Dear Mr. McLelland:
You have our approval, in accordance with the attached conditions and those listed below, to impact 335 feet of
stream for the purpose of constructing the Irwin Creek Relief Sewer - Contract II as you described in your application
dated January 9, 2002. After reviewing your application, we have decided that this fill is covered by General Water
Quality Certification Number 3288. This certification allows you to use Nationwide Permit Number 12 when the Corps
of Engineers issues it. In addition, you should get any other federal, state or local permits before you go ahead with your
project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water
Supply Watershed regulations. This approval will expire when the accompanying 404 or CAMA permit expires
unless otherwise specified in the General Certification.
This approval is only valid for the purpose and design that you described in your application except as modified below. If
you change your project, you must notify us and you may be required to send us a new application.. If the property is
sold, the new owner must be given a copy of this Certification and approval letter and is thereby responsible for
complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory
mitigation may be required as described in 15A NCAC 2H.0506 (h) (6) and (7). This approval shall expire when the
corresponding Nationwide Permit expires or as otherwise provided in the General Certification. For this approval to be
valid, you must follow the conditions listed in the attached

On behalf of Charlotte-Mecklenburg Utilities, we are hereby requesting a 2-year extension to
the 401 Water Quality Certification for the Irwin Creek Relief Sewers - Contract II project.
Coverage under General Water Quality Certification Number 3101 and Nationwide Permit
Number 12 was approved for the project on February 29, 2000. Enclosed please find copies of
the permit approval verifications for DWQ Project 000053.
The proposed project design has not changed since approval of the original 401 Water Quality
Certification. Final Design of the project is complete; however, construction has been delayed
due to fi.indi.ng and cash flow issues. Construction is scheduled to begin in May 2003.

Irwin Creek Relief Sewers - Contract II
Description of Activity:
Install 7695 LF of 36-inch and 54-inch relief sewer line along Irwin Creek, 1750 LF of 36-inch
relief sewer line along Stewart Creek, and 170 LF of 18-inch gravity sewer line adjacent to an
unnamed tributary to Stewart Creek. As part of the project it will be necessary to do 5
sub aqueous crossings of the above referenced streams. Original stream bank contours will be
restored after construction. Riprap will be used to restore stream banks below ordinary high
water and dormant cuttings of silky dogwood, silky willow, and elderberry will be planted
above ordinary high water.

On behalf of Charlotte-Mecklenburg Utilities (CMUD), we are submitting seven copies of the
joint Section 404 permit/Section 401 Water Quality Certification application for the Irwin Creek
Relief Sewers - Contract II project for your review. This project includes approximately 1,485
feet of 54-inch relief sewer, 7,960 feet of 36-inch sewer, and associated diversion structures and
manholes along the west side of Irwin Creek and Stewart Creek. A permit for this project is
requested under Nationwide Permit #12.
An Environmental Assessment was prepared for this project, and a final EA was submitted to the
State Clearinghouse in October 1998. Review of the EA through the State Clearinghouse was
completed on January 12, 1999 (see enclosed correspondence). Also enclosed please find a letter
from Mr. Barry Shearin, Chief Engineer of CMUD, authorizing Camp Dresser & McKee to act on
CMUD's behalf in signing the application on page 4 and a check for the application fee.

36-inch sewer along Irwin Creek from the Norfolk Southern Railroad tracks (lust south of Wilkinson Blvd to
West Trade Street in uptown Charlotte. In addition approximately 1,750 feet of 36-inch sewer will be
installed on the west side of Stewart Creek from the Irwin/Stewart Creek confluence to Freedom Drive Also

13. PURPOSE OF PROPOSED WORK: The purpose of the Irwin Creek Relief Sewers -Contract II
protect is to relieve the existing 36-inch Irwin Creek and Stewart Creek trunk sewers during wet-
weather events and handle wastewater flows at the Irwin Creek Wastewater Treatment Plant. The
sewer will also provide for future growth in the area.
14. STATE REASONS WHY IT IS BELIEVED THAT THIS ACTIVITY MUST BE CARRIED
OUT IN WETLANDS (INCLUDE ANY MEASURES TAKEN TO MINIMIZE
WETLAND IMPACTS)
The sewer must be constructed along Irwin Creek and Stewart Creek so that wastewater flows can be
conveyed by gravity. The sewer route was selected to minimize impacts to wetlands and streams. All
stream crossings by the sewers will be subaqueous and roughly perpendicular to the streams. The
sewer will be located below grade in all areas. Stream crossings will be restored with rip rap below the
ordinary high water mark and vegetation plantings (silky dogwood, silky willow, and elderberry) above
the high water mark. The stream banks will be restored to their original contours. Anti-seep collars
will be installed every 1,000 feet along the sewer route. Other than stream crossings no wetlands will
be disturbed during construction.

