Dear Mr. Wallace:
The Division of Water Quality has reviewed your plans for the discharge of fill material into 0.99
acres of wetlands and an unclosed length of perennial streams located at SR1394 and SR2426 near Ranch
Creek in Mecklenburg County for a residential development at Poplar Tent Road site in Huntersville as
described in your application dated February 21, 2000. Insufficient evidence is present in our files to
conclude that your project must be built as planned in waters and/or wetlands in accordance with 15A
NCAC 2H .0506. Therefore, unless modifications of the proposal are made as described below, we will
have to move toward denial of your 401 Certification as required by 15A NCAC 2H .0507(e) and will place
this project on hold as incomplete until we receive this additional- information, we are requesting (by copy
of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold.
Please provide us with information supporting your position that states your project must be
constructed as planned and that you have no practicable alternative to placing fill in these waters and/or
wetlands. Specifically can you 1) specify the length of stream to be impacted, 2) avoid the stream impact
(other than road crossings) or relocate the stream using proper stream restoration methods (e.g., not making
it into a ditch), 3) reduce the impact to the non-isolated wetlands to 1/3 acre or less, (including the
unavoidable road crossings), 4) provide a site plan at a scale which is legible and 5) provide a stormwater
site plan for the commercial/retail portion of the site? Any documentation such as maps and narrative that
you can supply to address alternative designs for your project may be helpful in our review of your 401
Certification. Also this project will require compensatory mitigation as described in 15A NCAC 2H
.0506(h). Your mitigation proposal is insufficient because none was proposed.
Please respond within three weeks of the date of this letter by sending a copy of this information to
me and to the Mr. Samar Bou-ghazale, Mooresville Regional Office at (704) 663-6040. If we do not hear
from you in three weeks, we will assume that you no longer want to pursue this project and we will consider

Comments:
The applicant i. proposing to impact 0.99 acres of wetlands (0.1 of isolated wetlands, 0.2 for road
construction- and 0.69 acres for lot and road), and 650 linear feet of stream for the purpose of
construe ing a mixers single family and multi-family residential development. The applicant is
props2S1[lu,to enhance/restore and preserve wetlands within the floodplain. However, the applicant
may not monitor the area since the mitigation is voluntary, as explained by his consultant Mr.
Christopher ysman.
It is most likely thr at the proposed mitigation will not succeed if not monitored. During the discussion
with Mr. Huysmau, he agreed to mitigate for the stream on the site (along flood Ip aim or relocate the
stream along the property line between the lots. The wetlands score was 50 points on the wetlands
rating _worksheet.
It is recommended that the 401 certification be issued provided that mitigation for the stream im ap ct
has been approved, Also, wetlands mitigations should be approved only if the owner has agreed to

The purpose of this letter is to request authorization for proposed impacts to jurisdictional
wetlands and waters resulting from the construction of a proposed Residential Development
located in Mecklenburg County. The property is owned by Mr. John Woodley Wallace and is
located on Poplar Tent Road near the Cabbarus County line; the site is located on the
attached Cornielius, NC Quadrangle (attachment 1). Mr. Wallace is abandoning corn fields
and a small sod operation located on the site and replacing them with the proposed
development.
Proposed development would maintain approximately 2.7 acres of high-grade floodplain
wetlands on the site while directing impacts toward approximately 0.99 acres of low-grade
wetlands located in headwaters positions out side the floodplain. Wetlands that are
maintained would be enhanced/restored if approval for proposed impacts are granted.
Linear wetlands and headwaters areas will be lost; however, these low-grade wetlands are
not assessed to be important in function due to the absence of aquatic life and the inability
of the wetlands to store and treat flood waters. The linear wetland feature has a vegetated
substrate that is similar in texture to the adjacent high ground.
Site Conditions:
The development site is located almost entirely within areas utilized row-crop farming and
sod operations. The wetland surface hydrology of the site has been somewhat altered by
diversion swales and ditching relating to the agricultural operations. The attached Cabarrus
County Soil Survey (1976 aerial photo) shows no impounded water or channels on site
(attachment 2).
Five wetland features are located within the property. Three isolated small pockets of
wetlands totaling 0.1 acre are located within the fields. Approximately three acres of
scrub/wooded wetland is located in the floodplain. Another 0.65 acres scrub/wooded
wetland is located within the property near Huntersville-Concord Road and a gas utility.

