SETBACK WAIVER AGREEMENT
The undersigned property Owner(s) hereby permits Aqua North Carolina, Inc. and Fairways
Utilities, Inc. to construct an expansion and modification of The Cape Wastewater Treatment
System that may position wastewater treatment/storage tanks at least 10 feet from the property
line and at least 25 feet from any habitable residence or place of assembly located on the
property of the undersigned Owner(s).
The setbacks stated above apply as shown on the "Attachment A" for the property described as:

I certify that I am a deeded property owner of the above described property and am authorized
to make decisions regarding this property on behalf of other deeded property owners.
Furthermore, I certify that I have read and understand this Agreement and do hereby grant
permission to Aqua North Carolina, Inc. and Fairways Utilities, Inc. to construct wastewater
treatment /storage tanks as described herein. I further agree that upon the Division of Water
Resources' issuance of an Authorization to Construct the proposed expansion and modification of
The Cape Wastewater Treatment System, I will have this Setback Waiver Agreement recorded in
the New Hanover County Register of Deeds office and will provide copies of the recorded
Agreement to the Division of Water Resources and to Aqua North Carolina, Inc. / Fairways
Utilities, Inc.
