However, additional information is required before the review may be completed. Please address the items on the attached pages no later than the close of business on April 2, 2020. Please be aware that you are responsible for meeting all requirements set forth in North Carolina rules and regulations. Any oversights that occurred in the review of the subject application package are still the Applicant's responsibility. In addition, any omissions made in responding to the outstanding items in Sections A and B, or failure to provide the additional information on or before the above requested date may result in your application being returned as incomplete. Please reference the subject application number when providing the requested information. All revised and/or additional documentation shall be signed, sealed and dated (where needed), with two paper copies and one electronic copy submitted to my attention at the address below. Application Forms: 1. The Land Owner's Agreement (FORM: LOA 06-16) indicates that the cover crop as row crops, but the Land Application Site Certification form (FORM: LASC 06-16) gives the cover crop as Bermuda grass. The cover crop observed during the February 17, 2020 site visit indicates that the cover crop was Bermuda grass. The Land Use section on the LOA 06-16 cover page shall be amended to reflect this cover crop. 2. The Edgecombe County GIS website shows that the western section of field DUNN-03 and all of field DUNN-02 are located within the 100-year floodplain. According to 15A NCAC 02T .1109(a)(1)(E), residuals shall not be land applied within the 100-year flood elevation unless the residuals are injected or incorporated within a 24-hour period following the application of residuals to land. This is also listed in Condition III.1 Le. of the previous permit issued August 21. 2015. However, section III.4.b of the RLAP 06-16 form shows that all 74.17 permitted acres will be surface applied. The Operation and Maintenance (O&M) plan also does not have any mention of incorporation or injection of residuals onto any field. In order for these fields to be included in the permit, they shall only be land applied via injection or incorporation. The total injection/incorporation acreage shall be reflected in section IIIA.b. of the RLAP 06-16 form. An updated O&M plan shall also be submitted to include operation functions associated with injection or incorporation for these fields. If incorporation/injection is not proposed for these fields, then they shall be removed from the permit. B. Site Man Any field changes due to A.2. of this request shall be shown on the site map and an updated LASC 06-16 form. Please note that the western portion of field DUNN-03 would need to be managed as separate from the rest of the field, and shall be considered its own separate field if injection/incorporation were to occur. 2. The southwestern part of the southern section of field DUNN-03 appears to be adjacent to a pond without an associated buffer. The appropriate 32.8 foot buffer shall be applied to this surface water in accordance with 15A NCAC 02T .1108(c). This shall be shown on both site maps and any acreage changes shall be shown on an updated LASC 06-16 form.