Wetlands, proposed for impacts, are characterized by perched water tables over expansive
clays that have generated into scrub wetland vegetation. It is anticipated that evaporation
and transpiration likely lead to very dry conditions during summer months. This assessment
is based on the presence of upland species within some of the polygons; the upland
component, however, does not preclude the areas from jurisdiction. Hydrology within the
headwaters wetland is likely derived from precipitation and hydrology for the floodplain
wetlands is likely from flooding.
Proposed Imp:
The project requestsr'6uth rization for impacts under NW Permits 14 and 26 and their 401
Water Quality Certficatio . Impacts proposed under Nationwide 26 include:
• Approximately 0.1 apre of fill in isolated wetlands.
• Fill within th?entiri length of a linear wetland, approximately 0.04 acres (650 linear feet
by 3 feet) of unimportant linear feature, no crayfish or salamanders observed.
• Fill approximately 0.69 acres of low quality wetland for the purpose of lot and road fill
Impacts proposed under Nationwide 14 include:
• Approximately 0.2 acre of fill in a low quality wetland polygon for the construction of a
road.
Proposed Development Plan:
Attachment 3 illustrates the post-construction conditions, also depicted on the map is a
representation of the wetland impact and preservation/enhancement areas. The depiction
includes all identified jurisdictional features. Post-construction illustrates the preservation of
the majority of the large wetland in the flood plain of Ramah Creek. This illustration also
depicts a road crossing up stream of existing gas line easement; the crossing passes through
an existing low-grade perched wetland for a total impact of 0.2 acres. Another road parallel
and east of the above road is required for egress (dictated by the County). Lot fills are
requested to provide development pads within the balance of the polygon located between
the parallel roads
The commercial / retail portion of the site will be served by a storm water detention facility.
Avoidance and Minimization:
Impacts have been avoided to the extent practicable for the equitable development of the ?S
site for its proposed use as a Residential Development. Impacts to the largest highest
quality wetland have been avoided to the extent practical; but because of a density some
impacts are needed.
Impacts to wetlands within the floodplain have been reduced to those areas outside of
regulated floodplains. Required egress practices and good design principles mandate three
exits from the site onto Huntersville-Concord Road. Slope and curvature of the existing road
have in part dictated the location of the illustrated egress points. Efforts to secure the out
parcel located on Hu ntersvil le-Con cord Road have thus far been unsuccessful, otherwise the
egress points would be configured differently. The illustrated roadway configuration has
dictated that the lots be placed where shown. Roadways have been configured to have
minimal impact but leave jurisdictional areas on 6 lots.

Mitigation:
Mitigation is not anticipated because wetland impacts do not exceed 1.0 acres and impacts
to linear wetland are to those areas that were observed to be uninhabited by fish and
crayfish. Though not specifically required by statute, the applicant proposes to
enhance/restore and preserve wetlands within the floodplain as a mitigative measure, if the
project is approved. Restoration of natural historic hydrology would be achieved by the
closure of a ditch that drains the wetland located in the floodplain to Ramah Creek.
The ditching that drains the wetland is approximated on the drawing. The ditch would be
closed with compacted clay and the grade would be matched to existing floodplain surface.
The hydrology would subsequently be returned and the natural propogule base on the site
would be allowed to regenerate. Some plantings of native species may be undertaken to
increase the aesthetic value of the site. The wetland area would be protected by a
protective covenant but we proposed not to officially monitor the area because the
mitigation is voluntary; if acceptable, the state or Corps could monitor the site.

SUBJECT: Review of 404/401 Application by Wetland and Natural Resource Consultants, Inc. for
Poplar Tent Site, DWQ 000295, Mecklenburg County
The applicant is requesting a letter of concurrence from the North Carolina Wildlife Resources
Commission (NCWRC) to obtain a 404 Permit and 401 Certification. These comments are provided in
accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and
Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Impacts from the
development are indicated to be 0.3 acres of wetlands and 650 linear feet of channel.
The North Carolina Wildlife Resources Commission (NCWRC) continues to be concerned about
the fragmentation and loss of forested areas or woodlands as development occurs in areas near the City of
Charlotte and in or near Mecklenburg County. We appreciate the efforts to protect water quality by
providing stormwater detention and treatment. However, the NCWRC does not encourage the utilization
of existing waters or wetlands for water quality treatment facilities. Any efforts to maintain current
hydrographic conditions should also be beneficial. This is particularly true, as efforts are underway to
protect and restore portions of the Clark Creek watershed. The onsite mitigation by closing a ditch should
be integrated into the stormwater management strategies for the site.
If relocation of the stream is not economically feasible or practicable, we recommend that the wet
detention facility include vegetated littoral shelves for aquatic edge habitat as routinely required in 401
Certifications. In an effort to restore avian and terrestrial habitats as well as enhance aquatic/detritus
habitats in the detention facility, we recommend that the applicant provide for the restoration of tree and
shrub species similar to those currently found in the area (red maple, sweetgum, tulip poplar, dogwood).
Native species such as wild cherry, hickory and oak may be preferred over the above due to structural
concerns. These trees and shrubs should be planted around and on the upper third of the detention
structure, excluding the dam. They should provide habitat benefits that could offset those functions lost
by development, partially restore aquatic habitats, reduce exposure of the water surface to sunlight
thereby minimizing thermal pollution, provide essential summer and winter habitats as well as provide an
aesthetically pleasing green space which should enhance property values. Essentially, these plantings
could provide water quality and habitat benefits as well as provide a park area for residents.

trees per acre on the top and upper portions of the structure and at a minimal rate of 150 per acre around
the normal water elevation and littoral shelf area. The following list of tree species may assist in
providing habitat benefits:

Other species may be utilized depending on site requirements and availability. Pines* should not
exceed 15% of the reforestation. No more than 20% of the tree species will be of a single
species. An 80% success rate is acceptable over five years. Large or fast growing trees like
Sycamore and Maple** may not be appropriate around detention facilities.
The above recommendations should be considered for the multiple benefits that they can provide
to the community and to the environment. Initial costs should not be prohibitive and the long-term costs
should be reduced, as constant mowing would not be necessary in the naturalized areas. Thank you for
