We wrote to you on October 27, 1999 discussing concerns that we have regarding the design of the project and placing it on hold until those concerns are addressed. We also met with you on November 9, 1999 and you agreed to supply additional information as outlined as outlined in our letter. As of today, we have not received a response to our earlier letter. Unless we receive a written response from you by May 19, 2000, we will consider that you have withdrawn this application and are not interested in pursuing the project at this time. Your letter states that the proposed house locations were not indicated on the plat. In my experience with writing PCN's, never before has this request been made. This information is still unknown at this phase of the project due to the fact that a Licensed Soil Scientist determines the locations of the houses when doing a lot by lot review of the site which is required by Wake County. Next, your letter states that the South Lake PCN indicated that wetland and stream impacts were "Not Applicable". This was my mistake in filling out the PCN. There are wetland impacts; it was determined that according to our plans there would be less than 1/3 of an acre of wetland impacts. This determination was reviewed by a Licensed Soil Scientist and there was a mutual agreement that this particular site would have less than 1/3 of an acre of wetland impacts according to our plans. Thirdly, your letter states that in my conversation with Cindy Bell I indicated that there were no wetland impacts. I recall indicating that there would be no wetland impacts over a 1/3 of an acre. If there was miscommunication, I apologize. In reference to Mr. Mitchell, lie had visited the site back in August, although I had forgotten to send him the proposed map. The day I received your letter, 1 realized what had happen and went to Mr. Mitchell's office and personally delivered a copy of the proposed map. In conclusion, our wetland impacts are less than 1/3 of an acre and both streams are subject to Neuse River Buffer. I hope this letter clears up most of (lie confusion, which was mainly my fault. Your application included a Pre- Construction Notification (PCN) and a preliminary plat delineating lots. The proposed house locations are not indicated on the plat. Based upon our review of the plat, it appears that at least two stream features and a pond are located within the boundaries of the project area. In your Pre-Construction Notification, you have indicated that wetland and stream impacts are "Not Applicable"; however, Section 10a indicates that wetland impacts would be "less than 1/3 of an acre." Furthermore, in Section 9b, you have stated that the number of wetlands located on the site is unknown. In a telephone conversation with Cyndi Bell, you indicated that no wetland impacts would be associated with this project, although crossings of an intermittent stream would be involved. You also indicated that any impacts to stream buffers had been approved in writing by Mr. Steve Mitchell of the DWQ Raleigh Regional Office. Mr. Mitchell has checked his files, and to date, has not yet been asked by you to review this project for the purposes of the Neuse Buffer Rules. We strongly suggest that you revise your PCN, and prepare a cover letter and maps to supplement your PCN form. The following list is provided for your use in preparing applications for this and any future 401 Cert ification or Neuse Buffer Rule requests you may submit. Provide a copy of a USGS topographic map or appropriate County Soil Survey with the`property boundaries and proposed work areas clearly indicated. If your property includes perennial or intermittent streams on either of these maps, you may be subject to the Neuse Buffer Rules. You should contact Steve Mitchell in our Raleigh Regional Office at (919) 571-4700 to have a site-specific Neuse Buffer determination made for your property. You should clearly discuss any buffer impacts proposed within your scope of work, and explain how these impacts were avoided and minimized. If buffer impacts are unavoidable and necessary to the project, buffer mitigation may be considered on a case-by-case basis. Any correspondence with Mr. Mitchell should be attached to your submittal. 2. Identify (by name) the streams impacted by the project, and clearly state the linear feet of impact (i.e. loss by burial or culverting, relocation, buffer removal) on each stream. If any stream channel ization/relocations are proposed, these must be included in your application. Also, you must identify the types of stream crossings proposed (i.e. culvert type, bridges, upstream and downstream rip-rap placement). If stream impacts exceed 150 linear feet of channel, stream mitigation may be required for impacts to perennial streams in accordance with 15A NCAC 211.0506. If a need for stream mitigation is anticipated, you should address how mitigation is to be conducted. Wetland Impacts - all of the following should be discussed: i) Have wetlands been avoided as much as possible? If so, how? ii) Have wetland impacts been minimized? If so, how? iii) Specify the area of wetland impacts, including the amount of each type of wetland community affected, and the quality of those systems. You should also identify the wetland classification system used. iv) Mitigation measures to compensate for wetland impacts may be required if impacts exceed one acre, in accordance with 15A NCAC 2H.0506. You should be aware that compensatory mitigation will be considered only after wetland impacts have been avoided and minimized to the maximum extent practical. On-site, in-kind mitigation is the preferred method of mitigation. In-kind mitigation within the same watershed is preferred over out-of-kind mitigation. Mitigation will be evaluated in the following order of acceptability: restoration, creation, enhancement, and lastly preservation. V) If no wetland impacts are involved, clearly state so. Do not simply state "unknown". 4. List the 404 Permit requested from the Corps of Engineers, so that we can determine which matching General Certification is applicable. For your information, the full text of each corresponding General Certification (GC) is available at http://h2o.enr.state.nc.us/wetlandc.html . 5. The 401/Wetlands Unit maintains a web page at http://h2o.ehnr.state.nc.us/Ndbranch/wetland/wetland.html . This includes a downloadable version of the Water Quality Certification Administrative Code (15A NCAC 2H.0500) and a discussion of the 401 application and review process within North Carolina. A downloadable version of the PCN form is also available at this location. Until the requested material is provided, your application will be placed on hold as incomplete. We are requesting (by copy of this letter) that the U.S. Army Corps of Engineers place your project on administrative hold. Also, we advise you that no work should be pursued at this project site until you have received written approval that your work is allowed in accordance with the Neuse Buffer Rules and Wetland Rules.
