Box 143 Fuquay-Varina, NC 27562 Subject Property: Lot 85, 12313 Amoretto Way, Raleigh, Wake County NC UT to Sycamore Creek [03-04-02; 27-33-9; B NSW] Dear Mr. Bender, On November 19, 2001, Mr. Bob Zarzecki of this office met with you on the subject property to discuss compliance issues regarding proposed channel maintenance. The proposed channel maintenance work involves the potential removal of fifteen (15) square feet of approximately one-foot deep sediment from a channel at the mouth of a stormwater outlet pipe located along the property's south-western boundary. The Division of Water Quality (DWQ) has determined that this is an "exempt" activity under the Neuse River Riparian Buffer Rules if the following conditions are met. We have determined that this activity will not require written concurrence from the DWQ for the use of the General Certification No. 3279. For this determination to be valid the following conditions must be met. 1. No removal of woody vegetation shall occur. Any grassed lawn disturbed must be re-seeded immediately following completion and the area stabilized with appropriate measures to ensure no additional soil will enter the stream. 2. The removal of sediment shall be limited to approximately five feet from the end of the stormwater outlet pipe. No more than one foot deep of sediment shall be removed. The activity shall not otherwise change the original dimensions of the channel. 3. No additional stormwater conveyances shall be directed to the channel without first providing diffuse flow prior to entering the protected buffers. This "exemption" determination completes the Neuse River Buffer compliance review of this project. If you have any additional questions please feel free to call Mr. Zarzecki at 919-733-9726. Box 143 Fuquay-Varina, NC 27526 November 15, 2001 Dear Sheila, Telephone: 1- 919-552-8920 Fax: 1- 919-552-7787 As per your request, here is my evaluation of the reinforced concrete storm drain pipe, which is located at the back of lot 85 on Amaretto Way. The above location was inspected Thurs., Oct. 18, 2001 in the p.m. The outflow or exit side of the pipe is visible at the rear of the lot, narrows from 36" to 18", and flows into the wooded area via an open stream channel. This stream channel was observed to have consistent moving water, no dry pockets, and no observed "stagnation" and /or still water. The bank was well stabilized with native vegetation and no evident erosion or obstruction. The end of the pipe evidenced some accumulation of fines and sediment, but this did not appear to restrict natural flow. At this time, it does not appear that any excavation is necessary (particularly due to the negative impact on the well established wooded area versus the merits of a "faster flowing" stream channel).
