude that your
project must be built as planned in waters and/or wetlands in accordance with 15A NCAC 2H
.0506. Therefore, unless modifications of the proposal are made as described below, we will
have to move toward denial of your 401 Certification as required by 15A NCAC 2H.0507(e)
and will place this project on hold as incomplete until we receive this additional information.
We are requesting (by copy of this letter) that the U. S. Army Corps of Engineers place your
project on administrative hold.
Please submit detailed plans and specifications for the stream channel restoration. It is
recommended that you utilize the Division's Draft Technical Guide for Stream Work in North
Carolina as guidance when designing the restoration plan. Copies of this document may be
obtained through the Wetland Unit homepage at http://h2o.enr.state.nc.us/ncwetlands.
Please respond within three weeks of the date of this letter by sending one copy
of this information to me and one copy to John R. Dorney, 4401 Reedy Creek Road,
Raleigh, NC 27607. If we do not hear from you in three weeks, we will assume that you no
longer want to pursue this project and we will consider the project as withdrawn. If you have

be shown on the map. Map scales should be 1 inch equals 50 fleet or 1 inch equals 100 feet or their
equivalent.

c. If delineation was performed by a consultant, include all data sheets relevant to the placement of the
delineation line.
d. Attach a copy of the stormwater management plan if required.

Dear Mr. Thomas and Mr. Dorney:
On behalf of CGR Development Corporation, WNR, Inc. requests authorization for
proposed impacts to jurisdictional Waters of the U.S. for their proposed Carefree Cove
Development located in Baldwin Gap, NC. The attached USGS Topo Quad depicts the
location of the site. In its current state the site contains some 3000 linear feet of
unnamed tributaries to Wallace Branch and 1+ acres of vegetated wetlands.
The on-site channel proposed for impacts is assessed to be a moderately high quality
channel with average peaks in its hydrograph resulting from the approximate 150-acre
rural drainage area. The channel does show on the USGS Topo Quad. Down-cutting
and bank failure is evident along several reaches of the channel. The channel has also
relocated itself in several areas into an adjacent historic roadbed, which is at a higher
elevation than the historic channel bed. There is better substrate in the historic channel
bed. Crayfish and salamanders inhabit the channel throughout its length.
Ephemeroptera, Plecoptera, and Tricoptera were all observed during the initial wetland
field evaluations in June.
Site development requires piping impacts of 140 linear feet of this DWQ important
channel under a Nationwide Permit 14. The entire reach of this channel was flowing
during June 2000. There are numerous springheads further up the drain within the
property limits that provide the hydrology for this feature.
Site development requires impacts to 0.09 acres of vegetated wetlands under
Nationwide Permit 14. The total wetland impacts for the site will be 0.11 acres, which
represents the area of wetlands and of channels (waters) impacted by the development.
Wetland impacts of 0.06 acres will be needed for the construction of Road Crossing #2

utilizing Nationwide Permit 14 while 0.03 acres of wetland impacts will also be permitted
under Nationwide Permit 14 for the construction of Road Crossing #3.
Avoidance was achieved by a layout that consists of 95 lots on the 165-acre tract of
land. If permitted, the net wetland and waters loss would be approximately 4.7% of
channel length and approximately 9% of vegetated wetland area. Channel impacts are
high in the drainage area. As a point of interest, the channel on site is at the top of the
drainage area for Wallace Branch. With the exception of road crossings in the
headwaters all other wetlands are avoided by the proposed development. The slope of
existing topography dictated road layout that could more easily cross the steep drainage
feature.
Wetlands located at the top of the drainage at an elevation of 3700 feet are important
for water storage and biological diversity. These wetlands are wooded with a diverse
stable canopy and are not proposed for extensive impacts.
The mitigative proposal is that all remaining wetlands and channels on the site will be
protected by a deed mechanism similar to the state recommended format. Also
included within this package is a Nationwide Permit 27 application to restore
approximately 2100 linear feet of the channel on site. Aforementioned conditions make
this channel attractive for restoration. The location of the channel, at the top of the
drainage area for Wallace Branch, also makes the proposal for restoration attractive.
Once this section of the drainage is restored, there may be downstream possibilities for
channel reaches currently in pastured land.