PROJECT DESCRIPTION
The Irwin Creek Relief Sewers - Contract II project consists of the following improvements:
Approximately 7,695 feet of 36- and 54-inch relief sewer along Irwin Creek This gravity
sewer will be installed parallel to an existing 36-inch sewer along the west side of Irwin
Creek from the Norfolk Southern railroad tracks (just south of Wilkinson Boulevard) to West
Trade Street in uptown Charlotte. The sewer will be interconnected with the existing sewer
to convey dry-weather flow from the Stewart Creek drainage basin and wet-weather flow
form the Irwin Creek and Stewart Creek drainage basins. The new sewer will be connected
to the Contract I portion of 54-inch relief sewer (soon under construction), which conveys
wastewater to the Irwin Creek Wastewater Treatment Plant.
Approximately 1,750 feet of 36-inch relief sewer along Stewart Creek. This gravity sewer
will be installed along the west side of Stewart Creek from the confluence of Irwin and
Stewart Creeks to Freedom Drive. The sewer will be interconnected with the existing sewer
and will convey dry-weather and wet-weather flow from the Stewart Creek drainage basin to
the Irwin Creek relief sewer. Construction of the sewer will allow the abandonment of an
existing inverted siphon under Stewart Creek.
Approximately 170 feet of 18-inch gravity sewer adjacent to a tributary of Stewart Creek
This sewer will be installed to intercept flow from an existing sewer on the west side of
Stewart Creek and will allow the abandonment of a second inverted siphon under the
tributary.
The 54-inch Irwin Creek relief sewer will cross Stewart Creek once at the confluence of Irwin
Creek and Stewart Creek. The 36-inch Irwin Creek relief sewer will cross Irwin Creek once near
West Trade Street. The 36-inch Stewart Creek relief sewer will cross Stewart Creek once and a
Stewart Creek tributary once. A 30-inch interconnector sewer will also cross Stewart Creek once
near Freedom Drive. At each stream crossing, the sewer will be grouted in a continuously welded
steel casing laid in a trench crossing the stream. All crossings will be subaqueous, and the top of
the pipe will be at least 1 foot below the bottom of the stream bed. Original stream bank contours
will be restored after construction. Rip rap will be used to restore the stream banks below the
high water mark, and dormant cuttings of silky dogwood (Corpus amomum), silky willow (Salix
sericea), and elderberry (&mbucus canandensis) will be used above the high water mark.

Dear Ms. Boone:
The North Carolina Natural Heritage Program has a record of one known rare species occurring
approximately 1-mile west and upstream of the proposed pump station and sewer pipeline project
in Charlotte, Mecklenburg County, North Carolina. The Federal/State Endangered freshwater
mollusk, Carolina Heelsplitter (Lasmigona decorata) was historically reported in Irwin Creek
approximately 1.0 mile west and upstream of the proposed pump station but not found in a recent
survey done in 1987.
Since the pipeline will be crossing the creek and tributaries several times, following the US Corp of
Engineers Best Management Practices for waterway sites is greatly advised.
Enclosed is a list of rare species that are known to occur in the Mecklenburg County. If suitable
habitat for any of these species occurs in the project areas, then those species may be present at the
project sites. To be certain that this site does not contain rare species, a field survey would need to
be conducted.

The county species list from the NC Natural Heritage Program is a listing of the elements (rare species, natural communities, and
special animal habitats) known to occur in a county. The information on this printout is compiled from a variety of sources,
including field surveys, museums and herbaria, literature, and personal communications. The Heritage Program's Biological and
Conservation Database (BCD) is dynamic, with new records being added and old records being revised as new information is
received. The BCD was developed and is maintained using methodology developed by The Nature Conservancy. The enclosed list
cannot be considered a definitive record of natural heritage elements, and it should not be considered a substitute for field surveys.

