Ristaino 21524 Delftmere Drive Cornelius, NC, 28031 APPROVAL of 401 Water Quality Certification and Catawba River Buffer Rules Dear Mr. Ristaino: You have our approval, in accordance with the attached conditions, to place fill in 0.04 acre of waters in order to stabilize the shoreline on your property on Lake Norman in Mecklenburg County, as you described in your application received by the Division of Water Quality on November 15, 2001. After reviewing your application, we have decided that this fill is covered by General Water Quality Certification Number 3280, which can be viewed on our web site at http://h2o.enr.state.nc.us/ncwetlands . This Certification allows you to use Regional Permit Number 198200030 when the Corps of Engineers issues it. This approval is also valid for the Catawba River Mainstem and Lake Buffer Protection Rule (15A NCAC 2B .0243). In addition, you should get any other federal, state or local permits before you go ahead with your project including (but not limited to) Sediment and Erosion Control, Coastal Stormwater, Non-Discharge and Water Supply Watershed regulations. Also this approval will expire when the accompanying 404 permit expires unless otherwise specified in the General Certification. This approval is only valid for the purpose and design that you described in your application. If you change your project, you must notify us in writing and you may be required to send us a new application for a new certification. If the property is sold, the new owner must be given a copy of the Certification and approval letter and is thereby responsible for complying with all conditions. If total wetland fills for this project (now or in the future) exceed one acre, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). For this approval to be valid, you must follow the conditions listed in the attached certification. If you do not accept any of the conditions of this certification, you may ask for an adjudicatory hearing. You must act within 60 days of the date that you receive this iettEr. To ask for a hearing, send a written petition which conforms to Chapter 1508 of the North Carolina General Statutes to the Office of Administrative Hearings, P.O. Box 27447, Raleigh, N.C. 27611-7447. This certification and its conditions are final and binding unless you ask for a hearing. This letter completes the review of the Division of Water Quality under Section 401 of the Clean Water Act. Most homes have established lawns down to the water. The applicant imposes to construct a low concrete and rock bulkhead along the existing crass shoreline and rebuild his existing boat dock. Ristaino, Lot 2, Delftmere Subdivision, Mecklenburg County The applicant is requesting 401 Water Quality Certification from the North Carolina Division of Water Quality to stabilize 110 feet ol?shoreline on Lake Norman with masonry and rock. The NCWRC has reviewed information provided by the applicant, and field biologists on our staff are familiar with habitat values of the project area. These comments are provided in accordance with provisions of the Clean Water Act of 1977 (33 U.S.C. 466 et. seq.) and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661-667d). Based on our review of the documents submitted, we have no objection to the project since the site is shown to be located in an area identified as acceptable for this type of activity on Duke Power Company's "Critical Habitat Inventory" maps. Concerning shoreline stabilization using riprap or other hard structures, this office prefers the use of a more "natural" approach. A combination of riprap used to two feet above normal pool elevation with banks sloped back and vegetated with grass, willows or other acceptable woody vegetation. This creates a more "natural" bank. A filter fabric should be used to prevent soil from eroding from behind the riprap during high water and/or wave action. Riprap should be imbedded roughly 18 inches into the substrate to prevent undercutting. We also recommend the establishment of native shoreline vegetation for enhanced habitat and shoreline erosion control. Please be advised that bake Norman shoreline activities must follow Duke Power Guidelines and any other special conditions (including Catawba River buffer requirements) specified by the NC Department of Environment and Natural Resources. But the Catawba Rules also apply, and no practical alternatives language described in the packet I was given. An allowed use. There was a very minimalistic summary of how the owner would try to keep the damage to a minimum. I think he should go further, and I suggest making him replant as many trees as he removes. 011670 (Panther Creek - Raleigh LP, Wake Co.) - What a monster of a project!!! This project is in WS-IV-PA near Jordan Lake. Neuse Rules don't apply. The Wake County will need to review project for BUA, VO stormwater, buffer requirements. My guess is that it's a high density project, which will require stormwater BMPs and 100' buffers. They're looking to have another 5 stream/buffer crossings for access around the site. 7 crossings were allowed under a previous permit. WSWP Rules do not allow these crossings since it's a private project. Of course we can't deny access to a site, but they already have 7 and I don't think they need all 5 of the ones they're asking for now. Strict adherence to the WSWP Rules would say deny the permit. But if we have to allow it, the crossings must minimize BUA, divert runoff away from surface waters, use BMPs, and show no practical alternative. There was no summary included on how there was no practical alternative summary given for the 5 access crossings they're requesting now. Plus they don't want to pay for mitigation for 4 of the 5 points since they already paid for them in the previous permitting process. It's not our fault their permit ran out before they built them. It's a new permit and I think they should have to pay again - but WSWP Rules don't have anything to say about that. 011691 (Town of Hillsborough, Orange Co.) - WSWP and Neuse Rules apply. `? It may be useful to provide information related to site constraints such as topography, building ordinances, accessibility, and financial viability of the project. The applicant may attach drawings of alternative, lower-impact site layouts, and explain why these design options were not feasible. Also discuss how impacts were minimized once the desired site plan was developed. If applicable, discuss construction techniques to be followed during construction to reduce impacts. Page 7 of 12 VIII. Mitigation DWQ - In accordance with 15A NCAC 2H .0500, mitigation may be required by the NC Division of Water Quality for projects involving greater than or equal to one acre of impacts to freshwater wetlands or greater than or equal to 150 linear feet of total impacts to perennial streams. USACE - In accordance with the Final Notice of Issuance and Modification of Nationwide Permits, published in the Federal Register on March 9, 2000, mitigation will be required when necessary to ensure that adverse effects to the aquatic environment are minimal. Factors including size and type of proposed impact and function and relative value of the impacted aquatic resource will be considered in determining acceptability of appropriate and practicable mitigation as proposed. Examples of mitigation that may be appropriate and practicable include, but are not limited to: reducing the size of the project; establishing and maintaining wetland and/or upland vegetated buffers to protect open waters such as streams; and replacing losses of aquatic resource functions and values by creating, restoring, enhancing, or preserving similar functions and values, preferable in the same watershed. If mitigation is required for this project, a copy of the mitigation plan must be attached in order for USACE or DWQ to consider the application complete for processing. Any application lacking a required mitigation plan or NCWRP concurrence shall be placed on hold as incomplete. An applicant may also choose to review the current guidelines for stream restoration in DWQ's Draft Technical Guide for Stream Work in North Carolina, available at http://h2o.enr.state.ne..us/ncwetlands/strmgide.html. 1. Provide a brief description of the proposed mitigation plan. The description should provide as much information as possible, including, but not limited to: site location (attach directions and/or map, if offsite), affected stream and river basin, type and amount (acreage/linear feet) of mitigation proposed (restoration, enhancement, creation, or preservation), a plan view, preservation mechanism (e.g., deed restrictions, conservation easement, etc.), and a description of the current site conditions and proposed method of construction. Please attach a separate sheet if more space is needed. Page 8 of 12 2. Mitigation may also be made by payment into the North Carolina Wetlands Restoration Program (NCWRP) with the NCWRP's written agreement. Check the box indicating that you would like to pay into the NCWRP. Please note that payment into the NCWRP must be reviewed and approved before it can be used to satisfy mitigation requirements. Applicants will be notified early in the review process by the 401/Wetlands Unit if payment into the NCWRP is available as an option.
