Deed notifications or similar mechanisms shall be placed on all remaining jurisdictional wetlands and streams to notify the state in order to assure compliance for future wetland and/or water impact. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). - An additional condition is that a final, written stormwater management plan shall be approved by this Office before the impacts specified 'MIpp in this Certification occur. The stormwater management plan must include plans and specifications for stormwater management facilities designed to remove 35% TSS according to the most recent version of the NC DENR Storrnwater Best Management Practices ,Manual. Also, before any permanent building is occupied at the subject site, the facilities, as approved by this Office, shall be constructed and operational. and the stormwater management plan, as approved by this Office, shall be implemented. The project proposes permanent impacts associated with road crossings of 149 linear feet of important, intermittent channel and permanent impacts associated with lot fill of 149 linear feet of important, intermittent channel. Impacts are shown on the attached site plans. The proposed activity is located in Mecklenburg County and is within lands owned by Mr. William Terry. The attached USGS topographical map shows the location of the project. A road crossing on an unnamed tributary to West Branch Rocky River, utilizing NW 14, consists of a box culvert with baffle walls. The unnamed tributary to West Branch Rocky River is considered to be intermittent and important in aquatic function. The permanent channel impacts for this road crossing total 149 linear feet. Lot fill utilizing NW 26 is proposed for impacts to a separate unnamed tributary to West Branch Rocky River. Channel impacts of 149 linear feet of important channel are anticipated utilizing pipe and rip-rap. Total impacts to important channel for this project include 298 linear feet. There were no vegetated wetlands found on site. No mitigation for lost channel is offered.