Program (NC Department of Environment and Natural Resources). E, T, and SC species are protected by state law (Plant
Protection and Conservation Act, 1979). C and SR designations indicate rarity and the need for population monitoring and
conservation action. WL indicates a species not warranting active monitoring, but believed to of conservation concern.
Animal statuses that indicate state protection (E, T, and SC) are published in Endangered Wildlife of North Carolina, March 16,
1992, Nongame and Endangered Wildlife Program (NC Department of Environment and Natural Resources). SR and EX statuses
are Natural Heritage Program designations. SR indicates rarity and the need for population monitoring and conservation action.
WL indicates a species not warranting active monitoring, but believed to of conservation concern.
FEDERAL STATUS
This status is designated by the US Fish and Wildlife Service. Federally listed Endangered and Threatened species are protected
under the provisions of the Endangered Species Act of 1973, as amended through the 100th Congress. Unless otherwise noted,
definitions are taken from the Federal Register, Vol. 56, No. 225, November 21, 1991 (50 CFR Part 17).

the US Fish and Wildlife Service does not recognize this designation.
T(S/A) Threatened due to Similarity of Appearence. "The American Alligator is threatened due to similarity of
appearance with other rare crocodilians and is listed for trade purposes. The species is no longer
biologically endangered or threatened and is not subject to Section 7 consultation." (U.S. FWS)
Please note that the US Fish and Wildlife Service no longer recognizes the following categories:
3A Candidate 3A A taxon formerly under consideration for listing, but for which there is "persuasive evidence of
extinction. "
3B Candidate 3B A taxon formerly under consideration for listing, but which current taxonomic understanding does not
support as a distinct entity meeting the Endangered Species Act's definition of "species. "
3C Candidate 3C A taxon formerly under consideration for listing, but which has been "proven to more abundant or
widespread than previously believed and/or (which is] not subject to any identifiable threat."
These ranks are determined by The Nature Conservancy's system of measuring rarity and threat status. "Global" refers to
worldwide ranks and "State" to statewide ranks.

FINDING OF NO SIGNIFICANT IMPACT
Environmental Assessment for the Irwin Creek Relief Sewers,
Pump Station, and Flow Equalization Facilities EA
Mecklenburg County, Catawba River Basin
An Environmental Assessment (EA) has been prepared, pursuant to the requirements of the
North Carolina Environmental Policy Act, for the proposed construction of a relief sewer, pump
station, and flow equalization basin to service the Irwin Creek drainage area which is located in
the north and northwestern portions of Charlotte in Mecklenburg County.
The proposed Irwin Creek relief sewers are located parallel to an existing sewer line along Irwin
Creek in Charlotte from the Irwin Creek WWTP to West Trade Street with another portion of the
relief sewer paralleling the existing sewer beginning at the confluence of Irwin.Creek and Stewart
Creek and continuing along the west side of Stewart Creek to Freedom Drive. The pump station
and flow equalization basin are to be constructed at the Irwin Creek WWTP on the west side of
the Creek. Wastewater from the Irwin Creek and Stewart Creek relief sewers will be conveyed to
the Irwin Creek WWTP. In dry-weather conditions, flow in the sewer will consist of only that
portion coming from the Stewart Creek side. This flow will be diverted to the McAlpine Creek
WWTP by an existing pipeline which already diverts part of the wastewater flow from Irwin
Creek to the McAlpine facility. During wet-weather periods, the proposed relief sewer will be
able to convey the wastewater flows from the Irwin Creek service areas which cannot be
adequately handled by the existing sewer. The flow will be pumped to the equalization basin for
treatment at the Irwin Creek WWTP.
Although the pipeline construction route was selected in order to minimize negative impacts to the
environment, there are several stream crossings proposed. Irwin Creek will be crossed once and
Stewart Creek three times. The pipeline is expected to be installed by temporarily diverting the
streams. Once the pipeline is installed, the appropriate backfill and erosion control techniques
will be used to comply with the Corps of Engineers Nationwide Permit 12. Stabilization of the
creek banks will take place immediately after construction by restoring the original stream
contours and seeding activities. Erosion in these stream crossing areas will be reduced by the use
of rip rap. No instream activities will occur between the months' of April to May in order to
reduce the impact to fish.
This EA and Finding of No Significant Impact (FONSI) are prerequisites for the issuance of
non-discharge permits by the Division of Water Quality for the pump station, distribution
pipeline, and equalization basin.
Based on the findings of the EA and on the impact avoidance and mitigation measures
contained therein, it is concluded that the proposed project will not result in significant impacts
to the environment. Pending approval by the State Clearinghouse, the environmental review for
this project will be concluded. An environmental impact statement will not be prepared.
