On September 21, 2000, the Division of Water Quality wrote to you concerning your plans to 0.46 and 290 feet of
streams in order to expand an existing golf course in Currituck County. This letter informed you that the project was
incomplete and was being placed on hold until the additional information outlined in the letter was supplied. To date, we
have not received this additional information. Unless we hear from you in writing within 3 weeks of the receipt of this
letter, we will consider that you no longer want to pursue this project and we will retire the file and consider the application
as withdrawn. Please be aware that reapplication for this project will require a Certification fee and new applications.

Unless modifications of the proposal are made, or compelling evidence is provided to demonstrate that
you cannot avoid and minimize the proposed wetland impacts, we will move toward denial of the 401
Certification as required in 15A NCAC 2H.0507(e). Until the information requested in this letter is
provided, I will request (by copy of this letter) that the Corps of Engineers place this project on hold. Also,
this project will be placed on hold for our processing due to incomplete information (15A NCAC 2H
.0507(h)).

Dear Sirs:
On August 1, 2000, the NC Division of Water Quality (DWQ) received your application for a 401 Water
Quality Certification to fill 0.46 and 290 feet of streams in order to expand an existing golf course in Currituck
County. In accordance with 15A NCAC 2H.0506, a thorough inspection of the site has been conducted by
staff of the DWQ Washington Regional Office. Based on this review, along with your application materials,
we have determined that insufficient evidence has been provided to conclude that your project must be built as
planned. Specifically, can you incorporate the wetlands an stream into the site as a water hazard?
Furthermore, we have determined that the stream you propose to culvert is a perennial stream, not an
intermittent stream. We do not concur with your statement that culverting of the stream into the pond will
improve the water quality. The existing wetlands adjacent to this stream provide a better filter for runoff than
the pond. Since you propose to impact greater than 150 linear feet of perennial streams, compensatory stream
mitigation will be required in accordance with 15A NCAC 2H.0506(h). You have the following options for
satisfying the stream mitigation requirement associated with this project:
1. Payment into the North Carolina Wetland Restoration Program, if the WRP will accept the
responsibility for conducting this mitigation work, or
2. Preparing and implementing a stream mitigation plan.
In your application, you not proposed any form of stream mitigation. Please note that your application
will be considered incomplete until a mitigation plan is forwarded to this office. We strongly suggest that you
locate a mitigation site within the same river sub-basin as your project. Please see the Draft Technical Guide
for Stream Work in North Carolina on our web site at hn:flh2o.enr.state.nc.us/ncwetiands/strm2ide.htmI for
assistance in developing a stream restoration plan. Additional options of stream enhancement, streambank
stabilization, and/or stream preservation may also be feasible for you. See the Interim, Internal DWQ Policy
on Stream Mitigation Options and Macrobenthos Monitoring for the appropriate mitigation ratios. This
document is also available on our web site at hn://h2o.ehnr.state.nc.us/Ndbranch/wetiand/strmmito.htm. As
an alternative, you may also propose payment into the WRP in lieu of developing your own mitigation plan.
If you wish to pursue this alternative, please contact Mr. Ron Ferrell at (919) 733-5208 to ask whether the
WRP will be able to add this project to their schedule. If so, you should obtain written verification from the
WRP and provide a copy of their concurrence to this office. Wetland mitigation will not be required for this
project.

The purpose of this letter is for Mitchell & Associates, Inc., representing the Carolina Club, to
submit an application for the placement of fill material within approximately 0.46 acres of non-
tidal, jurisdictional wetlands on my client's property, located off Hwy 58, the town of Grandy,
Currituck County, North Carolina.
The proposed project involves the partial relocation of an existing intermittent stream by
diverting the water flow into two 36" cmps and piping the water into an existing pond, which
will then flow back into the existing stream via an overflow pipe. Approximately 290 feet of
the old stream will be filled with clean earthen material, resulting in an impact of 0.46 acres.
The proposed fill in wetlands is needed in order to best and most practicably utilize available
area for the expansion of an existing golf course. The location of the project area in relation
to existing lots and infrastructure precludes the redesign of the course. The water that will be
diverted will return cleaner and more-filtered after being piped into and through an existing
pond. With respect to compensatory mitigation, the applicant is willing to provide the
adequate creation or preservation of similar onsite wetlands, in accordance with your
direction.
The applicant has considered all alternatives to the placement of fill material within these
wetlands, however, this plan is the only practicable option available. The project has been
designed to avoid and minimize undue impacts to the neighboring wetlands. Additional
measures will be taken to ensure that all work will be conducted in strict accordance with all
conditions pursuant to this permit.

Good afternoon Cyndi,
I received the directions to your office and also the message that you
sent to Deborah. I am looking forward to coming up there to speak with
you and John about the buffer rules and their implementation and
enforcement. I mentioned to you that I had already visited the Carolina
Club golf course in Currituck county. I would like to speak with you
next Monday about how we justify our decisions, but at this time I would
be inclinded to decline their proposal based on the lack of demonstrated
need for the filling of the wetland. The small creek does bisect one of
the fairways on the golf course, but I would say that it is not a major
problem for them. Most golf courses have water hazards on them.
Perhaps they can come up with a plan to redirect the stream and
establish comparable wetlands along the new course- but this is
something that I would like to speak with you about. I am not familiar
with what sorts of requirements we can (or can not) impose. For the
time being, I would recomend declining the permit for this project.
Again, I look forward to meeting with you in person next Monday. Have a
