This letter informed you that the project was incomplete and was being placed on hold until the additional information outlined in the letter was supplied. To date, we have not received this additional information. Unless we hear from you in writing within 3 weeks of the receipt of this letter, we will consider that you no longer want to pursue this project and we will retire the file and consider the application as withdrawn. Please be aware that reapplication for this project will require a Certification fee and new applications. Did you find the Caldwell Phase I 000249? I tried to fax it to you but I am not sure how much you got. Also, i can't our copy of Len's reductions and minimization. We may have to get hime to resend them to you. Piedmont Center 991096. I found a June 12, 2000 letter signed by John asking for more information on the project. Steele Creek 000754. Len R. response is pretty lame if you ask me. The basic question is do we want to issue a 401 on a large development with lots of streams and wetlands before know where the other impacts will be. I don't really object to the ponds, but are they in the best place?, will they hold the stormwater for whatever development is above them? As I told Len, I think DWQ needs to sit down with the developer to discuss the project and possible impacts before we give them any authorization. Of course we could issue the 401 for the ponds and condition it to preserve the rest of the wetlands and streams on the site. Ltes discuss, let me know if I am off base. A point of confusion however, Steele Crk #000754 is a project I objected to because Len provided only info on two ponds in a 1200 acre development and I want to see the rest of the anticipated impacts. I think Hyde Park #000738 is the one thatLen was moaning about the stormwater pond. I think they need to do it based on the imperviousness and steepness of the site. Also, Mike Parker keeps forwarding me email stuff from you apparently that must be sent out a general mailing list that I am not on. Doesn't bother me but it's driving him nuts. So you might want to add me to that list, or we can keep irritating Praker. Approximately 2400 If of stream will be flooded to create the facilities (±0.31 stream bed) utilizing Nationwide Permit 026. Based on my site visit, Waters of the U.S. on the above described property which are subject to the permit requirements of Section 404 of the Clean Water Act (33 USC 1344), consist of headwater wetlands and intermittent to perennial tributaries of Lake Wylie in the Catawba Basin. The project will planned to avoid and minimize impacts to the important intermittent and perennial streams and wetlands. The remaining streams and wetlands will be protected by forested buffers. All fill material will be unpolluted. Project construction will strictly adhere to an approved Sedimentation and Erosion Control Plan. Additional regulatory requirements are expected in future phases. General Wetland Classification and Description The wetlands on this site can be describe as Palustrine Forested Broad Leaved and Scrub-Shrub Temporarily and Seasonally Flooded. The majority of the site is a moderately to steeply sloping former agricultural land and woodland. The forested headwater wetland areas are dominated by Facultative Wet and Facultative species. Trees include sweetgum, tulip-poplar, red maple, willow oak, black willow, and American elm. Understory and herbaceous strata includes smilax, sedges, soft rush, poison ivy, etc. Where the soils are more saturated Obligate and Facultative Wet species such as black willow, tag alder, and silky dogwood are dominant. The site includes Monacan soils. These soils are map units which may have inclusions of hydric soils according to the Natural Resource Conservation Service, Technical Guide-Section II-A-2, June 1991. yr , Steele Creek Residential Golf Course Community Page 2, June 2, 2000 SUMMARY OF WATERS OF THE U.S. Preliminary identification of the Jurisdictional Waters on the site were determined according to the Corps of Engineers Wetland Delineation Manual, Technical Report Y-87-1, 1987, with Appendices. Preliminary data gathering included review and interpretation of topographic maps; USDA Soil Conservation Survey; aerial photographs, and preliminary site visits to selected areas. Then the Routine On-Site Determination Method was utilized to determine the upper boundary of the wetlands. In order to make a positive wetland determination indicators of hydrophytic vegetation, hydric soil, and wetland hydrology were identified as described in the manual. SUMMARY OF JURISDICTIONAL WATERS OF U.S. (Amroximate) Surface Waters Ponds + 3.00 ac. Streams (± 40,000 If) ± 5.00 ac. Wetlands + 15.00 ac. Total + 23.00 ac. Surface Waters Streams ( ± 150 If) + 0.02 ac. Streams Flooded (± 24001f) ± 0.31 ac. + 0.33 ac. Best Management Practices will be employed to minimize impacts to Jurisdictional Waters downstream. These will include: a) Siltation Barriers; Sediment Traps and Diversion Ditches b) Methods to prevent short term impacts will be inspected regularly and maintained during construction of the project. C) Project construction will strictly adhere to an approved Sedimentation and Erosion Control Plan. d) Best Management Practices will include utilizing siltation trapping ponds and other erosion control structures where appropriate. Impacts from hazardous materials and other toxins to fish and aquatic life such as fuels will be avoided by not permitting staging areas to be located near surface waters. e) As required by the 401 Water Quality Certification conditions, measures will be taken to prevent "live" or fresh concrete from coming into contact with waters until the concrete has hardened. Steele Creek Residential Golf Course Community Page 3, June 2, 2000 STORMWA TER MANAGEMENT PLAN A Stormwater Management Plan will be designed and implemented for the project to meet the 401 Water Quality Certification requirements. Stormwater management becomes necessary when increasing the impervious area within an existing natural area. The planners will utilize information and guidelines provided by the North Carolina Department of Environment and Natural Resources Water Quality Section in developing this stormwater wetland. Wet detention basins shall be the primary treatment system for stormwater runoff from paved surfaces and landscaping on commercial, office, business, and institutional parcels. The wet detention basins will be designed to attenuate the first inch of rainfall over a 24 hour period. Water will be released over a 2 to 5 day period. Discharge velocity of will be less than five cfs from the end of the dissipation device. A littoral zone/forebay will be incorporated into the design of the ponds to encourage additional nutrient removal. The planners will utilize information and guidelines provided by the North Carolina Department of Environment, Health, and Natural Resources in developing the design of wet detention basins using the Table 1.1 in the Stormwater Best Management Practices. NCDENR November. 1995. To help enhance water quality and reduce the potential nutrient impacts downstream utilization of the non-wetland floodplain will be used where feasible for stormwater treatment. CULTURAL RESOURCES The State Historic Preservation Office may review of the USGS maps at the Office of State Archaeology and the Survey and Planning Office of the North Carolina Department of Cultural Resources to determine if sites are indicated on the National Historic Register within the study area. Did you find the Caldwell Phase I 000249? I tried to fax it to you but I am not sure how much you got. Also, i can't our copy of Len's reductions and minimization. We may have to get hime to resend them to you. Piedmont Center 991096. I found a June 12, 2000 letter signed by John asking for more information on the project. Steele Creek 000754. Len R. response is pretty lame if you ask me. The basic question is do we want to issue a 401 on a large development with lots of streams and wetlands before know where the other impacts will be. I don't really object to the ponds, but are they in the best place?, will they hold the stormwater for whatever development is above them? As I told Len, I think DWQ needs to sit down with the developer to discuss the project and possible impacts before we give them any authorization. Of course we could issue the 401 for the ponds and condition it to preserve the rest of the wetlands and streams on the site. Ltes discuss, let me know if I am off base. Pete Colwell
