Based upon our review, we have determined that significant uses would be removed or degraded by this project. Insufficient evidence is provided in your application to conclude that your project must be built as planned. Therefore, unless modifications of the proposal are made, we will move toward denial of the approval. Please provide information supporting your position that you have no practical alternative to impacting wetlands to the extent proposed. For example, can you shift the location of the proposed new development to the northeast, away from the stream and wetlands? Any documentation, including maps, drawings and calculations beyond the narrative included in your application, that will help to describe design alternatives would be helpful in our review. Also, you should note that since total wetland fills for this project exceed one acre, compensatory wetland mitigation is required as described in 15A NCAC 2H.0506 (h), and as you noted in your application. Wetland mitigation would not be required if the impacts could be reduced so that the cumulative impact is less than one acre. Until the information requested in this letter is provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Nationwide Permit General Condition 19 mandates that projects must be designed to avoid and minimize adverse effects to waters of the United States to the maximum extent practicable at the project site (i.e., onsite). Following a review of your permit application, it was determined that there may be alternate site development plans which may result in reduced impacts to jurisdictional wetlands. Please indicate all that you have done, especially regarding the modification of plans and proposed construction techniques, to minimize adverse impacts (i.e., to reduce the discharge of fill material into waters of the United States as much as practicable). Specifically, this information should address alternative building layouts and the use of undeveloped on-site parcels (identified as parcels 1 and 2 on the plans submitted with the permit application). General Condition 19 also states that mitigation will be required when necessary to ensure that the adverse effects to the aquatic environment are minimal, and it requires compensatory mitigation at a minimum 1:1 ratio for all wetland impacts requiring a preconstruction notification application (any impact in excess of 0.1 acre for nationwide permit 39). In your application, you proposed to mitigate for impacts by planting trees within a water quality pond planned for the development. Please provide additional information so that the functional value of the proposed mitigation may be more accurately assessed. Specifically, we require detailed plans of the pond, including cross sections, a list of the species to be planted, and acreage of the mitigation area. Alternative measures to mitigate for impacts to aquatic resources (which may include wetland preservation on and off site) may also be proposed. Your response to the above concerns is essential to our expeditious processing of your permit application. Also, a copy of this information should be sent to the North Carolina Division of Water Quality to enable them to adequately evaluate your application for a Water Quality Certification pursuant to Section 401 of the Clean Water Act. The site is located on Olive Chapel Road (NCRS 1160), approximately 0.19 miles west of its intersection with Highway 55 (see attached USGS site vicinity map). Proposed impacts utilizing Nationwide Permit 39 will total 0.29 acres and approximately 230 linear feet of channel. A portion of the site was previously permitted (AID # 200020658) and utilized Nationwide Permit 26. Total impacts for the entire property to waters (including wetlands) will total 1.27acres (0.98 acres previously permitted under NWP 26 and 0.29 acres of impacts requested for NWP 39) and 563 linear feet of channel (333 linear feet previously permitted under NWP 26 and 230 linear feet requesting the use of NWP 39). Although the significance/importance of the channel has not been determined, S&EC, Inc. does not believe it tqa ?? either. The purpose of the project is to provide a shopping facility for the nearby residential developments. Construction of the project will comply with the general conditions stated within Nationwide Permit 39. A 0.92 acre water quality pond was required as a condition of the previously permitted NWP126. If then Il "` is accepted for mitigation, native plant species will be planted in and around the pond and shelves within the pond. Our client proposes a payment of $30,480 into the North Carolina Wetland Restoration Fund to mitigate for NC Division of Water Quality required mitigation. The 250 linear feet of channel impacts are not believed to be considered "important" or "significant", however, neither the NC Division of Water Quality (DWQ) nor the US Army Corps of Engineers (Corps) have evaluated the feature. The total amount of wetlands on this parcel was determined to be 1.27 acres, as delineated on the wetlands map prepared by BBM Associates, Inc. dated February 11, 2000. Under the Olive Chapel Village project, we were granted a nationwide permit 26 to fill 0.98 acres of wetlands. A 0.92 acre water quality pond is approved by the NCDENR Water quality Division and is to be constructed as part of that project. The Walgreens site was designed with every effort. to minimize wetland impacts. Unfortunately, the wetlands divide the site, separating; the portion of the site along the Apex Peakway from the remainder o1'thc site. This portion (approximately 2.5 acres) would be undevelopable because the Town of Apex and NCDOT will not allow access off the Apex Pcakway. There are no other suitable sites that are zoned retail. 'T'herefore, the site would require fill to be placed within the retraining 0.29 acres of wetlands to make it viable. We hope that the construction of the 0.92 acre water quality pond will partially mitigate the impact to the remaining 0.29 acres of wetlands spanning across the middle of the proposed Walg;reens site. There was no practical way to avoid impacts.
