APPROVAL of 401 Water Quality Certification and Neuse River Buffer Rules with Additional Conditions
Dear Mr. Stephens:
You have our approval, in accordance with the attached conditions, to place fill in 0.00413 acre of wetlands and
36 linear feet of streams in order to construct a residential driveway between lots 17 and 18 of Phase II of the Devon
Subdivision in Wake County, as described in your application received by the Division of Water Quality on August 10,
2000, and in additional correspondence received March 6, 2002 and April 22, 2002. After reviewing your application, we
have determined that this fill is covered by General Water Quality Certification Number 3362, which can be downloaded
from our web site at htti):Hh2o.enr.state.nc.us/ncwetiands . This Certification allows you to use Nationwide Permit
Number 39 when issued by the U.S. Army Corps of Engineers. This approval is also valid for the Neuse River Buffer
Rules (15A NCAC 26 .0233). In addition, you should get any other federal, state or local permits before you go ahead
with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed
regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the
General Certification. This Certification replaces the one issued to you on April 17, 2002.
This approval is only valid for the purpose and design that you described in your application. If you change your
project, you must notify us in writing and you may be required to send us a new application for a new certification. If the
property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the
conditions listed in the attached certification as well as the additional conditions listed below:
1. An additional condition is that stormwater shall be directed to diffuse flow at non-erosive velocities through the protected
stream buffers;
2. Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and waters or areas
within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter
or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the
401 /Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands ;
If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act
within 60 days of the date that you receive this letter. To ask for a hearing, send a written petition which conforms to
Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh,
N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing.
This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. If you have

RE Lot 18 Devon Wetland Permit Corrections
Dr. Thorpe, This memo is in response to your approval letter dated April 17,
2002, DWQ project No. 00-1057, addressed to Terry Stephens. First of all, we
thank you for the approval to do the work related to the wetland stream crossing;
however, it has come to our attention that the stream for this project is not subject
to the Neuse River Buffer regulations, since this feature is not found on the Soil
Survey or the USGS map. It appears on our driveway crossing asbuilt map has a
50-foot hatched area around the stream which is in error and may have caused the
confusion. Additionally, there is another stream feature near this one and it
appears on the Soils Survey, but its location is off the property in question.
We request a review of the attached soils and topo maps to prove this statement
and ask that you please revise the DWa approval letter to address only the
wetlands and not buffer rules. Also, for the record, the area of wetlands that was
actually disturbed/filled with the driveway crossing was 0.00413 acres and 36
linear feet of stream. It did not affect any Neuse River Suffer areas. Please give
me a call if you have any questions.

RE Lot 18 Devon Driveway Crossing Wetland Permit.
Mr. Stephens:
I spoke to Mike Horan with the Division of Water Quality today concerning the
401-wetland certification for the above mentioned lot. This memo addresses the
issues outlined in his letter dated August 17, 2000 for DWQ Project No. 001057.
A drawing of the as built driveway crossing is included to describe the location and
impact of the driveway to the stream and associated wetlands. DWQ project No.
990753 addresses the subdivision road-crossing permit south of the cul-de-sac.
Lot 17 is a buildable lot but does not need a driveway to cross the stream. Also,
please note that the driveway on lot 18 is shown crossing the NRB at a right angle.
I have faxed this memo to Mr. Horan and will send him and you both a hard copy in
the mail. Attached is a copy of the DWQ letter dated August 17, 2000. Please
let me know if you need anything else.
