Route 1 Box 264A Zirconia, NC, 28790 APPROVAL of 401 Water Quality Certification with Additional Conditions Dear Mr. Searcy: You have our approval, in accordance with the attached conditions, to place fill in 100 linear feet of streams in order to construct a road crossing associated with the proposed Rock Creek Subdivision in Henderson County, as described in your application received by the Division of Water Quality on November 19, 2001. After reviewing your application, we have determined that this fill is covered by General Water Quality Certification Number 3289, which can be downloaded from our web site at http://h2o.enr.state.nc.us . This Certification allows you to use Nationwide Permit Number 14 when it is issued by the U.S. Army Corps of Engineers. In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Non-Discharge and Water Supply Watershed regulations. You should send an application to the Division of Land Resources for their review of your project under dam safety rules as well as erosion and sediment control. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification as well as the additional conditions listed below: 1. Deed notifications or similar mechanisms shall be placed on all lots with remaining jurisdictional wetlands and waters or areas within 50 feet of all streams and ponds. These mechanisms shall be put in place within 30 days of the date of this letter or the issuance of the 404 Permit (whichever is later). A sample deed notification format can be downloaded from the 401/Wetlands Unit web site at http://h2o.enr.state.nc.us/ncwetlands ; 2. The Division of Land Resources' Design Standards in Sensitive Watersheds (15A NCAC 04B .0124) must be adhered to throughout the life of this project. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this letter. To ask for a hearing, send a written petftion which conforms to Chapter 150B of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. The developers propose to enclose an unnamed tributa to the Green River in 80 feet of 48" corrugated steel culvert to provide access to a proposed housing development, evelopment. The unnamed tributary to the Green River bears a Class R-Trout HOW classification. The stream segment which would be culverted has, in the past, been straightened and, through removal of woody vegetation, exposed to sunlight. Phys?y it is in the order of 1 1/2 feet wide and 1" to 2" deep. I am currently dealing with the developers on the matter of a stormwater permit. I have driven the project and find no other wetland issues. I have not seriously__raised the issue of bridg'ng rather than culverting for the reason of abuses suffered by the stream in the past. The original project Entrance joined Green River Road. Project roads included no new stream crossings. An Approval Letter for Erosion Plans for Phase I is included. Subsequent to the approval of the project, the Developer has secured a right-of-way across adjacent property to Rock Creek Road. The proposed new location crosses an un-named tributary to the Green River. The Green River is classified Trout Waters. This request is for a variance to the 25 foot riparian zone buffer requirement for 100 feet to allow for the installation of 80 feet of 48" culvert for a road crossing. As shown in the attached construction notes and details, the culvert will be buried below the existing stream bottom to allow for restoration of the channel bottom through the culvert. I have enclosed copies of plans and other information which has been submitted to the Corps and Sedimentation and Erosion Control. We find the plan to be acceptable and hereby issue this Letter of Approval with modifications and/or performance reservations. A list of the modifications required and/or reservations is attached. This approval is conditioned upon the incorporation or addition of these items to the plan. Please be advised that Title 15A, North Carolina Administrative Code 46.0017(a), requires that a copy of the approved soil erosion control plan be on file at the job site. Also, you should consider this letter to give the Notice required by NCGS §11 3A-61 (d) of our right of periodic inspection to ensure compliance with the approved plan. This plan approval shall expire three (3) years following the date of approval, if no land-disturbing activity has been undertaken, as is required by Title 15A NCAC 46.0029. The State's Sedimentation Pollution Control Program is a performance-oriented program requiring protection of the natural resources and adjoining properties. If, following commencement of this project, it is determined that the plan is inadequate to meet the requirements of NCGS §113A-51 to 66, this office may require revisions to the plan and implementation of the revisions to ensure compliance with the Act. Acceptance and approval of this plan is conditioned upon your compliance with federal and state water quality laws, regulations, and rules. In addition, local city or county ordinances or rules may also apply to this land-disturbing activity. This approval does not supersede any other permit or approval. Please note that this approval is based in part on the accuracy of the information provided in the Financial Responsibility Form which you have provided. You are requested to file an amended form if there is any change in the information included on the form.
