WSIV, B, NSW] Dear Ms. Karoly: This letter has been written in response to your letter dated December 21, 2006 related to deficiencies in a 401 Water Quality Permit Request submitted to the Division of Water Quality by the Division of Parks and Recreation. Below please find the responses to your questions related to the permit submission: 1. All intended bank stabilization work is shown on the original site plan. 2. 2. All work will be done in Riparian Buffer Zone 1, as shown on the attached map (3,700 square feet). Access to the dam will be from the adjacent parking lot. The disposal area shown on the plan is located in the parking lot and, if used, will only be for temporary stockpilling of excess material until its disposal in a permitted landfill. The temporary disposal area is located outside of the 50-foot riparian buffer area. The table in Section X of the permit has been included to show the slight modification in amount of riparian zone impacts (50 square feet less impacts than shown in the original table). 3. The attached map shows the riparian buffer area on the original planting map. 4. All work is being done on State Park property. No easements will be required to perform the work proposed in the original permit submittal. 5. All work will be completed by mechanical means using hoe ram, jack hammers, or similar equipment. Streamflow through the work site will continue its present course (through the dam gates) during dam removal and the excavation of the new channel. Dam material will be temporarily stockpilled in an existing dry area behind the dam. Once the dam is demolished and the new channel created, the new channel will be opened and the flow diverted through it. Once the flow is diverted through the new channel, the dam material and river-rock material that accumulated behind the dam will be used to rebuild and stabilize the west stream bank. Water quality problems are not anticipated and would be temporary since most of the work is being completed in dry areas. The material being moved is very course and not subject to suspension. 7. Proposed Impacts on Riparian and Watershed Buffers (required by DWQ) It is the applicant's (or agent's) responsibility to determine, delineate and map all impacts to required state and local buffers associated with the project. The applicant must also provide justification for these impacts in Section VII above. All proposed impacts must be listed herein, and must be clearly identifiable on the accompanying site plan. All buffers must be shown on a map, whether or not impacts are proposed to the buffers. Correspondence from the DWQ Regional Office may be included as appropriate. Photographs may also be included at the applicant's discretion. 1.
